NOTICE IS HEREBY GIVEN
that, pursuant to the provisions
of Sections 5.07 and 5.08,
Bozeman City Charter, and Ar-
ticle 2.06 of the Bozeman Mu-
nicipal Code, the City Commis-
sion of the City of Bozeman,
Montana will conduct a public
hearing to consider amend-
ments to:
1. The Street Impact Fee Cap-
ital Improvement Program, and
at 6:00 pm on Monday, March
17, 2014 in the City Hall Com-
mission Room, 121 . North

There are two actions addressed with this memo. The first is to amend the Transportation impact fee CIP
to add oversizing of 2,255 linear feet to three lane collector road configuration in conjunction with initial
installation of roadway. The second is to amend the Water impact fee CIP to oversize 1,330 feet of water
line from 8" diameter to 12" diameter in conjunction with initial installation of the water line.
The City has adopted water and transportation impact fees to help provide for additional capacity in the
arterial and collector streets and water system to provide service to new development within the
community. A full description of the impact fee program is given in Division 2.06.9, Impact Fees, in the
Bozeman Municipal Code.
The City has established five criteria which must be satisfied before expending impact fees. See
2.06.1690, BMC. These are:
• Capacity expansion
• Not project related
• Timely request
• CIP listed
• CIP funded.
Included in these criteria is that a project must be included on the City's impact fee capital improvement
list and funded on that list. Listing and funding on the CIP indicates that a particular project is a
community priority. The amendment to add this project to the CIP will facilitate an impact fee credit
request by Norton Properties, LLC. The construction project would then be funded by a combination of
public and private funds with each bearing its proportionate share. Final cost share is determined at the
conclusion of the project when all final costs have been determined.
Project 1) Consider amendment to the Fiscal Year (FY) 2015 Transportation Impact Fee Capital
Improvement Program to add the widening of 2,255 linear feet of West Babcock Street and Laurel
Parkway.
This is a new addition to the Transportation impact fee CIP. The project would allow the construction
of the new streets with the center tum lane as depicted in the City's adopted Transportation Plan. The
turn lane adds approximately 33% additional capacity per Table 9-1 of the transportation plan compared
to a two lane road. The Transportation impact fee fund has an adequate fund balance to add this project
without displacing another project.
Development Review Division Policy and Planning Division Building Division
Installing the center turn lane at the time the street is initially constructed is the least cost option to
obtain the additional street capacity. To later widen a street from 2 lanes to 3 lanes after it is constructed
is one of the most costly ways to add capacity. Therefore, it is very cost advantageous to the City to fund
this widening now to occur with the initial street construction. The estimated impact fee cost for this
project is a bit under $81,000. Staff suggests listing the item on the FY 2015 Transportation impact fee
CIP at $85,000to provide some contingency funding if needed.

Project 2) Amend the Water impact fee CIP to oversize 1,330 feet of water line from 8" diameter to 12"
diameter in conjunction with initial installation of the water line.
This project is a new addition to the Water impact fee CIP. The City's water facility plan depicts the
water line underneath Babcock Street as a 12" diameter pipe. The required minimum size for the project
is 8" diameter pipe. Similar to item one if the pipe is oversized at the time of initial installation the costs
are much reduced as trenching, design, and similar costs are shared with the project improvements rather
than being all attributed to the expansion with a later installation. Some costs such as repair of roadways
are avoided all together.
The Water impact fee fund has a present cash balance which could cover this project as actual revenues
are exceeding expected amounts. Expected revenues were $858,500.00, actual revenues this fiscal year
are $1,154,299.74, leaving an uncommitted balance of $295,799.74. The dollar cost for the oversizing is
comparatively small. The estimated impact fee cost for this project is a bit over $22,100. Staff suggests
listing the item on the FY 2015 Water impact fee CIP at $25,000to provide some contingency funding if
needed.
