Home My WebLink AboutResolution 630 Removal of Noxious Weeds 43 COMMISSION RESOLUTION NO. 630 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SPECIAL ASSESS~fflNT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFPAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS, FOR THE YEAR 1948, PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 428; ENTITLED: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES.tI WHEREAS, the City Council of The City of Bozeman heretofore duly and regularly passed I Ordinance No. 428, entitled: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES", and WHEREAS, S ection 5U39.82, R.C.M., 1935, provides the City or Town Council has power to declare and determine what vegetation within the City or Town shall be noxious weeds, and to provide the manner in which they shall be exterminated, and to require the owner or owners of any property within said City or Town, to exterminate or remove noxious weeds from their premises, and the one-half of any road or street lying next to the lands or boulevard abutting thereon, and to provide, in the event the owner or owners of any said premises neglect to exterminate or remove noxious weeds therefrom, for levying the cost of such extermination or removal as special assessment against the property; and WHEREAS, owners of premises in said City have neglected to exterminate and remove noxious weeds therefrom during the year 1948, and The City of Bozeman, pursuant to Section 5U39.82 R.C .M., 1935, and Ordinance No. 428, have exterminated and removed noxious weeds from the premises of said owners and the total cost of the extermination and removal there- of is chargeable to the property as hereinafter set forth, pursuant to provisions of said Section 5039.82, Political Code, H.C.M., 1935, and said Ordinance No. 428; I NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE CO~mISSION OF THE CITY OF BOZEMAN, Section 1. That during the year 1948, The City of Bozeman has exterminated and removed noxious weeds from properties in The City of Bozeman and defrayed the cost thereof as set forth in Schedule "Att hereto attached and made a part hereof. Section 2. That to defray the cost ($5U7.ll) of extermination and removing said noxious weeds from said premises as set forth in saId SChedule, hereto attached and made a part here- of, for the year 1948, there be, and there is hereby levied and assessed a special tax against said property as set forth in said Schedule, hereto attached and made a part here- of; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked Schedule "A", and made a part hereof; that the several sums set opposite the names of the owners and the description of the lots and parcels of lands be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of lands described in said Assessment List, "Schedule A", as required by law; that said sums shall be paid and I the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when same shall become due and payable shall make such person and such lots and parcels of land liable to the penAlties provided by the law relative to delinquent taxes. Section 3. That the regular session of the Commission of The City of Bozeman to be held on the 8th day of September, 1948, at the Commission Room, City Hall Building, be, and the same is hereby designated as the time and place at which objections to the final adopt- ion of this Resolution will be heard by the Commission. That the Clerk of the Commission be and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper, printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a resolu- tion levying an assessment of taxes to defray the cost of exterminating and removing noxious weeds from certain properties in The City of Bozeman'for the year 1948, is on file in the office of the Clerk of the Commission, sub.1ect to inspection for a period of five days; I that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing of objections, and the final adoption of this resolution. NOT ICE I HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 63U LEVYING SPECIAL ASSESSMENT TO DEFRAY THE COST OF EXTERMINATING AND REMOVING NOXIOUS WEEDS ON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN FOR THE YEAR 1948. NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of The City of Bozeman held on the 1st day of September, 1948, Commission Resolution No. 630 was duly passed and adopted; that said Commission Resolution No. 630 levies and assesses a special assessment of taxes upon certain properties in The Cl ty of Bozeman for the year 1948, to defray the cost of exterminating and removing noxious weeds for the year 1948. The t, said Cornmiss ion Resolution No. 630 is now on file in the office of the Clerk or the Commission of said City of Bozeman subject to inspection of all persons interested for a period of five days; that Wednesday, the 8th day of September, 1948, at 1:00 o'clock P.M. of said day at a regular session of the Commission of The City of Bozeman, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all obJec tions that may be made to the final passage and adoption of sa id Commission Resolution No. 630 and the levying of sald assessment; that, said Resolution will be finally passed and adopted at said regular session of said Commission subject to such I corrections and amendments as may be made and filed within the five days limit as provided by law.
