HomeMy WebLinkAboutResolution 606 Street Sprinkling District, defray cost -----. 4~17 COMMISSION RESOLUTION NO. 606 A RESOLUTION OF THE C01~ISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESS- ING A SPECIAL ASSESSMENT OF TAXES UPON ALL OF THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1947. I WHEREAS, the City Council and the Commission of the City of Bozeman have heretofore duly and regularly passed Council and Commission Resolutions creating Street Sprinkling Districts within the City of Bozeman and defining the boundaries thereof and providing for the assessment of the cost of sprinkling the same as set forth in Resolutions hereinafter referred to; and WHEREAS, the streets within the boundaries of said Street Sprinkling Districts have been sprinkled during the year 1947 as contemplated in said Resolutions, in accordance with terms and conditions thereof; and WHEREAS, the Street Sprinkling Districts and the Resolutions creating the same, the total frontage of the property within said district to be assessed, the total cost of said sprinkling within said districts and the proportion thereof chargeable to the property therein is hereinafter set forth. NOW, THEREFORE, pursuant to the provisions of Sections 5272 to 5277, inclusive Political Code, R.C.M., 1935 and Ordinance No. 295 and said Council and Commission Resolutions creating said Street Sprinkling Districts; BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: I Section 1. That for the year 1947, the City of Bozeman has waived the sprinkling assessments on the following districts: 130, 131, 132, 133, 134, 135, 136, 13'7, 138, 139, 140, 141, 142, 143, 144, 160, 161, 162, 163, 164, 192, 193, 194, 195, 196, 197, 198, 199, 204, 216, 217, 218, 219, 220, 232, 233, 234, 235, 236, 237, 238, and 256; that for the year 1947, the City of Bozeman has defrayed the cost ($1,403.14) of sprinkling streets in the several Street Sprinkling Districts pursuant to Resolutions creating the same, and that seventy-five per- cent of the entire cost thereof ($1,052.35) exclusive of the cost of sprinkling parks and public places, the total number of linear feet of property to be assessed, and the rate per linear foot, is as follows, to-wit: Sprinkling District No.1, crea ted by Council Resolution" 424" Main Street from Wallace Avenue to Fourth Avenue, a total frontage of 9355.9 feet, the sum of $1,052.35, being 75% of the entire amount, or at an approximate rate per front foot of $0.112479. See tion 2. That to defray seventy-five percent of the cost of sprinkling streets within said street sprinkling districts for the year 1947, there be, and there is hereby levied and assessed a tax upon all the property in front of I and bordering on said street sprinkling districts as set forth in Schedule One, hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it, is set forth in assessment lists hereto attached, marked Schedule One (1) and made a part hereof; That the several sums set opposite the names of the owners, and the described lots and parcels of land, be, and the same are hereby levied and assessed upon and against said lots and parcels of land; the t the several sums be collected from the respective owners of said lots and parcels Resolution No. 606 ----.. ,..- .--------.------- 4+(8 of land described in the said assessment lists, Schedule One as required by law; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when same shall become due and payable shall make such person and such lots and parcels of land liable to the penalties provided by the law relative to delinquent taxes. I Section 3. That the regular session of the Commission of The City of Bozeman to be held on the 30th day of July, 1947, at the Commission Chamber, City Hall Building, be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commission. Section 4, That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper, printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, and stating that a Resolution levying a special assessment of taxes to defray seventy-five percent of the cost of sprinkling streets in the said Street Sprinkling Districts for the year of 1947, is on file in the office of the Clerk of the Commission subject to inspection for a period of five days; tha t said notice shall s ta te the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing of objections, and the final adoption of this Resolution. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 23rd day of July, 1947, Commission Resolution No. 606 was I duly passed and adopted; that said Commission Resolution No. 606 levies and assesses a special assessment of taxes upon all the property in Street Sprinkling Districts of said City to defray 75% of the cost of sprinkling streets within said Street Sprinkling Districts for the year 1947. That said Street Sprinkling Districts, and the Resolutions creating the same, and the amount of the assessments are as follows: Street Sprinkling Resolution No. Amount of District No. Assessment 1 42,* $1,052.35 Tha t , said Commission Resolution No. 606 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interested for a period of five days, by any person interested; that Wednesday, the 30th day of July, 1947, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, Commission Room, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final pass- I age and adoption of said Commission Resolution No. 606, and the levying of said assessment; and that said Resolution will be finally passed and adopted at said regular session of said Commission, subject to s~ch corrections and amendments as may be made upon objections made and filed within five days limit as provided by law.
