A RESOLUTION OF THE COr\';ll,ISSION OF THE CITY OF BOZEMAN, MO NTANA,
CHEAT ING SPECIAL IMPROV1Ii1ENT DI STRLCT NO. 343, PURSUANT
TO THE
PROVISIONS OF Cm.'lMISSION RRffiLUTION NO. 584 DECLARING ITS INTEN-
T ION TO DO&).
WHEREAS, at a regular session of the Commission of The City of Bozeman held on the
I 4th day of September, 1946, the said City Commission duly passed and adopted Commission
Resolution No. 584 declaring it to be the intention of said Commission to create a Spec-
ial Improvement District of said City to be known and designated as Special Improvement
No. 343 for the uses and purposes as in said Resolution of Intention specifically and
particularly stated and set forth and which said Resolution of Intention on file in the
office of the Clerk and said City Commission is hereby referred to for such specifica-
tions and particulars, and to specially assess the property within the boundaries of such
Special Improvement District No. 343 on the area basis for the cost of the improvement
to be made in said Special Improvement Dis trict No. 343, and which Resolution of
Intention
No. 584, so on file as aforesaid, is hereby referred to for further particulars in respect
to the boundaries of said Special Improvement District No. 343, the estimated cost of' said
improvement and the terms, time And conditions of payment of such assessments and all
other particulars with reference to s aid Special Improvement Dis trict No. 343; a

VvIIEREAS, notice of the adoption of said Resolution of Intention No. 584 was duly
published as required by law and by sending a copy of such notice by United States mail,
postage prepaid, to each person, firm or corporation, and any and all others having
real
I property within the boundaries of sald proposed Special lmprovement District No. 343 as
said boundaries are defined in s aid Commission Resolution of Intention No. 584 a t hi s,
her or its last known address, upon the same day that said notice was
first so published,
as Bforesaid; and due proof having been made of such publIcation and service; and
WEEHEAS, within the tIme provided by law and said published and served notice there
were no protests filed or made against the creation of said proposed Special Improvement
District No. 343, or if filed were by the said City Commission found insufficient in law
and in fae t, nor against the cost of the improvement so to be made or the method of assess-
ment to pay such cost, nor against any provision of said Commission Resolution No. 584,
being the Resolution of Intention aforesaid; and the City Commission being in regular
session assembled on the 2nd day of October, 1946, at the hour of one o'clock P.M.
of
said day, in the Commission Room of said City Cormnission in the City Hall buildi:ng in
said The City of Bozeman, that being the time when and the place where the said Commis-
sion would consider and pass upon such protests, if any, as stated in said published
and
served notice, and all of the proceedings for, and preliminary to, the
creation of said
proposed Special Improvement District No. 343 having been done, observed and performed
I in due and regulBr form and as by law required; now, therefore,
BE IT RESOLVED BY THE COMMISSION OF' THE CITY OF BOZEl\1AN:
Section 1. DISTRICT CREATED. That pursuant to said Resolution of Intention No.
584
as referred to in the preamble hereto, there is hereby created a Special Improvement
Dis-
trict of The City of Bozeman, to be known and designated as Special Improvement District

No. 343 of said City, for the purpose of making the improvements in said District as
in said Resolution of Intention No. 584, and hereinafter, specified and described.
Section 2. CHARACTER OF Il.1PHOVEJ/lENT. The character of the improvement to be
made in sald Special Improvement District No. 343 hereby created is: The construc-
tion and installation of a ten inch sanitary sewer on West Koch Street from the pres- I
ent terminus of the sewer at 13th Avenue, West to the alley between 14th and 15th Ave-
nues, and eight inch sewer in the alley between 12th and 13th Avenues from story
Street to the East and West alley of Block 23 of Glendale Rearrangement, and in the
said East and West alley a sufficient distance East and West to serve all of the lots
fronting on West College Street; also eight inch sewer in each of the alleys in Norm-
andy Rearrangement from West Koch Street a sufficient distance to serve all of the
lots in sald Normandy Rearrangement.
Section 3. P AYjt.ENT OF CO 3T. That the cost of making said imnrovement as
final-
ly determined shall be aaid in cash from the s81e of bonds of said Special Improvement
District No. 343 in accordance with the provisions of Section 5250, Revised Codes of
Montana 1935, as amended by the provisions of Chapter 178 of the Laws of the 29th
Legislative Assembly of The State of Montana, 1945. Such bonds shall be issued in
denominations of $100.00 each, Bnd fractions of $100.00 where necessary, shall bear
interest at a rate not exceeding six (6%) per annum, payable annually,
and be paid
from a fund to be known and designated RS "Special Improvement District No. 343 Fund";
all in accordance with Section b249 Revised Codes of Montana 1935 as amended by the I
provisions of Cllapter 177 of the Laws of the 29th Legislative Assembly of The State
of Montana, 1945. That the entire cost and expense of making said improvement shall
be defrayed by a special assessment agains t all of the real property wi thin the bound-
aries of said Special Improvement District No. 343, on the area basis, each square
foot of the total area within the boundaries of said District, exclusive of
streets,
avenue s, alleys and public places, to be so assessed, and each separate lot or parcel
of land therein to be assessed for its proportionate share of the total cost.
Section 4. PLANS AND SPECIFICAT.lONS. That the City Engineer be,
and he is here-
by directed to prepare plans and specifications for the doing of said work and the
making of said improvement.
Section 5. CLEHK TO ADVEHT ISE FOR BIDS. That the Clerk of the City COlTImission
be, and he is hereby directed to publish a notice in the manner and form as by law
provided, inviting proposals for furnishing the necessary material and the installa-
tion of said improvement in s aid Special Improvement Dis trict No. 343, referring
to
the plans and specifications on file, by publishing the same in two (2) issues
of the
Bozeman Daily Chronicle, a newspaper of general circulation published and printed in I
The City of Bozeman, not less than ten (10) days before bids will be opened and con-
sidered by the City Commission, which shall be at a regular meeting of said Commis-
sion to be held on Wednesday, the 30th day of October, 1946, at the hour of one
o'clock P.M. of said day, at the Corrmlssion Room in the City Hall building, Boz emen,
Montana.
