(CITY) 620 AN AGREEMENT AND JOINT RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND OF THE TRUSTEES OF SCHOOL DISTRICT NUMBER SEVEN OF GALLATIN COUNTY, MONTANA, IN REGULAR SESSION ASSEMBLED, ENTERING INTO AN AGREEMENT BETWEEN THE SAID CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND THE TRUSTEES OF SCHOOL DISTRICT NUMBER SEVEN OF GALLATIN COUNTY, MONTANA, TO ESTABLISH, PROMOTE, MAIN- TAIN AND SUPPORT A JOINT GENERAL RECREATION PROGRAM FOR THE CITY OF BOZEMAN AND THE SCHOOLS OF THE CITY OF BOZEMAN. WHEREAS, the City Commission of The City of Bozeman and the Trustees of School I District Number Seven have a common interest in the establishment and maintenance of an integrated general recreation program for The City of Bozeman and for the schools of The City of Bozeman; and WHEREAS, The City of Bozeman and the schools of The City of Bozeman are now maintaining separate recreation programs; and WHEREAS, the recipients of the benefits of the now separate recreational pro- grams of The City of Bozeman and the schools of The City of Bozeman are, in general, the same; and WHEREAS, there has existed and presently exists a need for continuity and int- egration of the general recreation program for The City of Bozeman and the schools of the City of Bozeman; and WHEREAS, The City of Bozeman and the schools of The City of Bozeman each own and maintain recreational facilities and desire to integrate and jointly utilize such facilities; and WHEREAS, during certain parts of the year The City of Bozeman employs a recreat- ional director and during the remaining parts of the year the schools of the City of I Bozeman employ a recreational director; and WHEREAS, it is considered advantageous to employ recreational personnel jointly to facilitate the desired continuity and integration of recreational programs. NOW THEREFORE, IT IS RESOLVED AND AGREED BY THE CITY OF BOZEMAN AND SCHOOL DISTRICT NUMBER SEVEN ACTING BY THEIR RESPECTIVE GOVERNING BODIES, NAMELY, THE CITY COMMISSION OF THE CITY OF BOZEMAN IN REGULAR SESSION ASSEMBLED AND THE TRUSTEES OF SCHOOL DISTRICT NUMBER SEVEN IN REGULAR SESSION ASSEMBLED, AS FOLLOWS: 1. That the City of Bozeman and the Trustees of School District Number Seven join in the establishment, promotion, maintenance and support of a general, integ- rated city-wide recreational program. 2. That a competent, well-qualified person be employed to administer and coor- dinate such a general, integrated, city-wide recreational program in the capacity of a recreational director. 3. That such recreational director be employed jointly by The City of Bozeman and the Trustees of School District Number Seven on a full time, annual basis at an agreed monthly salary, The City of Bozeman to pay such director the full monthly I salary during the three (3) summer months and one-half of the full monthly salary during the remaining nine (9) months of the year, and the Trustees of School District Number Seven to pay one-half of the full monthly salary for the remaining nine (9) months of the year. 4. That the person so hired as recreational director will devote his full working time in the three (3) summer months and one-half of his time in the remain- ing nine (9) months to the recreational program of the City of Bozeman and the Resolution No. 620 .--... - -"..--.--- 13: remaining one-half of his time in the remaining nine (9) months to the physical education and recreation program of the pUblic schools. 5. That the selection and employment of the said recreational director shall be made by the Superintendant of The Elementary Schools of The City of Bozeman and the City Manager of The City of Bozeman, subject to the approval of the Trustees of School I District Number Seven and the City Commission of The City of Bozeman, and the work of said recreational director shall be performed in accordance with and subject to rules and regulations for such a position to be prepared and jointly approved by the Recreation Board of The City of Bozeman, the said Superintendant of The Elementary Schools of The City of Bozeman and the City Manager of The City of Bozeman. 6. That neither the City of Bozeman nor the Trustees of School District Number Seven will individually contract with a recreational director without the consent of the other, and that during the term of any contract with a recreational director, neither The City of Bozeman nor the Trustees of School District Number Seven will terminate their part of any contract with said recreational director without the consent of the other. 7. That the provisions of this Resolution shall be and become effective upon the adoption thereof by The City of Bozeman and the Trustees of School District Number Seven.
