'r~~ ~ a".po " ~ #'~ If.,- ~rPQ"" j .,/ COMMISSION RESOLUTION NO. 565. .~~ i.,?, / I d:it?P A RESOLUTION OF THE C OMMI S S ION OF THE CITY OF BOZEMAN RATIFYING AND CONFIRMING ,/ /' THE PURCHASE BY THE MAYOR OF LOTS SEVEN (7) AND EIGHT (8) OF BLOCK THIRTY-ONE /' (31), CAPITOL HILL ADDITION TO BOZEMAN ON SALE THEREOF BY GALLATIN COUNTY FOR ' DELINQ,UENT TAXES AND SPECIAL ASSESSTlifENTS OF THE CITY OF BOZEMAN, AND AUTHORIZ- ING LIKE PURCHASES, AND UNDER LIKE; CONDITIONS, IN THE FUTURE, AND SALE OF PROPERTY SO PURCHASED. PREAMBLE WHEREAS: On the 16th day of October, 1945, the Commissioners of Gallatin County, I Montana, acting pursuant to the authority of law, offered at public sale certain proper- ty acquired by said County upon sale thereof for delinquent taxes; and WHEREAS: Included in said property so offered for sale was Lots 7 and 8 of Block 31 of Capitol Hill Addition to The City of Bozeman, against which there were unpaid special assessments of The City of Bozeman as follows: Special Improvement District No.333, paving, $417.26; Special Improvement District No. 326, sewer, $103.36, and special assessment for woed cont;rol 60 cents, making a total of such special assessments in the sum of $521.22; and WHEREAS: Acting pursuant to the authority conferred by subsection 10 of Section 5030 Revised Codes of Montana 1935, Mayor J. Harry Healy of The City of Bozeman acting for and On behalf of said City as Trustee for the bondholders of the aforesaid Special Improvement District bonds, for the City's own special assessment for weed control and the property OWners of the City upon their liability for assessment and levy for the maintenance of the City's Special Improvement District Revolving Fund, purchased for the Ci ty the said Lots 7 and 8 of Block 31 of Capitol Hill Addition to The Ci t~ of Bozeman for the sum of $500.00, payable from said Revolving Fund; now, there fore, I BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. PURCHASE RATIFIED AND CONFIRMED. That the purchase by the Mayor at said sale of Lots 7 and 8 of Block 31, Capitol Hill Addition to The City of Bozeman, for the City of Bozeman and for the reasons and purposes set forth in the preamble hereto be, and the same is hereby in all things ratified and confirmed, including payment of the purchase price, $500.00, from the Special Improvement District Revolving Fund of the City, said Revolving Fund to be reimbursed from the proceeds of any sale by the City of said prop- erty so purchased by it. Section 2. FUTURE PURCHASES. That hereafter, upon any like sale advertised by the Commissioners of Gallatin County, Montana, the Director of Finance of The City investigate and report to the City Commission any interest of the City for general taxes or special assessments, or either, in any of such property so offered for sale; that such report be made to the Commission through the City Manager, together with the recommendation of the City Manager as to what action, if an y, the City should take with reference to the bidding upon a nf for, and the purchase of, any such property, by the Ma yor for the Ci ty, fo r the protection of the interests of the City, the taxpayers of the City, and the holders of the I Special Improvement District Bonds or Warrants of the City, and any special assessment and assessments against such property made pursuant to the authroity of law, as well as general taxes of the City, if any.
