WHEREA S, the 'ei ty ~Counci I of The City of Boz em~.n heretofore duly and regularly passed Ordinance No. 502, entitled: AN OHDINANCE PROVIDING F011 THE Hb;l,lGV AL OF 3NO'iV FHOili 'rHE Sl.DEWALKS IN THE CITY OF BOZEMAN AND HEPEALING ORDINANC E NO. 385, ENTITLED: 'AN OHDl NANCE PROVIDING FOR THE RHvlOVAL OF' SNOW AND ICE, DI RT , FIL'l'H AND 0 THEH. OB~TH.UC- TION FROM SIDEWALKS ON MAIN STR1<;ET BETWELN WALLACE AVENUE AND FOUR'rn AVE- NUE IN THE C ITY OF' BOZEMAN''', and WEEHEAS, Section 5030.6 R.C.M., 1935, provides: "The City or Town Council has power to regulAte the use of sidewalks, and to re- quire the owners of the premises adjoining to keep same free from snow xx xxx; and to provide for levying the cost of removal as a speciAl tax against the pro- perty xx xxx", and :;vHEHLA S, owners of vremises in said City have nef,lected to remove the snow from the sidewalks adjoining thereto during the year 1945-1946 and The City of Bozeman, pursuant to Section 5039.6, and Ordinance No. 502 has removed the snow from the side- walks adjoining the premises of said owners and the total cost of the removal there- of is chargeable to the property as hereinafter set forth, pursuant to provisions of said Section 5039.6 Political Code, R. C. M., 1935, and said Ordinance No. 502; NOW, THEREFORE BE IT REOOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF I OF' THE CITY OF' BOZEMAN, STATE OF MONTANA: Section 1. That during the year 1945-1946, The City of Bozeman has removed snow from sidewalks adjoining premises in The City of Bozeman and defrayed the cost thereof as set forth in Schedule "One" hereto a ttached and made a part hereof. Section 2. That to defray the cost ($104.10) of removing said snow from side- walks adjoining said premises as set forth in said Schedule "One", hereto attached and made a part hereof, for the year 1945-1946, there be, and there is hereby levied and assessed a speciAl tax against said property as set forth in said Schedule "One" hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked Schedule "One", and made a part hereof; that the several sums set opposite the name of the owners and the description of the lots and parcels of lands be, and the same are hereby levied and assessed upon and against said lots and oarcels of land; that the several sum s be collected from the respective owners of said lots and parcels of lands described in said assessment 11 st, Schedule "One" as required by law; that said sums shall I be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when same shall become due and payable shall make such per- son and such lots and parcels of land liable to the penalties provided by the lRW relative to delinquent taxes. 4aa Section 3. That the regular session of the Commission of The City of Bozeman to beheld on the 16th dRY 0 f October, 1946, at the Commission Room, City Hall BUilding, be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, Rnd he is hereby directed and I ordered to publish in the Bozeman Daily Chronicle, a daily newspaper printed and pub- lished in said City of Bozeman, a notice signed by the Clerk of the Commission, and statIng that a resolution levying a specIal assessment of ta,xes to defray the co st of removal of snow and ice from sidewalks adjoining certain premises in The City of Boze- man for the yes.r 1945-1946 is on file in the office of the Clerk of the Comrr.ission, subject to inspection for a period of five (5) days; that said notice shall state the time and place at which objections will be heard by the Commission to the adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing of objections and the final adoption of this Resolution. NO'I'ICE IS EEHEDY GIVEN, Tha tat a regular session of the Commission of The Ci ty of Bozeman held on the 9th day of October, 1946, Commission Resolution No. 591 was duly passed and adopted; that said Commission Resolution No. 591 levies and assesses a special assessment of taxes upon certain properties in The City of Bozeman for the year 1946 to defray the cost of removal of snow for the year 1945-1946. That said 'Commission Resolution No. 591 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interest- ed for a period of five (5) days by any person interested; that Wednesd~tY the 16th day of October, 1946, at one o'clock P.M., of said day at a regular session of the Cormnis- sian of The City of Bozeman, C ommi s si on Ho om, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission I Resolution No. 591 and the levying of said assessment; and that said Resolution will be finally passed and adopted at said regular session of said Commission, subject to such corrections and amendments as may be made upon objections made and filed within five days limit as provided by law.
