I WHEHEAS, the City Council of TIle City of Bozeman heretofore duly and regularly passed Ordinance No. 428, en ti tIed: "AN OHDINANCE DEFINING AND PROVIDING FOR THE PUNISI-L\lENT AND ABATE- MENT OF C ffiTAIN NU ISA NCES", and WHERb;A S, Section 5039.82, R.G.M. , 1935, provides the City or Town Council has power to declare and determine what vegetation within the City or Town shall be noxious weeds, and to provide the manner in which they shall be exterminated, and to require the owner or owners of any property within said City or Town, to eyterminate or remove nox- ious weeds from their premises, and the one-half or any road or street lying next to the lands or boulevard abutting thereon, and to provide, in the event the owners or owner of any of said premises neglect to exterminate or remove the noxious weeds therefrom, for levying the cost of such extermination or removal as special assessment against the property; and 'IVIIEREAS, owners of premis es in said C1 ty have neglected to exterminate and remove noxious weeds therefrom during the year 1946, and The City of Bozeman, pursuant to S e c- tion 5039.82 R.C.M., 1935, and Ordinance No. 428, have exterminated and removed noxious I weeds from the premises of said owners and the total cost of the extermination and re- moval thereof is chargeable to the property as hereinafter set forth, pursuant to pro- visions of said Section 5039.82, Political Code, R.C.M., 1935, and sa.ld Ordinanc e No. 428; NOW, THI:;REFCJ RE, BE IT RESOLVED AND IT lS HhREBY ORDEHED BY THE C OMJv; .1551 0 N 0 F THE (; I TY 0 F BO Z EN;AN , STATE OF lViONTANA: Section 1. That during the year 1946, The City of Bozeman has exterminated and re- moved noxious weeds from properties in The City of Bozeman and defrayed the cost thereof as set forth in Schedule "A" hereto a ttached and made a part hereof. Section 2. That to defray the cost ($46.20) of exterminating and removing said noxious weeds from said premis es a s set for th in said Schedule, hereto attached and made a part hereof, for the year 1946, there be, and there is hereby levied and assessed a special tax against said property as set forth in said Schedule, hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked Schedule "A", and made e part hereof; that the several sums I opposite the names of the owners and the description of the lots and parcels of lands be, and the same are hereby levied and assessed upon and against said lots 8.nd parcels of I and; that the several sums be collected from the respective owners of sRid lots or parcels of lands described in said assessment list, Schedul e "A", as required by 1 aw; that said sums shall be paid and the collection thereof shllll be made in the lmmner and in Accordance with the law governing the collection of special improvement taxes; - .". 430 that fHilure to PHY such assessments when same shall become due and payable shall make such person and such lots and parcels of land liHble to the penalties provided by the law relative to delinquent taxes. Section 3. That the reGulAr session of the Commission of The City of Dozeman to be held on the 16th day of October, 1946, at the Commlssion Room, City Ha.ll Build.- lng, be and the same is hereby desigr~ated as the time and place at which objections I to the final adoption of this Resolution will he heard by the Connnission. Sec tion 4. That the Clerk of the Commission be and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper, printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a resolution levying an assessment of taxes to defray the cost of exterm- inating and removing noxious weeds from certain properties in The City of Bozeman for the year 1946 is on file in the office of the Clerk of the Gommis sion, subject to in- spection for a period of five days; that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this He- solution; thRt it shall be published at least five days before the date set b~l the Commission for hearing of objections, and the final adoption of this Resolution. NOTICE IS E.EHEBY GIVEN, That at a regular session of the Commission of The City of Bozeman held on the 9th day of October, 1946, Commission Resolution No. 590 was I duly passed and adopted; that said Commls s1 on ResohJtlon No. 590 levies and 8ssesses a special assessment of taxes upon certain properties in The City of Bozeman for the year 1946 to defray the cost of extermina ting and removing noxious weeds for the year 1946. Resolution No. 590 .. . .-.-- 481 Tha t, said Commission Resolution No. 590 is now on fIle in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interested for a period of five (5) days, by any person interested; that Wednesday the 16th day of October, 1946, at one o'clock P.M., of said day at a regular session I of the Commission of crhe City of Bozeman, City Hall Building, has been designated as the time and place when and where said ~ommission, will hear and pASS upon Any and all objections that may be made to the final passage and adoption of said Commission He- Golution No. 590 and the levying of said assessment; tha t, said Resolution will be finally passed and adopted at sai d regular session of said Commission subject to such corrections and amendments as may be made upon objections made and filed within the five days limit as provided by law.
