COMMISSION RESOLUTION NO. 659
A RESOLUTION OF TFffi CO~~ISSION OF THE CITY
OF BOZEMAN LEVYING AND ASSESSING A SPECIAL
ASSESSMENT OF TAXES UPON ALL THE PROPERTY
IN STREET SPRINKLING DISTRICTS OF 7HE CITY
OF BOZEMAN, COUN'IY OF GALLATIN, STATE OF
MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF
THE COST OF SPRINKLING STREETS WITHIN SAID
STREET SPRINKLING DISTRICTS OF THE CITY OF
BOZEMAN FOR THE YEAR 1949.
WHEREAS,
the City Council and the Commission of the City of Bozeman have heretofore

duly and regularly passed Council and Commission Resolutions creating Street Sprinkling
Districts within the City of Bozeman
and defining the boundaries thereof and providing
for the assessment of the cost of sprinkling
the same as set forth in Resolutions herein-
after referred to; and
WHEREAS,
the streets within the boundaries of said Street Sprinkling Districts have
been sprinkled during the year 1949, as contemplated in said Resolutions,
in accordance
with the terms and conditions thereof; and
WHEREAS,
the Street Sprinkling Districts and the Resolutions creatlng the same,
the
total frontage of the property within said District to be assessed,
the total cost of said
sprinkling within said Districts and the proportion thereof chargeable to the property
therein is hereinafter set forth.
NOW, THEREFORE, pursuant to the provisions
of Sections 5272 to 5277, incluslve, Po1-
itica1Code, R.C.M., 1935, and Ordinance
No. 295 and said Council and Commission Resolut-
ions creating said Street Sprinkling Districts;
BE IT RESOLVED AND IT IS HEREBY ORDERED BY
THE COMMISSION OF THE CITY OF BOZEMAN,
STATE OF MONTANA:

That for the year 1949,
the City of Bozeman has waived the sprinkling
assessments on the following districts:
130, 131, 132, 133, 134, 135, 136, 137, 138, 139,
140, 141, 142, 143, 144, 160, 161, 162,
163, 164, 192, 193, 194, 195, 196, 197, 198, 199,
204, 216, 217, 218, 219, 220, 232, 233, 234, 235, 236, 237, 238, and 256;
tha t for the year
1949, the City of Bozeman has defrayed the cost
($1583.80) of spr"ink1ing streets in the
several Street Sprinkling Districts pursuant to
Resolutions creating same, and that seventy-
five percent of the entire cost thereof ($1187.85) exclusive of the cost of sprinkling
parks and public places, the total number
of linear feet of property to be assessed, and
the rate per linear foot, is as follows,
to-wit:
Sprinkling District No.1, created by Council
Resolution No. 424i, Main Street from
Wallace Avenue to Fourth Avenue, a, total
frontage of 9363.4 feet, the sum of $1187.85,
being 75% of the entire amount, or at an
approximate rate per front foot of $0.12696.
Section 2.
That to defray seventy-five percent of the cost of sprinkling streets
within said street sprinkling districts for the year 1949,
there be, and there is hereby
levied and assessed a tax upon all property in front of and bordering on said street
sprinkling districts as set forth in Schedule One hereto attached and made a part hereof;
that a particular description of each lot and parcel of land with the name of the owner

and the sum assessed against him or it,
is is set forth in the assessment lists hereto
attached, marked "Schedule One" and
made a part hereof; that the several sums set opposite
tbe names of the owners, and the described
lots and parcels of land be, and the sa1J1e are
hereby levied and assessed upon and against Baid lots and parcels of land; that the several
Bums be collected from the respective owners of said lots and parcels of land described in
the said assessment lists, Schedule
One, as required by law; that said sums shall be paid
and the collection thereof shall be made in the manner and in accordance with the law gov-
erning the collection of special improvement taxes;
that failure to pay such assessments

when same shall become due and payable shall make such persons and such lots and parcels
of land liable to the penalties provided by law relative to delinquent taxes.

That the regular session of the Commission of the City of Bozeman to be
held on the 28th day of September,
1949, at the Commission Chamber, City Hall Building,
be, and the same is hereby designated as the time and place at which objections to the
final adoption of this Resolution will be heard, by the Commission.

Section 4.
That the Clerk of the Commission be, and he is hereby ordered and dir-
ected to publish in the Bozeman Daily Chronicle, a daily newspaper prlnted and published
in t he said Ci ty of Bozeman, a notice signed by the Clerk of the Commission, and stating
that a Resolution levying a special assessment of taxes to defray seventy-five percent
of the cost of sprinkling streets in the said Street Sprinkling Districts for the year
1949, is on file in the office of the Clerk of the Commission,
subject to inspection for
a period of five days;
that said Notice shall state the time and place at which objections
will be heard by the Commission to the final adoption of this Resolution;

jections, and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a reg-
ular sess ion thereof held on the 215 t day of September, 1949.

HEARING, FINAL ADOPTION COMMISSION EESOLUTION NO. 659 LEVYING ASSESSMENT OF SEVENTY-
FIVE PERCENT OF COST OF SPRINKLING STREETS, STREET SPRINKLING DISTRICTS FOR THE
YEAR 1949.
NOTICE IS HEREBY GIVEN,
that at a regular session of the Commission of the City of
Bozeman held on the 21st day of September, 1949, Commission Resolution No. 659 waS duly
passed and adopted;
that said Commission Resolution No. 659 levies and assesses a special
assessment of taxes upon all the property in Street Sprinkling Districts of said City to
defra y
75~ of the cost of sprinkling streets within said Street Sprinkling Districts for
the year 1949.
That said Street Sprinkling Districts and the Resolutions creating the same, and the
amount of the assessments are ss follows:
Street Sprinkling District #1 - Resolution No. 424! - Amount $1187.85.

That, said Resolution No. 659 is now on file in the office of the Clerk of the Com-
mission of said City of Bozeman subject to inspection of all persons interested for a
period of five days; that Wednesday, the 28th day of September,
1949, at 1:00 o'clock
P.M. of said day at a regular session of the Commission of the City of Bozeman, Commiss-
ion Room, City Hall Building, has been designated as the time and place when and where
said Commission will hear and pass upon any and all objections that may be made to the
final passage and adoption of said Commission Resolution No. 659, and the levying of said
Resolution No. 659 - Page 2

said assessment; and that said Resolution will be finally passed and adopted at said reg-
ular session of said Commission, subject to
such corrections and amendments as may be made
upon objections made and riled within rive days limit as provided by law.
