COMMISSION RESOLUTION NO. 604
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL
IMPROVEMENT DISTRICT NO. 346, PURSUANT TO THE PROVISIONS OF COMMISSION RESOLUTION
NO. 602 DECLARING ITS INTENTION TO DO SO.
WHEREAS, at a regular session of the Commission of the City of Bozeman held on the 28th
day of May, 1947, the said Commission duly passed and adopted Commission Resolution No. 602
declaring it to be the intention of said Commission to create a Special Improvement I
District of said City to be known and designated as Special Improvement District No.
346 for the uses and ~lrposes as in said Resolution of Intention specifically and
particularly stated and set forth and which Resolution of Intention on file in the
office of the Clerk of the City Commission is hereby referred to for such specifications
and particulars, and to specially assess the property within the boundaries of such
Special Improvement District No. 346 on the area basis for the cost of the improvement
so to be made in said Special Improvement District No. 346, so on file as aforesaid is
hereby referred to for further particulars in respect to the boundaries of said proposed
Special Improvement District No. 346, the estimated cost of said improvement and the
te rms , time and conditions of payment of such assessments, and all other particulars
with reference to said Special Improvement District No. 346 so proposed to be created; and
WHEREAS, notice of the adoption of Resolution of Intention No. 602 was duly published
as required by law, and by sending a copy of such notice by United States mail, postage
prepaid, to each person, firm or corporation and any and all others having real property
wft~in the boundaries of said proposed Special Improvement District No. 346 as said
boundaries are defined in said Resolution of Intention No. 602 at his, her or its last I
known address, upon the same day that siad notice was first so published, as aforesaid;
and due proof having been made of such publication and service by mail; and
WHEREAS, within the time provided by law and said published and served notice
there were no protests filed or made against the creation of said proposed Special
Improvement District No. 346, nor against the cost of the improvement to be made or
the method of assessment to pay such cost, nor against any provision of said Commission
Resolution No. 602, being the Resolution of Intention aforesaid; and the City Commission
being in regular session assembled at the time and place specified for hearing and
passing upon all such protests, as specified in said publishe,d and mailed notice,
to-wit, at the Commission Room of the City Commission in the Sity Hall Building, in
The City of Bozeman, Montana; and all of the proceedings for, and preliminary to,
the creation of said proposed Special Improvement District No. 346 having been had
and done, observed and performed in due and regular course, and form, and time as
by law required; now, therefore:
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1

District Created
That pursuant to the Resolution No. 602 as referred to in the preamble
hereof, there is herebv created a Special Improvement District of The City of Bozeman
to be known and designated as Special Improvement District No. 346 of said City, for
the purpose of making the improvements in said District as in said Resolution of
Resolution No. 604

Section 2
Character of Improvement
The character and extent of the improvement to be made in said Special Improve-
ment District No. 346 is described as follows:
I Tne installation and construction of a sanitary sewer in West Lamme Street,
in said City, from the center of Ninth Avenue, North, westward to the center
of the alley between Tenth and Eleventh Avenues, North, thence south
along the alley to the center of Mendenhall street.
Section 3
Payment of Cost
The cost of making such improvement, as such cost is finally and definitely
determined, shall be paid in cash from the sale of bonds of said Special Improve-
ment District No. 346 in accordance with the provisions of Section 5250, Revised
Codes of Montana 1935, as amended by Chapter 178 of the Laws of the 29th Legisla-
tive Assembly of the State of Montana, 1945. Such bonds shall be issued in denom-
inations of $100.00 each, and fractions of $100.00 where necessary, shall bear
interest at a rate not exceeding six (6 ) per cent per annum, payable annually,
and be paid, principal and interest from a fund to be known and designated as
"Special Improvement District No. 346 Fund", all in accordance with Section
5249 Revised Codes of Montana 1935 as amended by the provisions of Chapter 177
of the Laws of the 29th Legislative Assembly of the State of Montana, 1945.
That the entire cost and expense of making said improvement shall be defrayed by
I a special assessment against all of the real property within the boundaries of said
Special Improvement ~istrict No. 346, on the area basis, each square foot of the
total area within such boundaries, exclusive of streets, avenues, alleys, and public
places, to be so assessed, and each separate lot, piece and parcel of labd therein
to be assessed for its proportionate share of such total cost.
Section 4
Plans and Specifications
That the City Engineer be, and he is hereby directed to prepare plana and
specifications for the doing of said work and making said improvement.
Section 5
Clerk to Advertise for Bids
Tha t the Clerk of' the Ci ty Commission be, and he is hereby direc ted to
publish a notice in manner and form, and for the time, as by law required and prov-
ided, inviting proposals for furnishing the necessary material and the installation
of said improvement in said Special Improvement District No. 346, referring to the
plans and specifications on file and obtainable at the office of the City Engineer,
and stating when and where such bids will be opened and considered by the City
I Commission, which shall be at a regular meeting of said Commission to be held on
Wednesday, the 16th day of July, 1947, at the hour of 1:00 o'clock P.M. of said
day, at the Commission Room in the City Hall Building, Bozeman, Mon tana .
Passed and adopted by the Commission of the City of Bozeman in regular session
assembled, this 25th day of June, 1947. /r~'
