HomeMy WebLinkAboutResolution 616 Garbage Collection 4 COMMISSION RESOLUTION NO. 616 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF' GALLATIN, STATE OF MONTANA, SERVICED AND FROM V';rHCH GARBAGE ViAS COLLECTED AND RE- MOVED DURING THE YEAR 1947 TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOS- ING OF GARBAGE mmER THE PROVISIONS OF ORDDT !\NCE NO. 696 OF THE CITY OF BOZEMAN, MONTANA. WHEREAS, the City Commission of The City of Bozeman did on the 8th day of January, 1940, duly and regularly pass Ordinance No. 696, entitled: I "AN ORDINANCE DEFINING GARBAGE FOR THE PURPOSES OF THIS ORDINANCE; PROVIDING FOR THE COLLECTION AND DISPOSITION THEREOF BY AND tJNDER THE SUPERVISION AND CONTROL OF THE DEPARTMENT OF 'PUBLIC WELFARE AND POR DEFRAYING THE COST OF SUCH COLLECTION AND DIS- POSITION BY SPECIAL ASSESSMENT AGAINST THE PROPERTY TO WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR TIm VIOLATION OF THIS ORDINANCE, which Ordinance No. 696 passed as aforesaid is hereby referred to and made a part of this resolution for f'urther particulars in respect to the basis and method of assessing the cost against the property herein assessed; and, WHEREAS, said expense incurred by said City in the collection and disposition of garbage in accordance with said Ordinance is hereby estimated by the Commission of The City of Bozeman to be the sum of Twenty-one Thousand Two Hundred Twenty-three Dollars and Fifty-four Cents ($21,223.54), for the year 1947, over and above all moneys collected from business and professional concerns, or combined residence and ~lsiness, or residence and professional business concerns in accordance with said Ordinance No. 696; and WHEREAS, in order to raise said 3um to defr8.Y said cost, it is necessary to establish the basic unit rate as defined in said Ordinance No. 696 at Eight Dollars ($8.00). NOW, THEREFORE, PURSUANT to the provisions of said Ordinance No. 696, and the laws of the State of Montana; I BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISS ION OF THE CITY OF BOZEMAN, STATE OF MONTANA Section 1. That to defray the estimated cost and expense of collecting and disposing of garba~e in The City of Bozeman for the year 1947, there is hereby levied and assessed against the property and the several lots, pieces and parcels of land thereof within The City of Bozeman, as set forth in Schedule "A", which is attached hereto and made a part hereof, a tax; that a particular description of each lot and parcel of land with the name of the owner and/or owners and the sum assessed a~ainst the same is set forth in the assess- ment list in said Schedu_le "A"; that the several sums set opposite the names of said owners and trc described lots and parcels of land, be, and the same are hereby levied and assessed upon and a~ainst said lots and parcels of land for ssid purpose; that the several sums be collected from the respective owners of said lots and parcels of land described in said assessment list and owned by them; that said sums shall be paid and the collection there- of be made in the manner and in accordance with Ordinance No. 696 of The City of Bozeman, Montana, and the laws of the State of Montana governing the collection of special improve- ment taxes; that failure to pay such assessment when the same shall bocome due and payable I shall make such person and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Sec tion 2. Tbat the regular session of the Commission of The Oity of Bozeman, Montana, to be J:ield ln the Cornmls::don Chamber in the Ci ty Hall of said C1 ty on the 29th day of October, 1947, at 1:00 o'clock P.M., be, and the same is hereby designs ted as the time and place at which objections to the final adoption of this Resohltion will be beard by said Comnission. That the Clerk of the Corr.mission of The City of Bozeman be, and he is hereby ordered and dirocted to publish in the Sozeman D3ily Chronicle, a daily newspaper printed and published in said City of Bozeman, a notice signed by the Clerk of the ComMission, ststing that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of the collection and disposition of garbage in I The Clty of Bozeman for the year 1947, against the property to which such service was rendered, is on fi.le in the offlce of the Clerk of the C01:11T1ss ion, subject to inspection for a period of five days; that said notice shall state the time and place at which objections will be heard by the Commlsslon to the final adoption of this Resolution; and that said notice shall be published at least five days before the day set by the Commission for hearing of objections and the final adoption of this Resolutlon. NOTICE IS HERBBY GIVEN, tDat at a repular session of the Commission of the City of Bozeman, held on the 22~d day of October, 1947, Commission Resolution No. 616 was provisionally passed and adopted; that said Resolution levies and assesses a special assessment of taxes to defra y the cost of collection and disposition of garbage in The City of Bozeman, for the year 1947, upon all the property to which such service was rondered. That said Commission Resolution No. 616 is now on file in the office of the Clerk of the Commission of the City of Bozeman, subject to the inspection of all persons interested, for a period of five days; tha t Wednesda y, the 29th day of October, 1947, at 1:00 o'clock P.M. of said day at a regular session of the Co~~isslon of the City of Bozeman, in the Commission Room in the C1 t'J~ Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission I Resolution No. 616 and the levying of said assessment; and that said Resolution will be finally passed and adopted at s"1id regular session of said Com1111ssion, sub.1ect to such corrections ann amend~nnts that may be made upon objections made and filed with the Clerk of the Commission within the five days limit as provided by law.
