Section 1. It 1s hereby declared to be the intention of the Commission of The
City of Bozeman to vacate that portion of Hayes Street in s aid City from the Eastern
boundary line of Willson Avenue EAstward to the East city limits, yet reserving and
retaining to the City of Bozeman, the right to install water mains and sewers in that
portion of lIayes Street so vaca ted and al so the right to make service connection with
such water mains and sewers and all rights of access thereto for the purpose of making
such installations mId repairing and maintaining the same.
Section 2. That the regular meeting of the City Commission to be held on Wednes-
day the 18th day of December, 1946, at the hour of one o'clock P.M. of said day, at
the Commission room in the City Hall Building, Bozeman, Montana, is the time when and
the place where the City Commission will hear, pass upon and consider objections to
such proposed vacation and retention of rights to the City, as set forth in Section 1
hereof, and the Clerk of the City Commission is directed to give notice thereof for
the time and in the manner provided in Section 5494 of the Revised Codes of Montrna,
1935.

Passed and adopted by the City Commission at its regular meeting held on the
4th day of December, 1946.

NOTICE IS HEREBY GIVEN That the Gommis sion of The Ci ty of Bozeman, Montana,
has adopted a resolution declaring its in ten tion to vacat e tho. t por tion of Hayes
street, in said City, from the Eastern boundary of Willson Avenue to the EAst City
Limits, yet reserving and retaining to the city the right to install water mains
and sewers in that portion of Hayes Street so vacated and also the right to make
service connections with such water mains and sewers and all rights of access to the
portion of Hayes Street so vacated for the purpose of making such installations and I
repairing and maintaining the same, including such service connections. That said
Resolution of Intention is numbered 597, is on file in the office of the Clerk of
the City Cownisslon in the City Hall building, Boz eman, Mont 8.na, and open to public
inspection during the regular office hours of such Clerk.

And notice is further hereby given that at its regular meeting to be held on Wednes-
