HomeMy WebLinkAboutResolution 623 Creates SID No. 348 21:' COMMISSION RESOLUTION NO. 623 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 348 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING CONCRETE CURBS, GRADING THE STREETS AND PARKINGS, APPLYING BASE GRAVEL AND PAVEMENT THERETO AND INSTALLING NECESSARY STORM SEWERS THEREIN ON THIRTEENTH AVENUE FROM THE SOUTH LINE OF KOCH STREET TO THE NORTH LINE OF COLLEGE I STREET; KOCH STREET FROM THE WEST LINE OF FOURTEENTH AVENUE TO THE WEST LINE OF EIGHTH AVENUE; TWELFTH AVENUE FROM THE SOUTH LINE OF KOCH STREET TO THE SOUTH LINE OF STORY STREET; NINTH AVENUE FROM THE NORTH LINE OF KOCH STREET TO THE NORTH LINE OF CURTISS STREET, IN SAID CITY. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain property owners on Thirteenth Avenue from the south line of Koch Street to the north line of College Street, Koch Street from the west line of Fourteenth Avenue to the west line of Wighth Avenue, Twelfth Avenue from the south line of Koch Street to the south line of Story Street and Ninth Avenue from the north line of Koch Street to the north line of Curtiss Street asking that a special improvement district be created for the purpose of constructing on said streets concrete curbs, grading the said streets and parkings, applying base gravel and pavement and installing necessary storm sewers; and WHEREAS, at the regular meeting of the City Commission of The City of Bozeman held on the 7th day of April, 1948, said petition was duly considered and granted, NOW THEREFORE, . BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 I That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 348 of The City of Bozeman for the purpose of constructing concrete curbs, grading the streets and parkings, applying base gravel and pavement thereto and install- ing necessary storm sewers therein, on Thirteenth Avenue from the south line ot Koch Street to the north line of College Street, Koch Street from the west line of Fourteenth Avenue to the west line of Eighth Avenue, Twelfth Avenue from the south line of Koch Street to the south line of Story Street, and Ninth Avenue from the north line of Koch Street to the north line of Curtiss Street, in said City, within the boundaries part- icularly described as follows: Beginning at the intersection of the West line of Eighth Avenue and the center line of Koch Street; thence north on the west line of Eighth Avenue 180 feet; thence west on a line parallel with and 150 feet north of the north line of Koch Street to the center line of the alley between Eighth Avenue and Ninth Avenue; thence north on the center line of said alley to the center line of Curtiss Street; thence west along the center line of Curtiss Street to the center line of the alley between Ninth Avenue and Tenth Avenue; thence 8011th along the center line of said alley to 8 point 150 feet north of the north line of Koch Street; thence west along a line parallel with and 150 feet north of the north line of Koch Street to the center line of vacated Fourteenth Avenue; thence south along the center line of Fourteenth Avenue to a point 150 feet south of the south line of Koch Street; I thence east along a line parallel with and 150 feet south of the south line of Koch Street to the center line of the alley between Thirteenth Avenue and Four- teenth Avenue; thence south along the center line of said alley to the horth line of College Street; thence east along the north line of College Street to the extended center line of the alley between Twelfth Avenue and Thirteenth Avenue; thence north along the extended center line and the center line of said alley to the center line of Story Street; thence east along the center line of Story Street to the center line of the alley between Eleventh Avenue and Twelfth Avenue; thence north along the center line of said alley to a point 150 feet south of the south line of Koch Street; thence east along a line parallel with and 150 ~eet south of the south line of Koch Street to the west line of Eighth Avenue; thence north along the west line of Eighth Avenue to the center line of Koch Street., the point of beginning. 22 Section 2 That a preliminary and approximate estimate of the cost of said improvements is $68,244.70, which is to be assessed against the property within said district on the area basis. The area of all assessable property within said district (exclusive of streets, avenues, alleys and public places) is 944,212.5 square feet. The estimated rate of assess. I ment is $0.072 per square foot. As provided by law the corner 25 feet will bear double the assessment of inside lots. Payment for said improvements to be made in twenty annual installments covering a period of nineteen years. Section 3 That the regular meeting of the City Commission to be held on the 18th day of August, 1948, at 1:00 o'clock P.M. at the regular meeting place of the City Commission in the City Hall Building of the City of Bozeman is the time and place when and where objections will be heard to the creation of said district and the passage of a resolution pursuant to this resolution of intention; and the City Manager is hereby directed to cause notice of this resolution to be served upon all persons whose property is within said propose~ Special Improvement District No. 348 and as hereln described, on Thirteenth Avenue from the south line of Koch Street to the north line of College street, Koch Street from the west line of Fourteenth Avenue to the west line of Eighth Avenue, Twelfth Avenue from the south line of Koch Street to the south line of Story Street"a.nd Ninth Avenue from the north line of Koch Street to the north line of Curtiss Street, and to give notice hereof by publication, all in the manner and form. as prescribed by Section 5227, Revised Codes of Montana, 1930. Resolution No. 623 - Page 2 -..---.-- 23 That Wednesday, the 18th day of August, 1948, at 1:00 o'clock-P.M. at the Commission Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 623 as the time and place for hearing objections to the action proposed to be taken by said Reso- lution and the adoption of a resolution giving effect to the same, and when and where any and all persona whose property is wi thin s aid proposed Special Improvement District I No. 348, on Thirteenth Avenue from the south line of Koch Street to the north line of College Street, Koch Street from the west line of Fourteenth Avenue to the west line of Eighth Avenue, Twelfth Avenue from the south line of Koch Street to the south line of Story Street and Ninth Avenue from the north line of Koch Street to the north line of Curtiss Street, may appear and show. cause, if any they have, against said proposed improvemen t . Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after the date of the first publication of' this notice. An approximate and preliminary estimate of' the cost of doing such work and making such improvement is $68,244.70, with the corner 25 feet doubled for the purpose of assessment. For a description of the boundaries of said Special Improvement District No. 348 reference is hereby made to Resolution No. 623 of the Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and to the public generally.
