WHEREAS, the Comnission of The City of Bozeman, pursuant to the provisions of Ordinance No. 561, entitled: I "AN ORDINANCE COVERING THE CONSTRUCTION ANi; INSTALLATION OF CONCRETE CURBS AN D SIDEWALKS IN THE C 1TY OF BOZEMAN, PHOVIDING PENALTIES FOR THE VIOLA'rION OF THIS ORDINANCE AND REPEALING OHDINANCES NOS. 365, 374, 435, 447, 449 AND 451, AND ALL OTHER OHD1NANCES AND PAH'rS 0 F ORD1NANCES OF THE CITY OF BOZ~~AN IN CONFLICT HI:.REW1TH" , and the provisions of Section 5244, Poli tical ':Gode, R.G.M., 1935, provided for the construction of sidewalks and curbs in The City of Bozeman during the year 1946, witheut the formation of a Special Improvement District. WIIEHEAS, proceedings were had for the construction and installation and/or re- pair of Miscellaneous Sidewalks and Curbs in The City of Bozeman for the year 1946, and WHEREAS, Miscellaneous sidewalk and curbs were constructed and installed and/or repaired bordering on various properties in The City of Bozeman, pursuant to Ordin- ance No. 561, Section 5244, Political Code, R.C.M., 1935, which are hereby referred to and made a part of this Resolution, and WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed and completed and/or repaired in accordance with the terms and conditions of said pro- ceedings, and the City Engineer has duly certified to the Commission a schedule show- I ing the sidewal1{s and curbs which have been constructed and installed, and/or repair- ed, and the properties which are subject to assessment thereunder and the total cost of said construction and instAllation and/or repairing is the sum of Seven Hundred Eighty-nine Dollars and Forty-five Cents, ($789.45), which schedule, marked "Schedule A" is hereto attached and made a part hereof. , NOW, THEREF'O RE, pursuant to the provisions of Ordinance No. 561 as aforesaid, and Section 5244, Politi cal Code, R.C.M., 1935, as aforesaid, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COlIiM1S,SlON o.t<' THE CITY OF BOZE- MAN, MONTANA: Section 1. That to defray the cost of constructing and installing and/or repair- ing Miscellaneous Sidewalks and Curbs as set forth in "Schedule A", hereto attached an d made a part hereof, there is hereby levied and assessed a tax amounting to the sum of Seven Hundred Eighty-nine Dollars and Forty-five Cents, ($789.45). Section 2. That a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such construction and in- stallation and/or repa\r and the amount of each payment to be made and the day when I the same shall become delinquent is set forth in the assessment list hereto attached marked IISchedule A" and made a part hereof; that the several sums set opposite the name of the owners and the description of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of constructing and installing and/or repairing said -- -...-.-..-..-.-- .. _..._....__.~-_._...._-_.._-----_...__._._- .....-------.... - .. 4,1B Sidewalks and Curbs; that the several sums so assessed be collected from the respec- tive owners of said lots and parcels of land described in said assessment list as re- quired by law; that the payment of said sums shall be made in six installments; that the payments of said installments shall be made on or before the 30th day of November I of each year until payment of all installments together with the interest thereof, shall be made; that said sums Shall be paid and the collection thereof shall be made in the manner Rnd in accordance with the law governing the collection of Special Im- provement taxes; that failure to pay such assessments when the same shall become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes; Section 3. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said Ci ty on the 20th day of November, 1946, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Commission. Section 4. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Dally Chronicle, a daily news- paper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assess- ment of taxes to defray the cost and expense of constructing and installing and/or re- I pairing Sidewalks and Curbs in The City of Bozeman for the year 1946 is on file in the office of the Clerk of the Commission subject to the inspection for a period of five (5 ) days; that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be oublished at least five (5) days before, the day set by the Commission for the hearing of objections and the final adoption of this Resolution. Resolution No. 594 ..___.__n --- 444 NOTIQE HEARING, FINAL AIDPTION OOMM1SSION RE3JLUTION NO. 594, LEVYING AS3ESSlilENT T AXBS, 00 NSTHUCTION AN D IN:.:;TALLATION AND/OR REPAIR OF MISCELLANEOUS SIDEWALKS AND CURBS IN THE (CITY OF BOZEMAN, DURING TIlE YEAR 1946. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City I of Bozeman held on Wednesday the 13th day of November, 1946, Commission Resolution No. 594 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of which, sidewalks and curbs have been constructed and/or re- paired pursuant to the provisions of Ordinance No. 561 and Section 5244, Political Code, R.C.M., 1935, to defray the cost end expense of constructing and installing and/or repairing said sidewalks and curbs. 'Ihat said Commission Resolution is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interest- ed; that Wednesday the 20th day of November, 1946, at 1:00 o'clock P.M., of said day, at the regular session of the said Commission of The City of Bozeman at the Commission Chamber in the 'City Hall Building of said Ci ty, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage ffi1d adoption of said Resolution No. 594 and the levying of said assessment, and that said Resolution will be finally passed and adopt- ed at said regular session. I All persons interested are referred to said Ordinance No. 561, and Corrmissioner's proceedings for the construction and/or repair of miscellaneous sidewalks and curbs, in front or on the side of lots and pRrcels of land within The City of Bozeman for the year 1946, without the formation of a Special Improvement District.
