The Commission of the City of Bozeman met in the Community Room, Gallatin County
Courthouse, 311 West Main Street, on Monday, October 15, 2007 at 6:00 pm. Present were Mayor
Jeff Krauss, Cr. Sean Becker, Cr. Jeff Rupp, Cr. Steve Kirchhoff, Cr. Kaaren Jacobson, City
Manager Chris Kukulski, Planning Director Andy Epple, Assistant City Attorney Tim Cooper, and
City Clerk Stacy Ulmen.

Mayor Krauss called the meeting to order.

Police Lieutenant Rich McLane gave an update on the Police Mill Levy and urged the citizens to
vote.

Ms. Lin, of 501 North 17th Avenue, spoke regarding a sewer leak at her property.

Ms. Stroke spoke regarding the City's annexation policy.

Mr. Knobel, of 401 North Church, spoke regarding the City's Noise Ordinance.

Mr. Farmer asked for support to retain a south bound left turn access to the First Security Bank
located at 670 South 19th Avenue.

0:41:16 Mike Lilly, Representative for Security Title and SPL Enterprises
Mr. Lilly stated that Security Titles supports retaining a south bound left turn access to the First
Security Bank located at 670 South 19th Avenue.
1:08:29 Motion to support the request of First Security bank for a median break and left-in
access from South 19th Avenue.
It was moved by Cr. Kirchhoff, seconded by Cr. Jacobson, to support the request of First
Security bank for a median break and left-in access from South 19th Avenue.
1:09:04 Discussion regarding the motion to support the request of First Security bank for a
median break and left-in access from South 19th Avenue.

Cr. Rupp asked that the motion includes the offer of the applicant that if there is accidents due to
the left hand turn, the applicant has offered to take it out and pay for removing the left hand turn.
1:19:03 Vote on the motion to support the request of First Security bank for a median break
and left-in access from South 19th Avenue.
Those voting Aye being Cr. Jacobson, Becker, Rupp, and Mayor Krauss.
Those voting No being Cr. Kirchhoff.
The motion carried 4-1.

1:29:59 2. Approval of the Memorandum of Agreement for joint development or Sale of
County Land for the County 911 Center and City Fire Station 3.

Mr. Winn asked for the Commission’s approval of the Memorandum of Agreement with the
County for the design and construction of the joint County 911 Center and Fire Station Number 3.

Mr. Winn stated that the County still is deciding whether to build one or two buildings.

It was moved by Cr. Jacobson, seconded by Cr. Becker to approve the Memorandum of
Agreement with Gallatin County for Joint Development or Sale of County Land for the
County 911 Center and City Fire Station 3.

Mr. Krueger gave a PowerPoint presentation regarding the Cowdrey Towers project. Six- seven
story buildings and a parking garage are being proposed. The Commission gave their suggestions
on the issue.

Mr. Krueger went over the staff report regarding Meadow Creek Subdivision. The Commission
gave their suggestions on the issue.

Mr. Hixson stated the importance of water rights.

Mr. Cooper stated that this item would need to be added as an action item to an agenda to direct
changes to the annexation policy

3:10:21 Andy Epple, Planning Director
Mr. Epple stated that the Commission directed staff to indicate what the trigger point of residential
components would be for the Bozeman Gateway primary commercial development. Epple stated
that the components will take place in phase 4.

Cr. Kirchhoff spoke about what the substantial portion would be.

Cr. Kirchhoff stated that language should read that the substantial amount of the residential
component should be located in the core of the development.
3:19:33 3. Future Discussion of the Noise Ordinance: Policy Meeting or Commission

Mr. Kukulski asked if the Noise Ordinance should be added to a future agenda.

Mayor Krauss stated that it should be added to a Policy Meeting agenda.

Cr. Becker stated that he wants to make sure that the discussion surrounds the zoning and the
municipal code portion of the ordinance.

Mayor Krauss stated that Policy Meetings are intended to be discussion between staff and the
Commission. There needs to be language added to the agenda that emphasizes this.

Mr. Epple spoke about the prototype bus shelter located near the Senior Center.

Mr. Epple asked the Commission to look at the shelters and decide if these are the type of shelters
that they would like. Look at the levels of illumination.

Mr. Epple explained that the Citizen Panel is to discuss planning issues.
