RESOLUTION 01" INTEN'rrON TO ESTABLISH THE RETIREMENT PLAN E'OR THE MUNICI-
PAL :@~lPLOYEES OF THE CITY OF BOZEMAN, MO NT ANA.
WHEREAS, the Public Employees Retirement Act (Chapter 212 Session Laws of Montana,
1945) provides for the estahlishment of a Retirement Plan for employees of certain
public agencies and

WHEREAS the Board of Administration of the Public Employees Retirement System
, has adopted a Resolution providing for the participation in said System of Cities,
Counties, School Districts and other public agencies under certain conditions, as
follows:
"Any County, G i ty, School District or other public agency may contract
with the Board of Administration of this System whenever it shall be
made to appear that 75% of the qualified members of such pUblic agency
have indicated by signing an "Employees Statement of Employment Record
(PERS-l) Card" and att;ached thereto a statement that they desire to par-
ticipate in the Retirement System as it is established by Chapter 212
of the Session Laws of 1945. The proper legislative body such as the
Boa.rd of Commissioners, City Council, Board of Trustees
or other like
authority shall thereupon adopt a resolution setting into effect such
con trac t. The contract thus effectuated shall be upon the terms and
conditions, rates and other factors as they appear in the state Law.
The employees affected will be required to pay the $1.00 membership
fee and the rates set forth in Regulation No. 2 and No.
5 as adopted
by the Board of Administration. The County, 'City, School District, or
other Public Agency will be required to pay the 3% State portion tax
to the fund. The said contract will also provide that any amendment
to the law by the State Legislature shall likewise amend the contra.ct
existing with a Public Agency to the same extent." And
vVHEHEAS, the employees of the City of Bozeman, Montana have expressed a desire
to participate in said Retirement Plan;

NOW THER1FO RE, BE IT HEREBY RESOLVED: That the City Commission of The City of
Bozeman, Montana hereby declares its intention to set up a Retirement Plan for its
employees upon the identical terms, conditions, rights, privileges,
and Plan provid-
ed by the Public Employees Retirement Act, as set forth in Chapter 212 Session Laws
of Montana, 1945, and the Questions and Answer Pamphlet and Regula tions adopted to
July 31, 1945, by the Board of Administration (PERS-#3) a copy of which is hereto
attached and which is hereby made a part of this Resolution as though set forth here-
in in full and verbatim; said participation to become effective as of October 1st,
1946.
BE IT FCnrrIIER BESOLVED: That an election shnll be held on the 20th day of August,
1946, between the hours of 9:00 A.M. end 5:00 P.M. of
said day in the office of the
Clerk of this body, at which election all qualified employees shall be requested and
allowed to vote upon the above entitled matter on the following prescribed ballot:

ployees Retirement System established by the Law with respect to its employees I

qualifications as appear in said statute (Chapter 212 Session Laws of Montana,

ed and which is hereby made a part of this Ballot as though set
forth herein in

BE iT F'lJHTHEH REWLVED: That the City Commission of Bozeman, Montana will hold
a meeting thereof on the 28th day of August, 1946, at 1:00 P.M. of said day in the
office thereof, for the purpose of canvassing the result of said election and the ad-
opting of a Resolution in accordance with the tabulated votes of the employees partici-
pating in said election.
I Passed and adopted by the City Commission at its regular meeting on the 7th day
of August, 1946.
