COMMISSION RESOLUTION NO. 627
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY
OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF REMOVAL OF SNOW FOR THE YEAR
1947~1948 PURSUANT TO PROVISIONS OF ORDINANCE NO. 502, ENTITLED: "AN ORDINANCE
PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CITY OF BOZEMAN AND
REPEALING ORDINANCE NO. 385, ENTITLED: 'AN
ORDINANCE PROVIDING FOR THE REMOVAL OF
SNOW AND ICE, DIRT, FILTH, AND OTHER OBSTRUCTIONS FROM SIDEWALKS ON MAIN STREET
BETWEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN'".

WHEREAS, the City Council of The City of Bozeman
heretofore duly and regularly
passed Ordinance No. 502, entitled:
"AN ORDINANCE PROVIDING FOR THE REMOVAL
OF SNOW FROM THE SIDEWALKS IN THE CITY OF
BOZEMAN AND REPEALING ORDINANCE NO. 385, ENTITLED:
'AN ORDINANCE PROVIDING FOR THE
REMOVAL OF SNOW AND ICE, DIRT, FILTH, AND OTHER OBSTRUCTIONS FROM SIDEWALKS ON
MAIN STREET BETWEEN WALLACE A VENUE AND FOURTH A VENUE IN THE CITY OF BOZEMAN'tt., and
WHEREAS, Section 5039.6 R.C.M., 1935, provides:
"The City or Town Council has power to regulate the use of sidewalks, and to require
the owners of the premises adjoining to keep sam.e free from snow xx xxx; and to
provide for levying the cost of removal as a special tax against the property xx xx",
and
WHEREAS, owners of premises in said City have neglected to remove the snow from the
sidewalks adjoining thereto during the year 1947-1948 and The City of Bozeman, pursuant
to Section 5039.6, and Ordinance No. 502 has removed the snow from the sidewalks adjoin~
ing the premises of said owners and the total cost of the removal thereof is chargeable
to the property as hereinafter set forth, pursuant to provisions of said Section 5U39.6
Political Code, R.C.M., 1935, and said Ordinance No. 502;
NOW THEREFORE BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE
CITY OF BOZEMAN, STATE OF MONTANA:

Section 1. That during the year 1947-1948, The
City of Bozeman has removed snow
from sidewalks adjoining premises in
The City of Bozeman and defrayed the cost thereof
as set forth in Schedule "One" hereto
attached and made a part hereof.
Section 2. That to defray the cost ($85.14)
of removing said snow from sidewalks
adjoining said premises as set forth in said Schedule "One" hereto attached and made a
part hereof, for the year 1947~1948, there be,
and there is hereby levied and assessed a
special tax against said property as set forth in said Schedule "One" hereto attached and
made a part hereof; that a particular description of each lot and parcel of land with the
name of the owner and the sum assessed against him or it is set forth in assessment list
hereto attached marked Schedule "One", and made a part hereof; that the several sums set
opposite the name of the owners and the description of the lots and parcels of land be,
and the same are hereby levied and assessed upon and against said lots and parcels of
land; that the several sums be collected from the respective owners of said lots and
parcels of land described in said assessment list, Schedule "Onett as required by law;
that said sums shall be paid and the collection thereof shall be made in the manner and
in accordance with the law governing the collection of special improvement taxes;
that

failure to pay such assessments when same shall become due and payable shall make such
person and such Iota and parcels of
land liable to the penalties provided by the law
relative to delinquent taxes.
Section 3. That the regular session of the Commission
of The City of Bozeman to
be held on the 1st day of September, 1948, at the Commission Room, City Hall Building, be,
and the same is hereby designated as the time and place at which objections to the final
adoption of this Resolution will be heard by the Commission.
Section 4. That the Clerk of the Commission
be, and he is hereby directed and ordered

to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in
said Ci ty of Bozeman, a notice signed by the Clerk of the Commission, and s ta ting tha t
a resolution levying a special assessment of taxes to defray the cost of removal of snow
and ice from sidewalks adjoining certain premises in The City of Bozeman for the year
1947-1948 is on file in the office of the Clerk of the Commission, subject to inspection
for a period of five (5) days; that said notice shall state the time and place at which I
objections will be heard by the Commission to the adoption of this Resolution; that it
shall be published at least five days before the date, set by the Commission for hearing
of objections and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of The City of Bozeman at a
regular meeting of said Commission on the 25th day of August, 1948.

HEARING, FINAL A,DOPTION COMMISSION RESOLUTION NO. 627, LEVYING SPECIAL ASSESSMENT I
TO DEFRAY THE COST OF REMOVAL OF SNOW FROM THE SIDEWALKS ADJOINING CERTAIN PREMISES
IN THE CITY OF BOZEMAN FOR THE YEAR 1947~1948.
NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of The City of
Bozeman, held on the 25th day of August, 1948, Commission Resolution No. 627 was duly
passed and adopted; that said Commission Resolution No. 627 levies and assesses a special
assessment of taxes upon certain properties in The City of Bozeman for the year 1948 to
defray the cost of removal of snow for the year 1947-1948.
That said Commission Resolution No. 627 is now on file in the office of the Clerk
of the Commission of said City of Bozeman subject to inspection of all persons interested
for a period of five (5) days; that Wednesday, the 1st day of September, 194~, at l:uu
o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman,
Commission Room, City Hall Building, has been designated as the time and place when and
where said Commission will hear and pass upon any and all objections tna t may be made
to the final passage and adoption of said Commission Resolution No. 627 and the levy-
ing of said assessment; and that said Resolution will be finally passed and adopted at
said regular session of said Commission, subject to such corrections and amendments as
may be made upon objections made and filed within five days limit as provided by law. I
