A R8~SOLU'I'ION OF THE COmnSSION OF THE CITY OF BOZEMAN, LEVYING .-- ;t1 r:~J.._--- AND ASSESSING A SPECIAL ASS-SSS~,mNT OF TAXES UPON CERTAIN PROPER- ~..,...--" TIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR TIlE YEAR 1945, PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 428; ENTITLED: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES." WHEREAS, the City Council of The City of Bozeman heretofore duly and regularly I passed Ordinance No. 428, enti tIed: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES", and WHEREAS, Section 5039.82, R.C.M., 1935, provides the City or Town Council has power to declare and determine what vegetation within the City or Town shall be noxious weeds, and to provide the manner in which the y sha 11 be exterminated, and to require the owner or owners of any property within said City or Town, to exterminate or remove noxious weeds from their premises, and the one-half of any road or street lying next to the lands or boulevard abutting thereon, and to provide, in the event the owners or owner of any of said premises neglect to exterminate or remove the noxious weeds therefrom, for levying the cost of such extermination or removal as special assessment against the property; and WHEREAS, owners of premises in said City have neglected to exterminate and re- move noxious weeds therefrom during the year 1945, and The City of Bozeman, pursuant to Section 5039.82 R.C.M., 1935, and Ordinance No. 428, have exterminated and removed noxious weeds from the premises of said owners and the total cost of the extermina- I tion and removal thereof is chargeable to the property as hereinafter set forth, pur- suant to provisions of said Section 5039.82, Political Code, R.C.M., 1935, and said Ordinance No. 428; NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMJVlISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. Tha t during the year 1945, The City of Bozeman has exterminated and removed noxious weeds from properties in The City of Bozeman and defrayed the cost thereof as set forth in Schedule "A" hereto attached and made a part hereof. Section 2. That to defray the cost ($68.82) of exterminating and removing said noxious weeds from said premises as set forth in said Schedule, hereto attached and made a part here- of, for the year 1945, there be, and there is hereby levied and assessed a special tax against said property as set forth in said Schedule, hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list here- I to attached marked Schedule "Au, and made a part hereof; tha t the several sums set opposite the names of the owners and the description of the lots and parcels of lands be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of lands described in said assessment list, Schedule itA" as required by , law; tha t said sums shall be paid and the collection thereof shall be made in the - manner and in accordance with the law governing the collection of special improvement ~) jl t.V _ __ taxes; that failure to pay such assessments when same shall become due and payable' "- shall make such person and such lots and parcels of land liable to the penal tJ.~s pro- vided by the law relative to delinquent taxes. Section 3. Tha t the regular session of the Commission of The Ci ty of Bozeman to be held on I the 31st day of August, 1945, a t the Commis sion Room, Ci ty Hall Building, be and the same 1s hereby designated as the time and place at which objections to the final adop- tion of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be and he is hereby ordered and directed to ~lblish in the Bozeman Daily Chronicle, a daily newspaper, printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a resolution levying an assessment of taxes to defray the cost of exterminating and re- moving noxious weeds from certain properties in The City of Bozeman for the year 1945 is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said notice shall state the time and place at which objec- tions will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing of objections, and the final adoption of this resolution. Provisionally passed by the Commission of The City of Bozeman at a regular session thereof held on the 24th day of August, 1945.
