Present were Mayor Jeff Krauss, Cr. Sean Becker, Cr. Jeff Rupp, Cr. Steve Kirchhoff, Cr. Kaaren Jacobson, City Manager Chris Kukulski, Planning Director Andy Epple, Assistant City Attorney Tim Cooper, and City Clerk Stacy Ulmen. 0:09:43 A. Call to Order-6:00 pm-Community Room, Gallatin County Courthouse, 311 West Main Street. Mayor Krauss called the meeting to order. 0:09:48 B. Pledge of Allegiance and a Moment of Silence 0:11:07 C. Public Service Announcement-Police Mill Levy (McLane) Police Lieutenant Rich McLane gave an update on the Police Mill Levy and urged the citizens to vote. 0:12:45 D. Consent 1. Authorize Payment of Claims (LaMeres) 2. Approve Monthly Building Report for September 2007 (Doerksen) 3. Finally adopt Ordinance No. 1722, Establishing Beer, Wine, and Liquor Licensing Fees through Resolution (Rosenberry) 4. Provisionally adopt Ordinance No. 1723, Louis Zone Map Amendment #Z-07073 (Riley) 5. Provisionally adopt Ordinance No. 1724, MSU Foundation Zone Map Amendment #Z-07157 (Riley) 6. Provisionally adopt Ordinance No. 1725, Schroeder Zone Map Amendment #Z- 07107 (Knight) 7. Approve Resolution No. 4034, Schroeder Growth Policy Amendment #P-07016 (Knight) 8. Authorize City Manager to sign a Professional Services Contract with Alta Planning and Design to provide Safe Routes to School Consulting Services (Fontenot) 9. Mayor Krauss closed public comment. 0:12:59 Motion and Vote to approve Consent items D 1-15. It was moved by Cr. Becker, seconded by Cr. Kirchhoff to approve Consent items D 1-15. Those voting Aye being Crs. Becker, Kirchhoff, Jacobson, and Mayor Krauss. Those voting No being none. The motion carried 4-0. 0:13:13 E. Public Comment Mayor Krauss opened public comment. 0:14:19 Sophia Lin-Public Comment Ms. Lin, of 501 North 17th Avenue, spoke regarding a sewer leak at her property. 0:17:26 Betty Stroke-Public Comment Ms. Stroke spoke regarding the City's annexation policy. 0:20:39 Tom Knobel-Public Comment Mr. Knobel, of 401 North Church, spoke regarding the City's Noise Ordinance. 0:23:44 Jeff Ball-Public Comment Mr. Ball, of 323 South Wallace, spoke regarding funding for Safe Routes to Schools. 0:26:55 Public Comment closed. First Security Bank Request for South 19th Median Curb Cut (Arkell) 0:35:07 Ron Farmer, President of First Security Bank Mr. Farmer asked for support to retain a south bound left turn access to the First Security Bank located at 670 South 19th Avenue. 0:41:09 Public Comment Mayor Krauss opened public comment. 53 Bozeman City Commission Meeting Minutes, October 15, 2007 3 0:41:16 Mike Lilly, Representative for Security Title and SPL Enterprises Mr. Lilly stated that Security Titles supports retaining a south bound left turn access to the First Security Bank located at 670 South 19th Avenue. 1:08:29 Motion to support the request of First Security bank for a median break and left-in access from South 19th Avenue. It was moved by Cr. Kirchhoff, seconded by Cr. Jacobson, to support the request of First Security bank for a median break and left-in access from South 19th Avenue. 1:09:04 Discussion regarding the motion to support the request of First Security bank for a median break and left-in access from South 19th Avenue. 1:18:35 Cr. Rupp Cr. Rupp asked that the motion includes the offer of the applicant that if there is accidents due to the left hand turn, the applicant has offered to take it out and pay for removing the left hand turn. 1:19:03 Vote on the motion to support the request of First Security bank for a median break and left-in access from South 19th Avenue. Those voting Aye being Cr. Jacobson, Becker, Rupp, and Mayor Krauss. Those voting No being Cr. Kirchhoff. The motion carried 4-1. 1:19:23 Break 1:29:59 2. Approval of the Memorandum of Agreement for joint development or Sale of County Land for the County 911 Center and City Fire Station 3. 1:30:11 Chuck Winn, Fire Chief Mr. Winn asked for the Commission’s approval of the Memorandum of Agreement with the County for the design and construction of the joint County 911 Center and Fire Station Number 3. 1:30:58 Mr. Winn Mr. Winn stated that the County still is deciding whether to build one or two buildings. 1:31:40 Public comment Mayor Krauss opened public comment. No person commented. Jacobson, seconded by Cr. Cowdrey Towers Informal #I-07022 1:33:19 Brian Krueger, Associate Planner Mr. Krueger gave a PowerPoint presentation regarding the Cowdrey Towers project. Six- seven story buildings and a parking garage are being proposed. The Commission gave their suggestions on the issue. 2:07:44 4. Meadow Creek Major Subdivision Phases 3 and 4 Preliminary pre-application #P-07038 (Krueger) 2:10:31 Mr. Krueger Mr. Krueger went over the staff report regarding Meadow Creek Subdivision. The Commission gave their suggestions on the issue. 2:51:49 Public comment Mayor Krauss opened public comment. 2:54:36 G. FYI/Discussion 2:54:38 1. Updating the Amount charged for Cash-in-Lieu of Water Rights (Hixson) 2:55:49 Mr. Hixson Mr. Hixson stated the importance of water rights. 3:09:19 Tim Cooper, Assistant Attorney Mr. Cooper stated that this item would need to be added as an action item to an agenda to direct changes to the annexation policy 3:10:11 2. Bozeman Gateway Major Subdivision Planned Unit Development Residential Component #Z-05217 (Skelton) 55 Bozeman City Commission Meeting Minutes, October 15, 2007 5 3:10:21 Andy Epple, Planning Director Mr. Epple stated that the Commission directed staff to indicate what the trigger point of residential components would be for the Bozeman Gateway primary commercial development. Epple stated that the components will take place in phase 4. 3:13:02 Cr. Kirchhoff Cr. Kirchhoff spoke about what the substantial portion would be. 3:14:31 Cr. Kirchhoff Cr. Kirchhoff stated that language should read that the substantial amount of the residential component should be located in the core of the development. 3:19:33 3. Future Discussion of the Noise Ordinance: Policy Meeting or Commission Meeting Item? (Kukulski) 3:19:33 Mr. Kukulski Mr. Kukulski asked if the Noise Ordinance should be added to a future agenda. 3:19:51 Mayor Krauss Mayor Krauss stated that it should be added to a Policy Meeting agenda. 3:20:11 Cr. Becker Cr. Becker stated that he wants to make sure that the discussion surrounds the zoning and the municipal code portion of the ordinance. 3:24:27 Mayor Krauss Mayor Krauss stated that Policy Meetings are intended to be discussion between staff and the Commission. There needs to be language added to the agenda that emphasizes this. 3:29:48 Bus Shelters 3:29:58 Mr. Epple Mr. Epple spoke about the prototype bus shelter located near the Senior Center. 3:31:47 Mr. Epple Mr. Epple asked the Commission to look at the shelters and decide if these are the type of shelters that they would like.
