ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN 'l'HE CITY pwa

OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH
GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1944, TO DEFRAY TIm COST
AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF
ORDINANCE NO. 696 OF THE CITY OF BOZEMAN.
WHEREAS, the City Commission of The City of Bozeman did on the 8th day of January,
I 1940, duly and reg"larly pass Ordinance No. 696 entitled:
"AN ORDINANCE D~FINING GARBAGE FOR THE PURPOSES OF TI-IIS ORDINANCE; PROVIDING
FOR THE COLLECTION AND DISPOSITION THEREOF BY AND UNDER THE SUPERVISION AND
CONTROL OF THE DEPARTMENT OF PUBLIC WELFARE AND FOR DEFRAYING THE COST OF
SUCH COLLECTION AND DISPOSITION BY :)PECIAL ASSESSMENT AGAINST THE PROPERTY
TO WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR VIOLA TION OF
TI-IIS ORDINANCE,
which Ordinance No. 696 passed as aforesaid is hereby referred to and made a p',rt of this
resolution for further particulars in respect to the basis and method of assessing the
cost against the property herein assessed; and,
WHEREAS, said expense incurred by said City in the collection and disposition of
garbage in accordance with said Ordinance is hereby estimated by the Commission of The
City of Bozeman to be the sum of Ten Thousand Eight Hundred Eighty-four Dollars and Thir-
teen Cents, ($10,884.13), for the year 1944, over and above all moneys collected from
business and professional concerns, or combined residence and business, or re~idence and
professional business concerns in accordance with said Ordinance No. 696; and,
WHEREAS, in order to raise said S11m to defray said cost,
it is necessary to establish
the basic unit rate as defined in said Ordinance No. 696 at Four Dollars and Forty Cents
I ($4.40) .
NOW, THEREFORE, pursuant to the provisions of said Ordinance No. 696, and tbe laws of
the Sta te of Mintana;
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COln~ISSION OF THE CITY OF
BOZEMAN, STATE OF MONTANA
Section 1. That to defray the estimated cost and expense of collecting and disposing
of garbage in The City of Bozeman for the year 1944, there is hereby levied and assessed
against the property and the several lots, pieces and parcels of land thereof within The
Ci ty of Bozeman as set forth in Schedu Ie It A", which is a ttached hereto and made a part
hereof, a tax; that a particular description of each lot and parcel of land with the name
of the owner and/or owners and the sum assessed agains t the same is set forth in the assess-
ment list in said Schedule "A"; that the sevRral sums set opposite the names of said owners
and the described lots and parcels of land, be, and the same hereby are levied and assessed
lJpon and agains t said lots and parcels of land for said purpose; that the several sums be
collected from the respective owners of said lots and parcels of land described in said
assessment list and owned by them; that said sums shall be paid and the collection thereof
I be made in the manner and in accordance with Ordinance No. 696 of The City of Bozeman,
Montana and the laws of the State of Montana governing the collection of spec:1al improvement
taxes; tha t failure to pay such assessmen t when the same shall become due and payable shall
make such person and such lots and parcels of land liable to the penalties provided by
law relative to delinauent taxes.
Sec tion 2. That the rC~llar session of the Commission of The City of Bozeman, Montana,
to be held :Ln the Commission Chamber in the City Hall of said City on the 29th day of
P.M.
September, 1944, at 7:30 o'clock/be and the same is hereby designated as
the time and

place at which objections to the final adoption of this Resolution will be heard by
said Commission.
Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is
hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper
printed and published in said City of Bozeman, a notice signed by the Clerk of the
Commission, stating that a Resolution levying and assessing a special assessment of

taxes to defray the cost and expense of the collection and disposition of garbage in
The Ci ty of Bozeman fur the year 1944, against the property to which such service was
rendered, is on file in the office of the Clerk of the Commission, subject to inspection
for a period of five days; tha t sa id no tice sha 11 s ta te the time and place at which
ob-
jections will be heard by the Commis8ion to the fin~l adoption of this Resolu tiOD; and tha t
said notice shall be published at least five days before the day set by the Commission
for hearing of objections and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of The City of Bozeman at a regular
session thereof held on the 22nd day of September, 1944.

FOR THE YEAR 1944, AGAINST ALL PRO PERTY IN THE CI TY OF BOZE:MAN TO WHICH
SUCH SERVICE WAS RENDERED.
NOTICE IS I~REBY GIVEN, Tha tat a regular session of the Commission of The City of
Bozeman, held on the 22nd day of September, 1944, Commission Resolution No.
546, was pro-
visionally passed and adopted; that said Resolution levies and assesses a special assess-
men t of taxes to defray the cost of collection and disposition of garbage in The City of
Bo zeman, for the year 1944, upon all property to which such service wes rendered.
That
said Commission Resolution No. 546, is now on file in the office of the Clerk of
the
Commission of The City of Bozema~, sub.1ect to the inspection of all p8r~ons
interested,
for a period of five days; thAt Friday the 29th day of September, 1944, at 7:30
o'clock
P.M. of said day at a re,~~lar session of the Commission of The City of Bozeman, in the

Commission Room, in the C1 ty Hall BUild:tng, has been designated as the time and place
when and where said Commission will hear and pas:"! upon any and all objections that may
be made to the final passage and adoption of said Commission Resolution No. 546 and
the
levying of said assessment; and that said Resolution will be finally passed and adopted
at said regular session of said Commission, sub J eo t to such correc tions and amendmen ts
that may be made upon objections made and filed with the Clerk of the Commission within
the f1 ve days' limit as provi0ed by law.
