COMMISSION RESOLUTION NO. 607
A RESOLtTTION OF THE COWHSSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES UPON ALL TIill PROPERTY IN SPECIAL IMPROVEMENT DISTRICTS
OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, FOR THE MAINTENANCE
OF PARKINGS TO DEFRAY THE COST OF MAINTAINING THE PARKING WITHIN SAID SPECIAL
IMPROVEMENT DISTRICTS OF THE CITY OF BOZEMAN FOR TIill YEAR 1947.
W}illREAS, the City Council and the Commission of the City of Bozeman have hereto-
fore duly and regularly passed Council and Commission Resolutions creating special I
improvement districts within the City of Bozeman, defining the boundaries thereof and
providing for the maintenance of parking therein, and for the assessment of the cost
of maintaining the parkings as set forth in Resolutions hereinafter referred to; and
WHEREAS, the parkings within the boundaries of said Special Improvement Districts
have been cared for and maintained during the year 1947, as contemplated in said Res-
olu tions, in accordance with terms and conditions thereof; and
WHEREAS, said Special Improvement Districts for the maintenance of parkings and
the Resolutions creating the same, the total frontage or the area, of the property
within said districts to be assessed, the total cost of said maintenance within said
districts and the amount chargeable to the property therein is hereinafter set forth.
NOW, THEREFORE, pursuant to the Provisions of Section 5242, Political Code, R.C.M.,
1935, and said Council and Commission Resolutions, creating said Special Improvement
Districts, and providing for the maintenance thereof;
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMl'lISSION OF THE CITY OF BOZEMAN,
STATE OF MONTANA:
See tion 1. That for the year 1947, the City of Bozeman has defrayed the cost I
($6078.75) of maintenance of parkings in the several Special Improvement Districts,
pursuant to Resolutions creating the same, and that the entire cost thereof, the
total number of linear feet, or area, of property to be assessed, and the rate per
linear or square foot, is as follows, to-wit:
Maintenance of Parking District No.6, created by Council Resolution No. 306,
on South Willson Avenue from Babcock Street to College Street, a total frontage
of 4355.37 linear feet, at the sum of $873.81, at an approximate rate per front
foot of $0.200628.
Maintenance of Parking District No. 16, created by Council Resolution No. 356,
Babcock Street from Black Avenue to Tracy Avenue, a total area of 93773 square
feet, the sum of $59.57, at an approximate rate per square foot of $0.0006353.
Maintenance of Parking District No. 17, created by Council Resolution No. 355,
Grand Avenue from Babcock Street to College Street, a total area of 58148 square
feet, the sum of $551.45, at an approximate rate per square foot of $0.00094835.
Maintenance of Parking District No. 18, created by Council Resolution No. 357,
Tracy Avenue from Babcock Street to Dickerson Street, a total area of 457782.2
square feet, the sum of $306.65, at an approximate rate per square foot of
$0.00067.
Maintenance of Parking District No. 31, created by Council Resolution No. 385,
Black Avenue from Babcock Street to College Street, a total area of 267893
square feet, the sum of $596.61, a t an approxima te rs te per square foot of .

Maintenance of Parking District No. 45, created by Council Resolution No. 432, I
Eighth Avenue from Koch Street to Dickerson Street, a total area of 66000 square
feet, the sum of $114.15, at an approximate rate per square foot of $0.00173.
Maintenance of Parking District No. 48, created by Council Resolution No. 435,
Eighth Avenue from Main Street to Koch Street, a total area of 116104 square feet,
the sum of $306.92, at an approximate rate per square foot of $0.8026435.
Maintenance of Parking District No. 50, created by Council Resolution No. 474,
Third Avenue from Story Street to Cleveland Street, a total area of 378774 square
feet, the sum of $359.23, at an approximate rate per square foot of $0.0009484.

Babcock Street from Fifth Avenue to Eighth Avenue, a total area of 174600
square fee t, the sum of $174.04, at an approximate rate per square foot of
$0.0009968.
Maintenance of Parking District No. 57, created by Council Resolution No. 529,
Cleveland Street from Willson Avenue to Seventh Avenue, a total frontage of
3182 linear feet, the sum of $525.29, at an approximate rate per front foot
of $0.165082.

1260 linear feet, the sum of $253.32, at an approximate rate per front foot

College Street from Grand Avenue to Seventh Avenue, a total area of 515294.7
square feet, the sum of $432.25, at an approximate rate per square foot of
$0.00083
Maintenance of Parking District No. 77, created by Council Resolution No. 576,
Eighth Avenue fDom Dickerson Street to Harrison Street, a total frontage of
1971 linear feet, the sum of $257.85, at an approximate rate per front foot
of $0.130822.
Maintenance of Parking District No. 86, created by Council Resolution No. 620,
south side of Story Street from Sixth Avenue to Eighth Avenue, and both sides
of Sixth Avenue from Story Street to College Street, a total frontage of
2426.2 linear feet, the sum of $324.99, at an approximate rate per front foot
of $0.13395.
Maintenance of Parking District No. 107, created by Council Resolution No. 658,
East Story Street, a total frontage of 70 linear feet, the sum of $12.44, at
an approximate rate per front foot of $0.177714.
Maintenance of Parking District No. 114, created by Council Resolution No. 722,
west side Grand Avenue from College Street to Arthur Street, a total frontage
of 930 linear feet, the sum of $154.99, at an approximate rate per front foot
of $0.16665.
Maintenance of Parking District No. 117, created by Council Resolution No. 719,
I Tracy Avenue from Dickerson Street to College Street, a total frontage of
1408.2 linear feet, the sum of $135.87, at an approximate rate per front foot
of $0.096485.
Maintenance of Parking District No. 151, created by Council Resolution No. 810,
east side Fifth Avenue from Olive Street to Koch Street, a total area of
111189.06 square feet, the sum of $75.07, at an approximate rate per square
foot of $0.006752.
Maintenance of Parking District No. 189, created by Council Resolution No. 1004,
east side of Grand Avenue from College Street to Arthur Street, a total frontage
of 930 linear feet, the sum of $154.99, at an approximate rate per front foot
of $0.16665.
Maintenance of Parking District No. 256, Created by Commission Resolution No.
69, Sixth Avenue, Cleveland to Garfield Street, a total frontage of 1362
linear fee t, the sum of $213.90, at an a proximate rate per front foot of
$0.15705.
Maintenance of Parking District No. 301, created by Commission Resolution No.
331, Sixth and Seventh Avenues between Harrison and Cleveland Streets and on
the .south side of Harrison Street between Sixth and Seventh Avenues, a total
frontage of 1456 linear feet, the sum of $195.36, at an approximate rate per
front foot of $0.134176.
Section 2. That to defray the cost of Maintenance of Parkings within said
Special Improvement Districts for the year 1947, there be and there is hereby levied
and assessed a tax upon all the property in front of and bordering on said Special
I Improvement Districts as set forth in Schedule One to Twenty-One inclusive, hereto
attached and made a part hereof; that a particular description of each lot and
parcel of land with the name of the owner and the sum assessed against him or it,
1s set forth in assessment lists hereto attached, marked "Schedules One (1) to
Twenty-one (21 ) and made a part hereof; that the several sums set opposite the names
of the owners and the described lots and parcels of land be, and the same are hereby
levied and assessed upon and against said lots and parcels of land; that the several
sums be collected from the respective owners of said lots and parcels of land

described in the said assessment lists, Schedules One (I) to Twenty-one (21) inclusive,
as required by law; that said sums shall be paid and the collection thereof shall be
made in the manner and in accordance with the law governing the collection of Special
Improvement Taxes; that failure to pay ffilCh assessments when same shall become due and
payable shall make such persons and such lots and parcels of land liable to the penal ties
provided by law relative to delinquent taxes.

See tion 3. That the regular session of the Commission of the City of Bozeman to
be held on the 30th day of July, 1947, at the Commission Chamber, City Hall Building,
be, and the same is hereby designated as the time and place at which ob.jections to the
final adoption of this Resolution will be heard by the Commission.
Section 4. That the Clerk of the Commission be, and he is hereby ordered and
directed to publish in the Bozeman Daily Chronicle, a daily newspaper, printed and
published in the City of Bozeman, a notice signed by the Clerk of the Commission, and
stating that a resolution levying a special assessment of taxes to de fra y the cost of
maintenance of parkings in the said Special Improvement Districts for the year 1947,
is on file in the office of the Clerk of the Commission, subject to inspection for a
period of five days; that said notice shall state the time and place at which objections
will be heard by the Commission to the final adoption of this Resolution; tha tit
shall be published at least five days before the date set by the Commission for hearing
objections, and the final adoption of this Resolution.

COST OF MAINTENANCE OF PARKINGS IN SPECIAL I~WROVE~ffiNT DISTRICTS FOR THE YEAR 1947.
NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of the City
of Bozeman held on the 23rd day of July, 1947, Commission Resolution No. 607 was duly
passed and adopted; that said Commission Resolution No. 607 levies and assesses a I
special assessment of taxes upon all the property in Special Improvement Dostricts
of said City to defray the cost of Maintenance of Parkings within said Special
Improvement Districts for the year 1947.
That the Special Improvement Districts and the Resolutions creating the same, and
the amount of the assessments are as follows:

That, said Commission Resolution No. 607 is now on file in the office of the
Clerk of the Commission of the said City of Bozeman subject to inspection for a
period of five (5) days, by any person interested; that Wednesday, the 30th day
of .July, 1947, at 1:00 o'clock P.M., of said day at a regular session of the
Commission of the City of Bozeman, Commission Chamber, City Hall Building, has
been designated as the time and place when and where said Commission will hear
and pass upon any and all objections that may be made to the final passage and
adoption of said Commission Resobltion No. 607, and the levying of said assessment;
I and that, said Resolution will be finally passed and adopted at said regular session
of said Commission, subject to such corrections and amendments as may be made upon
objections made and filed within the five days limit as provided by law.
All persons interested are referred to the several Council and Commission
Resolutions creating the aforesaid Special Improvement Districts, defining the
boundaries thereof and providing for the assessment of the cost of said maintenance
of parkings. For further particulars, all of said Resolutions being on file in the
office of the Clerk of the Commission of the City of Bozeman, at the City Hall of
said City, and subject to the inspection of all interested parties.
