A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND
ASSESSING A SPECIAL ASSESS1ffiNT OF TAXES UPON ALL ~iE PROPERTY IN SPECIAL
IMPROVEMENT DISTRICT NO. 342 IN THE CITY OF BOZEYAN, COUNTY OF GALLATIN,
STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUC'T'ION AND MAKING THE IMPROVE-
MENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 342.
I WHEREAS, The City Commission of the City of Bozeman, did on the 21st day of
June, 1946, duly and regularly pass Commission Resolution No. 575, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT
TO BE Tfffi INTENTION OF SAID CO~~rISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT
OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO.
342, FOR THE PURPOSE OF INSTALLING AN EXTENSION OF THE SANITARY SEWER MAIN IN
THE ALLEY BETWEEN ELFVENTH AND TWELFTH AVENUES FROM THE PRESENT TERMINUS OF
SAID SEWER AT EAST STORY STREET, SOUTH TO THE EAST AND WEST ALLEY IN BLOCK
24 OF GLENDALE REARRANGEMENT OF A PORTION OF VillST SIDE ADDITION TO BOZEMAN
AND THENCE WEST IN SAID ALLEY A SUFFICIENT DISTANCE TO SERVE THE LOTS FRONTING
ON WEST COLLEGE STREET, APPROXINATELY NINETY (90) FEET: AND TO SPECIALLY
ASSESS THE PROPERTY IN SAID SPECIAL IMPROVEMENT DISTRICT ON THE AREA BASIS.
ALL UNDER A~ID BY VIRTUE OF THE PROVISIONS OF SECTIONS 5225 TO 5277, BOTH
SECTIONS INCLUDED, Rr.~VISED CODES OF MONTANA 1935 AND ANY AMENDMENTS THEREOF
AND THERETO.
and thereafter, after due and legal proceedings had, the Cormnission of the City of
Bozeman did on the 26th day of July, 1946, duly pass Commission Resolution No. 581
entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A
SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN A~~ DESIGNATED AS ItSPECIAL IMPROVE-
WENT DISTRICT NO. 342" OF SAID CITY, PURSUANT TO C01~ISSION RESOLUTION NO. 575
OF SAID CITY DECLARING THE INTENTION OF SAID COMMISSION TO C&~ATE SAID SPECIAL
IMPROVEMENT DISTRICT NO. 342 FOR THE USES AND PURPOSES SET FORTH AND DETAILED
IN SAID COMMISSION RESOLUTION NO. 575 ON FILE IN THE OFFICE OF THE CLERK OF
SAID CITY COMMISSION AND OPEN TO PUBLTC INSPECTION.
I which Commission Resolutions Nos. 575 and 581, passed as aforesaid, are hereby
referred to and made a part of this resolution for further particulars in respect
to the boundaries of said district, the character of the improvements to be construct-
ed therein, the estimated cost of said improvements and the method of assessing the
cost against the property within said district; and
WHEREAS, said improvements'as contemplated in said Commission Resolutions Nos.
575 and 581 have been constructed and completed in accordance with the terms and
conditions of Commission Resolutions Nos. 575 and 581, and the total cost of said
improvemen ts so constructed is the sum of Four Thousand Seven Hundred Dollars
($4,700.00).
NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485
R.C.M., 1935 and amendments thereto,
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF
BOZEMAN, STATE OF MONTANA:
Section 1. That to defray the cost and expense of constructing and making
the improvements in said Special Improvement District No. 342, there be, and there is
hereby levied and assessed a tax amounting to the sum or Four Thousand Seven Hundred
I Dollars ($4,700.00) upon all the prope'rty in saAd Special Improvement District No.
342; that a particular description of each lot and parcel of land with the name of
the owner and the sum assessed against him or it for such improvements and the amount
of each partial payment to be made and the day when the same shall be delinquent is
set forth in detail in the assessment list hereto attached, marked "Schedule "A" It,

and made a part hereof; that the several sums set opposite the names of the owners of
the described lots and parcels of land be, and the same are hereby respectively levied
and assesses upon and against said described lots and parcels of land tp defray the cost
and expense of construction and making improvements within said District; that the
several sums so assessed be collected from the respective owners of said lots and parcels
of land described in said assessment list, Schedule" AI!, as required by law; tha t the I
payment of said sums shall be made in ten installments and the payment of said install-
ments shall extend over a period of Ten Years; that the payment of the respective
annual installments shall be made on or before the 30th day of November of each year
until payment of all installments together with the interest thereof, shall be made; that
said sums shall be paid and the collection thereof shall be made in the manner and in
accordance with the law governing the collection of special improvement taxes; that
failure to pay such assessments when the same become due and payable shall make such
persons and said lots and parcels of land liable to the penalties provided by law
relative to delinquent taxes.
Section 2. That the regular session of the Commission of the City of Bozeman to
be held in the Commission Chamber in the City Hall of said City on the 17th day of
September, 1947, at I:OO:otclock P.M., be, and the same is hereby designated as the
time and place at which objections to the final adoption ~f this Resolution will be
heard by the said Commission.
Section 3. That the Clerk of the Commission of the City of Bozeman be, and he is
hereby ordered and directed to publish in The Bozeman Daily Chronicle, a daily newspaper I
printed and published in the said City of Bozeman, a notice signed by the Clerk of the
Commission and stating that a Resolution levying and assessing a special assessment of
taxes to defray the cost and expense of constructing and making the improvements in the
said special improvement District No. 342 is on file in the office of the Clerk of the
Commission subject to inspection for a period of five (5) days; that said notice shall
state the time and place at which objections will be heard by the Commission to the
final adoption of this Resolution; that it shall be published. at least five (5) days
before the day set by the Commission for the hearing of objections and the final adoption
of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a
regular session thereof held on the lath day of September, 1947.

HEARING, FINAL ADOPTION OF RESOLUTION NO. 611, LEVYING ASSESSMENT SPECIAL
IMPROVEMENT DISTRICT NO. 342, CITY OF BOZEMAN, SANITARY SEWER IN ALLEY
BETWEEN ELEVENTH AND TWELFTH AVENUES FROM STORY STREET SOUTH A SUFFICIENT
DISTANCE TO SERVE ALL PROPERTY IN DISTRICT BETWEEN STORY AND COLLEGE STREETS.
I NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the
City of Bozeman, held on the 10th day of September, 1947, Commission Resolution
No. 611 was duly passed and adopted; that said Commission Resolution levies and
assesses a special assessment of taxes upon all the property in Special Improvement
District No. 342 in said City, to defray the cost and expense of constructing and
making the improvements within said District, to-wit;
BeQ:inning at a point in the center line of Eleventh Avenue South, where said
line is intersected by the center line of West story Street, thence south along
the center line of Eleventh Avenue South, to the center line of West College
Street, ; tbence west along the center line of West College Street to the center
line of Twelfth Avenue South; thence no~th along the center line of Twelfth
Avenue South, to the center line of West Story Street; thence east along the
center line of West Story Street to the point of the beginning of this
description.
That, said Commission Resolution No. 611 is now on file in the office of the
Clerk of the Commission, subject to inspection for a period of five (5) days by
any persons interested. The t Wednesday, the 17th day of September, 1947, at 1:00
o'clock P.M. of said day, at the regular session of the said Commission of the City
of Bozeman, at the Commission Room in the City Hall Building of said City, has
I been designated as the time and place when and where the said Commission will hear
and pass upon any and all objections that may be made to the final passage and
and adoption of said Resolution No. 611, and the levying of said assessment, and
that said Resolution will be finally passed and adopted at said regular session.
All persons interested are referred to Commission Resolution No. 575 declar-
ing it to be the intention of the Commission to create Special Improvement District
No. 342, and Commission Resolution No. 581 creating Special Improvement District
No. 342, for constructing and making the improvements therein.
