THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF REMOVAL OF SNOW FOR THE YEAR 1944-145 PURSUANT TO PROVI- SIONS OF ORDINANCE NO. 502, ENTITLED: "AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CITY OF BOZEMAN AND RE- PEALING ORDINANCE NO. 385, ENTITLED: 'AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH, AND OTHER OBSTRUCTION FROM SIDE- I WALKS ON MAIN STREET BETWEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN'''. WHEREAS, the City Council of The City of Bozeman heretofore duly and regularly passed Ordinance No. 502, entitled: "AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CITY OF BOZEMAN AND REPEALING ORDINANCE NO. 385, ENTITLED: 'AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH AND OTHER OBSTRUCTION FROM SIDEWALKS ON MAIN STREET BE1WEEN WALLACE A VENUE AND FOUR TH A VEl\\11JE IN Th'E CITY OF EOZEMAN''', and WlillREAS, Section 5039.6 R. C. M., 1935, provides: "The City of Town Council has power to regulate the use of sidewalks, and to require the owners of the premises adjoining to keep same free from snow xx xxx; and to provide for levying the cost of removal as a special tax against the property xx xxx and WHEREAS, owners of premises in said City have neglected to remove the snow from the sidewalks adjoining thereto during the year 1944-1945 and The City of Bozeman, pursuant to Section 5039.6, and Ordinance No. 502 has removed the snow from the sidewalks adjoining the premises of said owners and the total cost of the removal thereof is chargeable to the property as hereinafter set forth, pursuant to provi- sions of said Section 5039.6 Political Code, R. C. M., 1935, and said Ordinance No. 502; I NOW, THEREFORE BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE CONMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That during the year 1944-1945, The City of Bozeman has removed snow from sidewalks adjoining premises in The City of Bozeman and defrayed the cost thereof as set forth in Schedule "One" hereto a ttached and made a part hereof. Section 2. That to defray the cost ($92.68) of removing said snow from side- walks adjoining said premises as set forth in said Schedule "One", hereto attached and made a part hereof, for the year 1944-1945, there be, and there is hereby levied and assessed a special tax against said property as set forth in said Schedule "One" hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked Schedule "one", and made a part hereof; tha t the several sums set opposi te the name of the owners and the descrip- tion of the lots and parcels of lands be, and the same are hereby levied and assessed upon and against said lots and parcels of land; tha t the several sums be collected from the respective owners of said lots and parcels of' lands described in said assess- I ment list, Schedule "One" as required by law; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law govern- ing the collection of special improvement taxes; that failure to pay such assessments when same shall become due and payable shall make such person and such lots and par- cels of land liable to the penalties provided by the law relative to delinquent taxes. Section 3. Tha t the regular session of the Commission of The Ci ty of Boz eman to .~" . oL1[j be held on the 12th day of October, 1945, at the Commission Room, City Hall Building, be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and he is hereby directed and I ordered to publish in the Bozeman Daily Chronicle, a daily newspaper printed and publi- shed in said City of Bozeman, a notice signed by the Clerk of the Commission, and stat- ing that a resolution levying a special assessment of taxes to defray the cost of removal of snow and ice from sidewalks adjoining certain premises in The City of Bozeman for the year 1944-1945 is on file in the office of the Clerk of the Commission, subject to inspection for a period of five ( 5) da ys ; that said notice shall state the time and place at which objections will be heard by the Commission to the adoption of this Resolu- tion; that it shall be published at lease five days before the date set by the Commis- sion for hearing of objections and the final adoption of this Resolution. Provisionally passed and adopted by the Commission of The City of Bozeman at a regular meeting of said Commission on the 5th day of October, 1945. ATTE:Z ~.~ Clerk of the ommission Finally passed and adopted by the Commission of The City of Bozeman at a regular session of said Commission on the 12th day of October, 1945. .1 ~ATTE~ . ~kO~ NOT ICE ------ HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 561 LEVYING SPECIAL ASSESSMENT TO DEFRAY THE COST OF REMOVAL OF SNOW FROM THE SIDEWALKS ADJOINING CERTAIN PREMISES IN THE CITY OF BOZEMAN FOR THE YEAR 1944-1945. NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of The City of Bozeman held on the 5th day of October, 1945, Commission Resolution No. 561 was duly passed and adopted; that said Commission Resolution No. 561 levies and assesses a spec- ial assessment of taxes upon certain properties in 'l'he Ci ty of Bozeman for the year 1945 to defray the cost of removal of snow for the year 1944-1945. That said Commission Resolution No. 561 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interest- ed for a period of five (5) days by any person interested; that Friday the 12th day of I October, 1945, at 7:30 o'clock P.M., of said day at a regular session of the Commission of The City of Bozeman, Commission Room, City Hall Building, has been designated as the time and place when and and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission Resolu- tion No. 561 and the levying of said assessment; and that said Resolution will be final- ly passed and adopted at said regular session of said Commission, subject to such correc- tions and amendments as may be made upon objections made and filed within five days limit as provided by law. ~/ Dated this 6th day of October, 1945.
