BACKGROUND: The applicant is proposing to amend the City of Bozeman Zoning Map to change the municipal zoning designation from M-1 (Light Manufacturing District) to R-O (Residential Office District) on approximately 7.388 acres of land generally situated on the east side of North 27th Avenue, just north of the intersection of Catron Street and North 27th Avenue, in Phase 3 of the Cattail Creek Subdivision. The City Commission approved the requested zone map amendment application on Monday, July 16th, 2007. UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for the proposed development at this time. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues, along with increased costs to deliver municipal services to the property, when the property is developed. APPROVED BY: Andrew Epple, Planning Director Chris Kukulski, City Manager 30 ORDINANCE NO. 1725 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP FROM “M-1” (LIGHT MANUFACTURING DISTRICT) TO “R-O” (RESIDENTIAL OFFICE DISTRICT) FOR APPROXIMATELY 7.388 ACRES ON PROPERTY DESCRIBED AS LOTS 2, 3, 4, AND 5, BLOCK 3, CATTAIL CREEK SUBDIVISION PHASE 3, CITY OF BOZEMAN, SITUATED IN THE NORTHEAST ONE-QUARTER OF SECTION 23, T2S, R5E, P.M.M., GALLATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to grant a zoning designation of "R-o" (Residential Office District) has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on July 3, 2007, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved as proposed; and WHEREAS, after proper notice, the City Commission held its public hearing on July 16, 2007, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone map amendment criteria established in Section 76-2-304, M.C.A., and found that the proposed zone map amendment would be in compliance with the twelve criteria; and WHEREAS, at its meeting held on July 16, 2007, the City Commission found that the proposed zone map amendment would be in compliance with Bozeman’s adopted growth policy and would be in the public interest. 1 31 NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as "R-O" (Residential Office District): Lots 2, 3, 4, and 5, Block 3, Cattail Creek Subdivision Phase 3, City of Bozeman, Gallatin County, Montana; and located in NW¼ of Section 35, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana. Said parcel containing 7.388 acres more or less. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
