COMMISSION RESOLUTION NO. 603 A REIDLUTION OF THE COMraSSION OF THE CITY OF BOZEMAN, MONTANA, CREArrlNG SPECIAL IMPHOVEMENT DISTHICT NO. 345, PURSUANT TO THE PROVISIONS OF COMMISSION RESOLUTION NO. 600 DECLARING ITS IN- TENTION TO W SO. WHEREAS, at a regular session of the Commis sion of The City of Bozeman held on I the 14th day of May, 1947, the said Commission duly passed and adopted Commission Resolution No. 600 declaring it to be the intention of said Commission to create a special improvement district of said City to be known and designated as Special Im- provement District No. 345 for the uses and purposes as in said Resolution of Inten- tion specifically and particularly stated and set forth and which Resolution of Inten- tion on file in the office of the Clerk of said City Commission is hereby referred to for such speci fica tions and p€trticulars, and to specially assess the property within the boundaries of such SpeciAl Improvement District No. 345 on the area basis for the cost of the improvement so to be made in said Special Improvement District No. 345, so on file as aforesaid is hereby referred to for further particulars in respect to the boundaries of said proposed Special Improvement District No. 345, the estimated cost of said improvement and the terms, time and conditions of payment of such assessments, and all other particulars with reference to said Speci a1 Improvement District No. 345 so proposed to be created; and WHEREAS, not ice 0 f the adoption of Resolution of Intention No. 600 was duly pub- lished as required by law, and by sending a copy of such notice by United States mail, I postage prepaid, GO each person, firm or corporation, and any and all others having real property within the boundaries of said proposed Special Improvement District No. 345 as said boundaries are defined in said Resolution of Intention No. 600 at his, her or its last known address, upon the same day that said notice was first so published, as aforesaid; and due proof having been made of such publication and service by mail; and WHEREAS, wi thin the time provided by law and said published and served notice there were no protests filed or made against the creation of sald proposed Special Improvement District No. 345, nor against the cost of the improvement to be made or the method of assessment to pay such cost, nor against any provision of said Commis- sion Resolution No. 600, being the Resolution of Intention aforesaid; and the Ci ty Commission being in regular session assembled at the time and place specified for hearing and passing upon all such protests, as specified in said published notice and in said mailed notice, to-wi t, at the Commission Room of the City Commission in the City Hall Building, in The Ci ty of Bozeman, Montana; and all of the proceedings for, and preliminary to, the creation of said proposed Special Improvement District I No. 345 having been done, observed and performed in due and regular form and time as by law required, now, therefore: BE IT RESOLVED BY THE COMM.1.SSION OF THE CITY OF BOZEMAN: Section 1. DISTRI~T CREATED. That pursuant to the Resolution of Intention No. 600 as referred to in the preamble hereof, there is hereby created a Special Improve- - ment District of The City of Bozeman, to be known and designated as Special Improvement 4 ~"f 0 -, District No. 345 of said City, for the purpose of making the improvements in said District as in said Resolution of Intention No. 600 and hereinafter specified and described. Section 2. CHARACTER OF IMP HOVEMENT. The character and extent of the improve- ment to be made in the Special Improvement District No. 345 is described as follows: The installation or a six-inch water main from the present water I main terminus in Tracy Avenue, North, at Aspen Street, to a point 19 feet South of the North line of Tamarack Street; also a four- inch water main extension along Tamarack street from the end of said six-inch main to connect wi th the present six-inch main in Black Avenue, Nor th. Section 3. PAYMENT OF COST. The cost of making said improvement, as such co at is finally and definitely determined, shall be paid in cash from the sale or bonds or said Special Improvement District No. 345, in accordance with the provisions of Sec- tion 5250, Revised Codes of Montana 1935, as amended by Chapter 178 of the Laws of the 29th Legislative Assembly of The State of Montana, 1945. Such bonds shall be issued. in denominations of ,$100.00 each, and fractions of $100.00 where necessary, shall bear interest at a rate not exceeding six (6%) per cent per annum, payable annually, and be paid, principal and interest, from a fund to be known and designat- ed as "Special Improvement District No. 345 Fund"; all in accordance with ~ection 5249 Revised Codes of Montana 1935 as amended by the provisions of Chapter 177 of the Laws of the 29th Legislative Assembly of The State of Montana, 1945. That the entire cost and expense of making said improvement Shall be defrayed by a special assessment against all of the real property within the boundaries of said Special Improvement I District No. 345, on the area basis, each square foot 0 f the tot al area wi thin such boundaries, exclusive of streets, avenues, alleys and public places, to be so assess- ed, and each separate lot, piece and parcel 0 f land therein to be ass.essed for its proportionate share of such total cost. Section 4. PLANS AN D SPECIFICATIONS. That the City Engineer be, and he is here- by, directed to prepare plans and specifications for the doing of said work and making said improvement. Sec tion 5. CLERK TO ADVERTiSE FOR BIDS. That the Clerk of the City Commission be, and he is hereby directed to publish a notice in the manner and form, and for the time, as by law required and provided, inviting proposals for furnishing the necess- ary material and the installation of said improvement in said Special Improvement District No. 345, referring to the plans and specifications on file and obtainable at the office of the City Engineer, and stating when and where such bids will be opened and considered by the City Commission, which sh~ll be at a regular meeting of said Commission to be held on Wednesday the 16th day of JUly, 1947, at the hour of one o'clock P.M. of said day, at the Commission Room in the City Hall BUilding, Bozeman, I Montana.
