COMMISSION RESOLUTION NO. 625
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SPECIAL
ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY
OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, FOR THE MAINTENANCE OF PARKINGS TO
DEFRAY THE COST OF MAINTAINING THE PARKINGS WITHIN SAID SPECIAL IMPROVEMENT DISTRICTS
OF THE CITY .'OF BOZEMAN FOR THE YEAR 1948.
WHEREAS, the City Council and the Commission of the City of Bozeman have heretofore
duly and regularly passed eouncil and Commission Resolutions creating special improvement

districts within the City of Bozeman, defining the boundaries thereof and providing for
the maintenance of parkings therein, and for the assessment of the cost of maintaining
the parkings as set forth in Resolutions hereinafter referred to; and
.
WHEREAS,
the parkings within the boundaries of said Special Improvement Districts
have been cared for and maintained during the year 1948, as contemplated in said Resolution,
in accordance with terms and conditions thereof; and
WHEREAS, said Special Improvement Districts for the maintenance of parkings and the
Resolutions creating the same,
the total frontage or the area, of the property within said
districts to be assessed, the total cost of said maintenanoe within said distriots and the
amount chargeable to the property therein,
is hereinafter set forth.
NOW, THEREFORE, pursuant to the provisions of Section 5242, Political Code, R.C.M.,
1935, and said Council and Commission Resolutions, creating said Special Improvement Districts,
and providing for the maintenance thereof;
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN,
STATE OF MONTANA:
Section 1.
That for the year 1948, The City of Bozeman has defrayed the cost
($6,092.32) of maintenance of parkings in the several Special Improvement Districts,

pursuant to Resolutions creating the same, and that the entire cost thereof,
the total
number of lineal feet, or area, of property to be assessed, and the rate per linear or
square foot, is as follows,
to-wit:
Maintenance of Parking District No.6, created by Council Resolution No. 306, on S.
Willson Ave. from Babcock St. to College St., a total frontage of 4355.37 linear feet,
at the sum of $875.71, at an approximate rate per front foot of $0.201064.
Maintenance of Parking Distriot No. 16, created by Council Resolution No. 356, Babcock
St. from Black Ave. to Tracy Ave., a total area of 93773 square feet, the sum of $59.57,
at an approximate rate per square foot of $0.0006365.
Maintenance of Parking District No. 17, created by Council Resolution No. 355, Grand
Ave. from Babcock St. to College St., a total area of 581481 square feet, the sum of
$552.66, at an approximate rate per square foot of $0.0009504.
Maintenance of Parking District No. 18, created by Council Resolution No. 357, Tracy
Ave. from Babcook st. to Dickerson St., a total area of 457782.2 square feet, the sum of
$307.32 at an approximate rate per square foot of $0.000671.
Maintenance of Parking District No. 31, created by Cauncil Resolution No. 385, Black
Ave. from Babcock St. to College st., a total area of 267853.2 square feet, the sum of
$597.91, at an approximate rate per square foot of $0.0022322.
Maintenance of Parking Distriot No. 45, created by Council Resolution No. 432, Eighth
Ave. from Koch St. to Dickerson St., a total area of 66000 square feet, the sum of $114.39,
at an approximate rate per square foot of $0.001733.
Maintenance of Parking Distriot No. 48, oreated by Council Resolution No. 435, Eighth

Ave. from Main st. to Koch St., a total area of 116104 square feet, the sum of $307.58,
at an approximate rate per square foot of $0.0026492.
Maintenanoe of Parking District No. 50, created by Council Resolution No. 474, Third
Ave. from Story St. to Cleveland St., a total area of 378774 square feet, the sum of
$360.01, at an approximate rate per square foot of $0.00095046.
Maintenanoe of Parking Distriot No. 52, created by Council Resolution No. 476, Babcock
St. from Fifth Ave. to Eighth Ave., a total area of 174600 square feet, the sum of $174.92,
at an approximate rate per square foot of $0.0010018.

Street to College St., a total frontage of 2426.2 linear feet, the sum of $325.70, at
an 'approximate rate per front foot of $0.13424.

East story Street, a total frontage of 70 linear feet, the sum of $12.44, at an approx-

Maintenance of Parking District No. 114, crea,ted by Council Itesolution No. 722,
west side of Grand Ave. from College St. to Arthur St., a total. frontage of 930 linear
feet, the sum of $155.32, at an approximate rate per front foot of $0.167011.
Maintenance of Parking District No. 117, created by Council Resolution No. 719,
Tracy Ave. from Dickerson St. to College St., a total frontage of ~408.2 linear feet,
the sum of $136.17, at an approximate rate per front foot of $0.0966979.
Maintenance of Parking District No. 151, created by Council Resolution No. 810,
east side of Fifth Ave. from Olive St. to Koch St., a total area of 111189.06 square feet,
the sum of $75.23, at an approximate rate per front foot of $0.00067659.

east side of Grand Ave. from College St. to Arthur St., a total frontage of 930 linear
feet, the sum of $155.32, at an approximate rate per front foot of $0.16701.

of Harrison Street between Sixth and Seventh Avenues, 8 total frontage of 1456 linear
teet, the sum of $195.79, at an approximate rate per front foot of $0.13447.
Section 2. That to defray the cost of
maintenance of parkings within said Special

Improvement Districts for the year 1948, there be and there is hereby levied and assessed
a tax upon all the property in front of and bordering on said Special Improvement Districts
as set forth in Schedule One to Twenty-one inclusive, hereto attached and made a part here-
of; that a particular description of each lot and parcel of land with the name of the owner
and the sum assessed against him or it, is
set forth in assessment lists hereto attached

to Twenty...one (21)" and made a part thereof; that the several
sums set opposite the names of the owners and the descriped lots and parcels of land be,
and the same are hereby levied and assessed upon and against said lots and parcels of
land; that the several sums be collected from the respective owners of said lots and
parcels of land described in the said assessment lists, Schedules One (1)
to Twenty-one
C2l) inclusive, as required by law; tha~
said sums shall be paid and the collection there-

of shall be made in the manner and in accordance with the law governing the collection ot
Special Improvement Taxes; that failure
to pay such assessments when same shall become due
and payable shall make such person and
such lots and parcels of land liable to the penalties

provided by law relative to delinquent taxes.
Section 3. Tha t the regular session
of the Commiss ion of The C1 ty of Bozeman to be
held on the 25th day of August,
1948, at the Commission Chamber, City Hall Building, be,
and the same is hereby designated as the time and place at which objections to the final

adoption ot this Resolution wi~l be heard, by the Commission.
Section 4.
That the Clerk of the Commission be, and he is hereby ordered and
directed to publish in The Bozeman Daily Chronicle, a daily newspaper, printed and
published in the City of Bozeman, a notice signed by the Clerk of the Commission, and
stating that a resolution levying a special assessment of taxes to defray the cost of.
maintenance of parkings in the said Special Improvement Districts for the year 1948,
is

on file in the office of the Clerk of the Commission,
subiect to inspection for a period
of five days; that said notice shall state the time and place at which objections will
be heard by the Commission to the final adoption of this Resolution;

published at least five days before the date set by the Commission for hearing objections
and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of The City of Bozeman at a
regular meeting of s"aid Commission, August 18th, 1948.

OF Y~INTENANCE OF PARKINGS IN SPECIAL IMPROVEMENT DISTRICTS FOR THE YEAR 1948.
NOTICE IS HEREBY GIVEN,
That at a regular session of the Commission of The City
of Bozeman held on the 18th day of August, 1948, .Commisaion Resolution No. 625 was duly
passed and adopted; that said Commission Resolution No. 625 levies and assesses a
special assessment of taxes upon all the property in Special Improvement Districts of
said City to defray the cost of Maintenance of Parkings within said Special Improvement
Districts for the year 1948.
That the Special Improvement Districts and the Resolutions creating the same, and
the amount of the assessments are as follows:

That, said Commission Resolution No.
625 is now on file in the office of the Clerk
of the Conmlission of the said City
of Bozeman subject to inspection for a period of
five (5) days, by any person interested;
that Wednesday, the 25th day of August, 1948,
at 1:00 o'clock P.M., of said day at a regular session of the Commission of The City
of Bozeman, Commission Chamber, City Hall BUilding, has been designated as the time
and place when and where said Commission will hear and pass upon any and all objections
that. may be made to the final passage and adoption of said Commission Resolution No.
625 and the levying of said assessment; and that,
said Resolution will be finally
passed and adopted at said regular session of said Commission, subject to such correct-
ions and amendments as may be made upon objections made and filed within the five days
limit as provided by law.
All persons interested are referred to the several Council and Commission Reso-
lutions creating the aforesaid Special Improvement Districts, defining the boundaries
thereof and providing for the assessment of the cost of said maintenance of parkings.
For further particulars, all of said Resolutions being on file in the office of the

Clerk of the Commission of the City of Bozeman, at the City Hall of said City, and
subject to the inspection of all interested
parties.
