Construction Contract Change Order No. 4
Valley Center Road / North 19th Avenue SID Project
MEETING DATE: November 5, 2007
RECOMMENDATION: Authorize the City Manager to sign the Valley Center Road / North 19th
Avenue SID Project Construction Contract Change Order No. 4.
BACKGROUND: On April 18, 2005, the City Commission authorized award of the bid for the
Valley Center Road / North 19th Avenue project to JTL Group, Inc. The City
Commission approved Change Order No. 1 on July 5, 2005, Change Order No. 2
on January 17, 2006, and Change Order No. 3 on February 21, 2006.
Three (3) original signature copies of the partially executed Change Order No. 4
to the Construction Contract for the above referenced project have been provided
to the City Clerk, Stacy Ulmen.
This change order reconciles the final as-built quantities with the estimated
quantities used for bidding purposes. The reconciliation of the final as-built
quantities is noted in the Summary of Change Order No. 4. At the beginning of
the contract, the quantities for all of the unit price items are estimated for the
purposes of bidding. During the course of the work, the actual amount of work
completed for each item is paid. At the end of the project, a change order of this
kind is executed to contractually establish the final quantities. The final as-built
quantities decrease the contract amount by $170,625.87.
The change order decreases the contract amount from $4,058,038.31 by
$170,625.87 to a total of $3,887,412.45.

FISCAL EFFECTS: The project will be funded through SIDs, developer contributions, and Street
Impact Fees.
ALTERNATIVES: As may be suggested by the City Commission.

RESOLUTION NO. 4080
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH JTL
GROUP, INC., BELGRADE, MONTANA.
WHEREAS, the City Commission did, on the 18th day of April 2005, authorize award of the bid for
the Valley Center Road/North 19th Avenue improvement project to JTL Group, Inc., Belgrade, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and JTL Group, Inc., as contained in Change Order No. 4, attached hereto, be and
the same are hereby approved; and the City Manager is hereby authorized and directed to execute the
contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest
such signature.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular
session thereof held on the 5th day of November 2007.
