HomeMy WebLinkAboutResolution 629 Creates SID No. 349 ...--.....-.-- 39 COMMISSION RESOLUTION NO. 629 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 349 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN (OIL MAT) PAVED SURFACE ON EXISTING GRAVEL BASE AND WHERE NO CURBS NOW EXIST, TO INSTALL CONCRETE CURBS ON WEST COLLEGE STREET BETWEEN THE WEST LINE OF FOURTH AVENUE SOUTH AND THE EAST LINE OF EIGHTH AVENUE SOUTH, IN SAID CITY. I 1,'VHEREAS, There has been filed with the Clerk of the City Commission of The City of Bozeman, Montana, a petition in due form of certain property owners on West College street between the west line of Fourth Avenue South and the east line of Eighth Avenue South asking that a special improvement district be created for the purpose of constructing and installing an (oil mat) paved surface on existing gravel base and where no curbs now exist, to install concrete curbs on West College Street between the west line of Fourth Avenue South and the east line of Eighth Avenue South; and WHEREAS, at the regular meeting of the City Commission of The City of Bozeman held on the 18th day of August, 1948, said petition was duly considered and granted, NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That it is hereby declared to be the intention of The City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 349 of The City of Bozeman for the purpose of installing a bituminous pavement and, where there is no concrete curb, to install concrete curb on West College Street between the west line of Fourth Avenue and the east line of Eighth Avenue. The pavement proposed is to be made by scarifying the present gravel surface on this street, adding I enough crushed gravel to bring the present surface to grade, applying bitumen or road oil to the gravel and "road-mix" and lay the mixed aggregate to form a three inch mat on the existing base material on the street, this mat to be sealed with an oil and gravel chip seal. Section 2. That the boundary of said Special Improvement District No. 349 shall be as follows: Beginning at a point on the east property line of Block 2, Capital Hill Addition, said point being 165 feet south of the N.E. corner of said Block 2; thence west on a line parallel with and 165 feet south of the north property line of Blocks 2, 3, 4, and 5, Capital Hill Addition, to the west property line of Block 5; thence north along the west line of Block 5, Capital Hill Addition and Block 40, Park AGdition, to a point on the west line of said Block 49, 177.75 feet north 'of the S.W. corner of said Block 49; thence east on a line through the center of Blocks 49, 48, 47, and 46, Park Addition, to a point on tne east line of Block 46, said point being 1'15.4 feet north of the S.E. Corner of said Block 46; thence south along tne east line of said Block 46 and Block 2, Capital Hill Addition, to point of beginning. Section 3. Tha t a preliminary and approximate estimate of the cost 01' the improve- ment is $5,552.00. The cost of the proposed improvement is to be assessed against the property within the district on an area basis, that property immediately adjacent to and within 25 feet from 'I the proposed improvement to be assessed at double the assessment against other property in the district. Where it is necessary to install curbs, assessment for the curbs will be made only against the property within the block where the curb is installed. The total area of property within the proposed district, with that area within 25 feet of the pro- posed improvement doubled, is 440,810 square feet. In that part of the district where curb is now installed, the estimated rate of assessment is $0.0107 per square foot and in that part of the district where it is necessary to install new curb the estimated rate of assess- ment is $0.1891. 40 Payment for said improvement is to be made in annual installments over a period not to exceed ten years. See tion 4. It is proposed to pay the entire cost and expense of the construction and installation of said improvement with cash to be obtained from the sale of bonds of said Special Improvement District No. 349, as authorized by law. Such bonds will be in denom~ inations of $100.00 each and fractions of $lOO.UO where necessary, to be issued and charge~ I able against a fund to be known and designated as Special Improvement District No. 349 Fund of The City of Bozeman. The bonds will be redeemable at the option of the City, singly or in mul tiples, and in the order of their registration, whenever funds are aVail~ able in said Special Improvement District No. 349 for that purpose. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not exceeding six (6%) per cent per annum, which interest shall be chargeable as a part of the cost of the construction and installation of said improvement. The bonds will be I issued and sold in accordance with the provisions of Section 5250 and Section 5277.3, Revised Codes of Montana, 1935, as said sections are amended by the provisions of Chapters 178 as to Section 5250, and by Chapter 179 as to Section 5277.3, both Chapters of the Laws of the 29th Legislative Assembly of the State of Montana, 1945, and all other applicable provisions of Chapter 398 of the Political Code, Revised Codes of Montana, 1939, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 5. That the regular session of the Commission of The City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the I 22nd day of September, A.D.,1948, at the hour of 1 o'clock P.M. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 349, the improvement proposed to be made pursuant thereto and the extent and characte~ thereof, or either thereof. Section 6. That the Clerk of the City Commission be, and he is hereby, directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution.of Intention. Adopted by the Commission of The City of Bozeman, Montana, at a stated and regular session of said Commission held on the 1st day of September, A.D., 1948 . Tha t Wednesday, the 22nd da~ of September, 1948, at 1:00 o'clock P.M. at the Commission Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 629 as the time and place for hearing objections to the action proposed to be taken by said Resolution . and the adoption of a Resolution giving effect to the same, and when and where any and all persons whose property is within said proposed Special Improvement District No. 349, on West College Street between the west line of Fourth Avenue South and the East line of Eighth Avenue South, may appear and show cause, if any they have, against said proposed improvemen t. Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after the date of the first publication of this no tice . I An approximate and preliminary estimate of the cost of doing such work and making such improvement is $5,552.00; that property immediately adjacent to and within 25 feet from the proposed improvement to be assessed at double the assessment against other property in , - the district.
