which Commission Resolutions Nos. 563 and 567, pA ssed as aforesaid, are bereby re-
ferred to and made a part of this reEolution for further particule.rs in respect to
the boundaries of said district, the character of the improvements to oe constructed
therein, the estimeted cost of s~1id improvements And the method of assessing the cost
ageinst the property within said district; and
.iVHEREAS, sAld irr.provements AS contemplated in said Commission Resolutions Nos.
563 ond 567 have been constructed and completed in accordanee with the terms and
conditions of Commission Resolutions Nos. 563 and 567, and the totel cost of said
improvements so cons tructed is the sum of Five Thousand Two Hundred rrhirty Dollars
and Thirty-five Cents ($5,230.35).
NOW, 'TEEREFOHE, pursuant to the 'Jrovisions of Sections 5225 to 5277.5 and 5485, ,.

BE- IT RESOLVED A~D IT IS HEREBY ORDEHED BY THE COTil\iiIS::j10N OF THE CITY OF BOZE-
MAN, STATE OF MONTANA
Section 1. ThBt to defray the cost and expense of cODCJtructing and mAking the
improvementE in s aid Special Improvement Distriet No. 339, there be, I'md there is

hereby levied and assessed a tax amounting to the sum of Five Thousl"md Two Hundred
Thirty Dollars end Thirty-five Cents ($5230.35) upon all the property in s8id Spec-
ial Improvement Dis tri c t No. 339; that ~ particular description of' each lot and par-
cel of land with the name of the owner and the sum Assessed ~:first him or it for
such i.rrprovements and the amount of e8.ch Dartlal payment to be made and the dRY when

the SAme shall be delinquent is set forth in detail in the assessment list hereto
attached, marked Schedule "A", and made a part hereof; tha t the several
sums set
opposite the names of the owners and the described lots and parcels of land be, and
the snme 8re hereby respectively levied and assessed upon and against said described
I lots and pFJrcels of land to defray the cost and expense of constructing and making im-
provements within said District; that the several sums so a ssessed be collected from
the respective owners of said lots and parcels of lrmd described in saId a.ssessment

in ten installments r1nd the pAyment of s aid installments shAll extend over a period of

with the interest thereof, she 11 be TT1pde; that said sums shall be paid and the collec-
tion thereof shall be made in the manner and in accordance with the law governing the
colJection of special improvement taxes, that failure to pey such assessments when the
same beco~e due 2nd pAYAble shall make such persons And said lots and parcels of land
lil1ble to the penalties provided by law relative to delinquent taxes.
Section 2. That the re[;1Ile.r session of the Commission of The City of Bozeman to
be held in the Commission Chamber in the CltJT Hall of s aid City on the 6th day of Novem-
ber, 1946, at 1:00 o'clock P.~., be, and the same is hereby designBted 8S the tin:e and
place at which objections to the final adoption of this Resolution will be heard by the
I said Commission.
Section 3. ThRt the Clerk of the Commission of The Glty of Bozeman be, and he is
hereby ordered md directed to publl sh in the BozeT'1Rn Dgily Chronicle, a daily newspaper
printed and published in the said City of Bozeman, a notice signed by the Clerk of the
Cor.rmis;'.ion and statine; that n Resolution levying and assessing a special assessment of
taxes to defray the cost qnd expense of constructing And making the improvements in the
said special im:9rovement District no. 339 is on file in the office of the Clerk of the
GonJ:t11ission subject to inspection for a period of five (5 ) days;
that s9id notice shall
stpte the time and place at which objections will be heard by the Commission to the
final adoption of this Resolution; that it shall be Dublished at least five ( 5)
days
before the day set by the Commission for the hearing of objections and the final adop-
tion of this Resolution.
