WHEREAS, The City Commission of the City of Bozeman, did on the 12th day of October, I 1945, duly and regularly pass Commission Resolution No. 564, entitled: A RESOLUTION OF THE COMlVilSSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMJ..SSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT 0 F SAID C1 TY TO BE Kl~OWN AND DES.LGtATED AS SPECIAL IMPROVHJlENT DISTRICT NO. 340, FOR THE INSTALLATION OF A SANI1rARY SEWER ON FIFTH AVENUE, NORTH, IN SAI D <<::1 TY AJ.""i D DI STRICT, FROM THE PRESENT SEWER ON PEACE S'l'REbT, SOUTH A SUFFICIENT DISTANCE TO SERVE ALL PROPERTY FRONT .LNG OR ABUTTIHG ON SAID FIFTH A VENUE, NORTH, .roUTH OF PEACH STREET AND NORTH OF' A LINE PARALLEL WITH AND FIFTY FEET WUTH OF THEroUTH LINE OF WEST BEALL STREET. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did. on the 9th day of November, 1945, duly pass Commission Resolution No. 568 en ti tIed: A HESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MOl.TANA, CREATING A SPECIAL IMPROVEMENT DlSTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVE- MENT DISTRICT NUMBER 340"OF SAID CITY, FOR THE PURPOSE OF IhSTALLING A SANI- TARY SEWER IN FIFTH AVENUE, NO RTH, IN SAl D CITY, PURSUANT TO THE PROVISIONS OF COMIvIlS;:;;ION REIDLUTION NO. 564 WHICH DECLARES THE INTENTION OF THE CITY COMli~ISSlON TO CREATE S AID SPECIAL IMPRO V:EMENT DISTRICT NUMBER 340, AND 10 SPECIALLY ASSESS THE ENTIRE OOST AND E).pEN SE OF INSTALLING SUCH SEWER AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF' SAID SPECIAL IMP ROVEMENT DISTRICT NO. 340 AS SUCH BOUNDARIES ARE DEFINED IN SAID CITY COM1VllSSION RESOLUTION NO. 564. which Commission Resolutions Nos. 564 and 568, passed as aforesaid, are hereby referr- ed to and made a part of this resolution for further particulars in respect to the I boundaries of said district, the character of the improvements to be constructed there- in, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEHEAS, said improvements as contemplated in said Commission Resolutions Nos. 564 and 568 have been constructed and completed in accordance with the terms and condi- tions of Commission Resolutions Nos. 564 and 568, and the total cost of said improve. ments so constructed is the sum of Four Thousand Two Hundred Eighty One Dollars and Forty Cents ($4,281.40). NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C.M., 1935 and amendments thereto, BE IT RESOLVED AND IT IS hEREBY ORDERED BY THE COlMf.ISSION OF THE CITY OF' BOZBAAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the im. provements in said Special Improvement District No. 340, there be, and there is hereby levied and assessed a tax amounting to the sum of Four Thousand Two Hundred Eighty One Dollars and Forty Cents ($4,281.40) upon all the property in said Special Improvement I District No. 340; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked "Schedule An and made a. part hereof; that the several sums set opposite the names of , 4 .~~~ .bt the owners and the described lots and parcels of land be, a.nd the same are hereby re- spectively levied and assessed upon and against said described lots and parcels of land- to defray the cost and expense of construction and making improvements within said District; that the several sums so assessed be collected from the respective owners of I said lots and parcels of land described in said assessment list, Schedule "A", as re- quired by law; that the payment of said sums shall be made in ten installments and the payment of said installments shall extend over a period of Ten Yea.rs; that the payment of the respective annual installments shall be made on or before the 30th day of Novemb- er of each year until payment of all installments together with the interest thereof, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improve- men t taxes; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to ~le penalties pro- vided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 18th day of June, 1947, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the said Commission. Section 3. That the Clerk of the Commission of the City of Bozeman be, and he is I hereby ordered and directed to publish in The Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the improvements in said special improvement District No. 340 is on file in the office of the Clerk of theCommis- sion subject to inspection for a period of five (5) days; that said notice shall state the time and place at which objections will be heard by the Commission to the final ad- option of this Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolution. Resolution No. 601 -" 464 NOTICE ------ HEAR lNG, FINAL AIX)PTlON OF' RESJLUTION NO. 601, LEVYING ASSESGMENT SPECIAL IMPROVD~ENT DISTRICT NO. 340, CITY OF BOZmlAN, SANITARY SEWER ON FIFTH AVElmE NOHTH FROM. PEACH STREET TO A POINT FIFTY FEET SOUTH OF THE SOUTH LINE OF' BEALL STREET. NOTICE IS HEREBY G1VEN that at a regular session of the Commission of the City , of Bozeman, held on the 11th day of June, 1947, Commission Resolution No. 601 was duly I passed and adopted; that said Commission Resolution levies and assesses a special assessment of ta.xes upon all the property in Special Improvement District No. 340 in said City, to defray the cost and expense of constructing end making the improvements within said District, to-wit: Beginning at a point in the center line of West Peach Street (also called Durston Road) where the same is intersected by the center line of the first alley East of said Fifth Avenue, North, (now being platted in a new addi- tion by John Karp); thence South along the center line of said alley, and said line extended to a point fifty (50) feet South of the South line of West Beall Street; thence West parallel with and fifty (50) feet South, South of the South line of West Beall Street to an extension of the center line of the alley between Fifth and Sixth Avenues as platted in Violett Addition to The City of Bozeman; thence North along the center line of said alley so extended, to the center line of West Peach street (or Durston Road) ; thence East along s aid center line of '{lest Peach Street to the place of beginning. Tha t, said Commission Resolution No. 601 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Wednesday, the 18th day of June, 1947, at one o'clock P.M., of said day, at the regular session of the said Commission of the City of Bozeman, B.t the Commission Room in the City Hall Building of said City, has been designated as the I time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 601, and the levying of said assessment, and that said Resolution will be finally passed and adopted a t said regular session. All persons interested are referred to Commission Resolut ion No. 564 declaring it to be the intention of the Commission to create Special Improvement District No. 340, and Commission Resolution No. 568 creating Special Improvement District No. 340, for constructing and making the improvements therein.
