DISTRICT IN CERTAIN STREETS AND AVENUES AS HT':RT~INAFT'<:R IN TnI~) F:':~_)C!LUTION PAR'I'ICULARLY DESCRIBED AND D~SI CH; A Tf,~D, AND TO SPF~CIALLY M3S1~;:',~) THi=<: "8~NTIRE COST AND EXPENSE OF SUCH INSTALLATION AND CONSTRUC'I'ION AGAINST TITS PROPERTY WITHIN SAID SPECIAL IMPROVElVTENT DISTRICT UNDER AND BY VIRTUE OF 'I'HE PROVISIONS OF SECTION 5225 to 5277, INCLUSIVE, REVISED CODBS OF MONTANA, 1935, AND ANY AMENDE- I MENTS THEREOF OR THERETO. which Commission Resolutions Nos. 557 and 558, pRssed as aforesaid, are hereby re- ferred to and made a part of this resolution for further partic-ulars in respect to the boundaries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WlillREAS, said improvements as contemplated in said Commission Resolutions Nos. 557 and 558 have been constructed and completed in accordance with the terms and conditions of Comrrission Resolutions Nos. 557 and 558, and the total cost of said improvements so const~1cted is the sum of Seven 'Thousand 31xty One Dollars and Sixty Cents ($7,061.60). NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C.M., 1935 and amendments thereto, BE IT R8S0LVED A1-TD IT IS HEREBY ORD14~RED BY THE CmTrfISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. Tha t to defray the cos t and expense of cons tructing and making the improvements in said Special Improvement District No. 338, there be, and there is I hereby levied and assessed a tax amounting to the sum of Seven Thousand Sixty One Dolla rs and Six ty Cen ts, ($7,061.60) upon all the property in said Special Improve- ment District No. 338; tha t a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improve- ments and the amount of each partial payment to be made and the day when the same 3t"jf',;' (t> shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A" and made a part hereof; tha t the se vera 1 sums se t oppos i te the , names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making improve- I ments within said District; tha t the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment lis t, Schedule "A" as required by law; the t the pa yment of said sums shall be made , in ten installments and the payment of said installments shall extend over a period of nine years; that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereof, sha 11 be made; tha t said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delin- quent taxes. Section 2. That the re~mlar session of the Commission of the City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 17th day of May, 1946 , at 7:30 o'clock, P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard I by the said Commission. Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news- paper prin ted and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special aSS8SS- ment of taxes to defray the cost and expense of const~lcting and making the improve- ments in the said Special Improvement District No. 338 is on file in the office of the Clerk of the Commission subject to inspection for a period of five ( 5) da ys ; that said notice shall state the time and place at which objections will be heard by the Commis- sion to the final adoption of this Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolution. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman, held on Friday the lOth day of May, 1946, Commission Resolution No. 572 I was duly passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 338 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-wi t: Beginning at a point in the North line of West Curtiss Street where the same is intersected by the center line of the alley between Tenth and Eleventh Avenues; thence South along the cen- ter line of said alley to its intersection with the South line of West Curtiss Street; thence West along the South line of West Curtiss Street to the West line of eleventh Avenue; thence S01.1 th a long the Wes t line of Eleventh Avenue to the South line of West Story Street; thence West along the South line of West Story Street to the center line of Thirteenth Avenue; thence North along the center line of Thirteenth Avenue to a point 150 feet North of the North line of West Koch street; thence East parallel with the North line of West Koch Street and 150 feet North of said North line, to the center line of Twelfth Avenue; thence North along the center line of Twelfth Avenue to the North line of West Curtiss Street; thence East along the North line of West Curtiss Street to the center line of the alley be- tween Eleventh and Twelfth Avenues; thence North along the center line of said alley to the North line of West Side Addition, the same being also the City Liwits; thence East along said Ci ty Limi ts to the West line of Eleventh Avenue; thence South along the West line of Eleventh Avenue to the North line of West Curtiss Street; thence East along the North line of West Curtiss Street to the place of beginning. I Tha t, said Commission Resolution No. 572 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Friday, the 17th day of May, 1946, at 7:30 o'clock P.M., of said day, at the regular session of the said Commission of the City of Bozeman, a t the Commj ssion Room in the Ci ty Hall Building of said Ci ty, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections tha t ma'Y be made to the final passage and adoption of said Resolution No. 572, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Cowmlssion Resolution No. 557, declaring it to be the intention of the Commission to create Special Improvement District No. 338, and Commission Resolution No. 558, creating Special Improvement District No. 338, for constructing and making the improvements therein.
