COMMISSION RESOLUTION NOo 615
A RESOLUTION OF THE COM1'ISSION OF THE CITY
OF BOZEMAN LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXRS UPON CERTAIN
PROPERTIES IN THE CITY OF BOZEMAN,
COUNTY OF GALLATIN, STATE OF MONTANA, TO
DEFRAY THE COST OF CONSTRUCTING AND
INSTALLING AND/OR REPAIRING MISCELLANEOUS
SIDEWALKS AND CURBS DURING THE YEAR
1947.
WHEREAS,
the ComITission of the
City of Bozeman, pursuant to the provisions of

entitled:

SIDEWALKS IN THE CITY OF BOZEMAN,
PROVIDING PENALTIES FOR THE VIOLATION OF THIS

435,
447, 449 AND 451,
AND ALL
OTHER ORDINANCES AND PARTS OF ORDINANCES
OF TI1E CITY OF BOZE~AAN IN CONFLICT
HEREWITH",
and the provisions of Section 5244,
Political Code, RoCoMo,
1935, provided for the
construction of sidewalks and curbs in the City of Bozeman during the year 1946,
without the formation of a Special Improvement District.
WHEHEAS,
proceedings were had for the construction and installation and/or repair
of Miscellaneous Sidewalks and Curbs in the City of Bozeman for
the year 1946, and
WHEREAS,
Miscellaneous sidewalk and curbs were constructed and installed and/or
repaired bordering on various properties in The City of Bozeman,
pursuant to Ordinance
Noo 561,

Political Code, R.C.Mo,
1935, which are hereby referred to and
made a part of this Resolution, and
WHEREAS,
the said Miscellaneous Sidewalks and Curbs have been constructed and
completed and/or repaired in accordance with the
terms and condi t:tons of said pro-
ceedings, and the City Engineer has
duly certified to the Commission a schedule show-

ing the sidewalks and curbs which nave been constructed and installed, and/or r~pair-
ed,
and
the properties which are subject to assessment thereunder and the
total cost
of said construction and installation
and/or repairing is the
sum of Eight 'Ihousand
One Hundred Fifty Five Dollars and Fifty Two Cents
($8,155.52) which schedule, marked
I!Schedule A", is hereto attached
and made a part hereof.
NOW,
THF$EFORE,
pursuant to the provisions of Ordinance Noo 561 as aforesaid,
and
Section 5244, Political Code,
RoC.Mo,
1935, as aforesaid,
BE IT RESOLVED AND IT IS HEREBY ORDri;RED
BY THE COMMISSION OF THE CITY OF
BOZEMAN,
MONTANA:
Section 10
That to defray the cost of constructing and installing and/or repair-
ing Miscellaneous Sidewalks and C,Jrbs as set forth in "Schedule A",
hereto attached
and made a part hereof, there
is herebu levied and assessed a tax amounting to
the sum
of Eight Thousand One Hundred Fifty Five Dollars and Fifty 'lwo Cents
($8,155052) 0

That a particular description of each lot and parcel of land with the
name of the owner and the
sum assessed against him or it for such construction and
installation and/or repair and
the amount of each payment to be made and the day when

the same shall become delinquent is set forth in the assessment list hereto attached

hereof; that
the several SUt!lS SAt opposite the
name of the owners and the description
of the lots and parcels of land be,
and the
same are hereby respectively levied and assessed upon said lots and parcels of land to
defra y the cost and expense of constructing
and installing and/or repairing said

Sidewalks and Curbs;
that the several sums so assessed be collected from the rospect-
ive owners of said lots and parcels of land described in said assessment list as
required by law; that the
payment of said sums shall be made in six installments;
that the payments of said installments shall be made
on or before
the 30th day of

November of each year until payment of all installments
together with the
interes t there-
of,
shall be made;
tha t sa.id sums shall be paid and the collection thereo,f shall be made
in
the manner and in accordance with the law governing the collection of Special Improve-
ment taxes;
that failure to pay such assessments when the same shall become due and pay-
able shall make such persons and said lots and parcels of land liable
to the pene 1 ties
provided by law relative to delinquent taxes;

Section 3.
That the re[;ular session of the Commission of tbe City of Bozeman to be
held 1n tho Commission Chamber in the City Hall of said City on the 22nd day of October,

at 1:00 o'clock P.M., be,
and the same 18 hereby designated as the
time and place
at which objections to the final adoption of this Resolut1on will be heard by said Comm-
ission.
Section 4.
That the Clerk of the Commission of the City of Bozeman be,
and he is
hereby ordered and directed to publish in the Bozeman Daily Chronlcle,
a daily newspaper
printed and published in the said City of Bozeman, a notice signed by the Clerk of the
Commission and stating that a Resolution levying and assessing a special assessment of
taxes
to d~frQY the cast and expense of constnlcting and installing and/or repairing
Sidewalks and Curbs in the City of Bozeman for the year 1946 is on file in the office
of the Clerk of the Commission subject to inspection for a period of five
( 5)

time and place at which objections will be heard by the
Commission to the final adoption of this Fesolutlon;
that it shall be published at least
fi ve
(5 ) days before the day ~et by
the Commission for the hearing of objections and the
final adoption of this Resolution.

OF MISCELLANEOUS SIDEWALKS MID CURBS
IN THE CITY OF BOZF.MAN, DURING THE YEAR
1947.
NOTICE IS HEREBY GIVEN,
that at a regular session of the Commission of The City of
Bozeman held on Wednesday the 15th day of October,
1947,
Commission Resolution No. 615

was provisionally passed and adopted;
that said Commission Resolution levies and assess-
es a special assessment of taxes upon certain lots and parcels of land in front,
or on
the side of which,
Sidewalks and Curbs have been constructed and/or repaired pursuant to
the provisions of Ordinance No.
561 and Section 5244,
Political Code,
R.C.M., 1935,
to
defray the cost and expense of constructing and installing and/or repairing said Side-
walks and Curbs.
That said Commission "Resolution is now on
file in the office of the Clerk of the
Commission Resolution No. 615

Commission, subject to inspection for a period
of five (5)
days by any persons interest-
ed; tha t Wednesday,
the 22nd day of October,
1947, at 1:00 o'clock P.M., of
said day,
at the regular session of the said Commission of The City of Bozeman at the Commission
Chamber in the City Hall Building of said City, has been designated as the time and
place when and where
the said Commission will hear and pass upon any and all ob,jections

that may be made to the final passage and adoption of said Resolution No. 615 and the
levying of said assessment, and that
said Resolution will be finally passed and adopted
at said regular session.
All persons interested are referred to said
Ordinance No. 561, and Commissioners
proceedings for the construction and/or repair of Miscellaneous Sidewalks and Curbs,
in front or on the
side of lots and parcels of land within the City of Bozeman for
the year 1946, without the formation of
a Special Improvement District.
