MEETING DATE: October 22, 2007 BACKGROUND: With the adoption of Ordinance No. 1722, the City can now establish the fees for Beer, Wine, and Liquor licenses through resolution. In accordance with Bozeman Municipal Code 5.12.090, fees derived from the sale of these licenses must be used for “defraying the costs of necessary police regulation, inspection, and control under the police power of the city, and not for revenue…” *Requires State License endorsement and applicable City of Bozeman Beer/Wine/Liquor licenses. This resolution increases the above fees by approximately 50% beginning January 2008, and again by 33% beginning January 2009. The resolution does not provide separate license designations for Clubs & Fraternal Organizations (as our prior ordinance did) because we have no clubs or fraternal organizations that have historically used those license designations. They purchase the full Beer/Wine/Liquor licenses from both the City and the State. These City licenses are renewed annually, each January. Renewal notices are sent to current licensees in mid-November. Since 1992, the City has seen an increase in personnel costs and the number of officers and staff that are needed to handle alcohol related crimes. Our police department (sworn and administrative) numbered 32.2 FTE’s in 1992 and has increased by 25.5 FTE’s (a 79% increase) to a total of 57.75 FTE’s in the current fiscal year. Since 1992, there has also been an 80% increase in the annual salary of a confirmed police officer (from $1,877/mo to $3,418/mo.) The police department now estimates that the majority of contacts and investigations made during nighttime hours involve either direct alcohol consumption (DUI) or are indirectly related, with alcohol being an aggravating factor; open containers, domestic abuse with one or both partners intoxicated; fights and loud parties involving alcohol consumption. In addition, the legal costs to prosecute alcohol-related citations have increased. In 1992, the City had one part-time prosecutor. In 2007, the City is struggling to keep up with caseloads using one full-time prosecutor and a part-time contracted prosecutor. RECOMMENDATION: Adopt Resolution No. 4079 – Establishing Fees for Beer, Wine and Liquor Licenses for the next two years. FISCAL EFFECTS: Adoption of this resolution will increase Beer, Wine and Liquor Licenses revenues by approximately $21,500 (to a total of $64,500) in FY08 and an additional $21,500 (to a total of $86,000) in FY09. This money will defray costs of police officers and prosecution that are currently paid out of the General Fund budget. With these new fees due in 363 January 2008, consideration could also be given to increasing our existing level of contract prosecution in FY08. ALTERNATIVES: As suggested by the City Commission. WHEREAS, the City Commission of the City of Bozeman, following notice and public hearing establishes the following license fees. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the annual license fees for years beginning January 1, 2008, January 1, 2009 and years thereafter are as follows: Section 1 – Annual License Fees Beer & Wine: January 1, 2008 January 1, 2009 Brewers $150.00 $200.00 Wholesalers of Beer & Wine $115.00 $150.00 Retail Sale of Beer $300.00 $400.00 Retail Sale of Wine $300.00 $400.00 Liquor: Retail Sale of Liquor $450.00 $600.00 Catering Alcohol* – per event $55.00 $70.00 *Requires State License endorsement and applicable City of Bozeman Beer/Wine/Liquor licenses.
