(CITY) 656 AN AGREEMENT AND JOINT RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND THE BOARD OF COUNTY COMMISSIONERS OF GALLATIN COUNTY, MONTANA, IN REGULAR SESSION ASSEMBLED, ENTERING INTO AN AGRE"~MENT BETWEEN SAID CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND THE SAID BOARD OF COUNTY COMMISSIONERS OF GALLATIN COUNTY, MONTANA, TO ESTABLISH, MAINTAIN, AND SUPPORT A JO~Tr.Y OWNRD -R~O RECEIVING AND TRANSMITTING STATIONF~OR-.!I'RE JOINT USE OF THE CITY 0 BOZEMAN, MONTANA, POL ICE--DE1'1rn'TMENT"--1n'IDTHE OFFICE OF THE S'FIER1F}i!.--~bL.COUNTY, MONTANA, AND SPECIFICALLY PROVIDING WHAT PORTIONS THEREOF SHALL BE OWNED JOINTLY BY THE CITY OF I BOZEMAN, MONTANA, AND THE COUNTY OF GALLATIN, MONTANA, AND WHAT PORTIONS TlmREOF SHALL BE SEPARATELY OWNED BY THE CITY OF BOZEMAN, MONTANA, AND THE COUNTY OF GALL- ATIN, MONTANA. WHEREAS, the City Commission of the City of Bozeman, Montana, and the Board of County Commissioners of Gallatin County, Montana, have a common interest in the estab- lishment, maintenance, and support of an integrated radio receiving and transmitting sta tion for the .10int use of the C1 ty of Bozeman Police Department and the office of the Sheriff of Gallatin County, Montana; and WHEREAS, The City of Bozeman and the County of Gallatin, Montana, are now maintain- ing separate radio receiving and transmitting facilities; and WHER.EAS, the recipients of the benefits of the now separately maintained radio rec- eiving and transmitting facilities are, in many respects, the same; and WHEREAS, there has existed and presently exists a need for integration, unification, and combination of the now separately maintained radio receiving and transmitting facil- ities; and WHEREAS, The City of Bozeman, Montana, and the County of Gallatin, Montana, desire to integrate, unify, and combine their separately owned and maintained facilities and it is considered to be mutually advantageous to do so. I NOW, THEREFOR.E, IT IS RESOLVED AND AGREED BY THE CITY OF BOZEMAN, MONTANA, AND THE COUNTY OF GALLATIN, MONTANA, ACTING BY THEIR RESPECTIVE GOVERNING BODIES, NAMELY THE CITY COMMISSION OF THE CITY OF BOZEMAN AND THE BOARD OF COUNTY COMMISSIONERS OF GALLATIN COUNTY, IN REGULAR SESSION ASSEMBLED, AS FOLLOWS: 1. That the City of Bozeman and the County of Gallatin join in the establishment, maintenance, and support of integrated, unified, and combined radio receiving and trans- mitting facilities for the use of the Police Department of the City of Bozeman and the office of the Sheriff of Gallatin County. 2. That to that end the City of Bozeman and the County of Gallatin shall purchase, own, and hold jointly and equally a sixty (60) Watt, FM central station radio receiver and transmitter; together with all parts and equipment necessary thereto, the hous ing or building necessary to house such station, and the communication facilities necessary to connect said station with the offices of the Police Department of the City of Bozeman, and the office of the Sheriff of Gallatin County. 3. That all the above-described jointly owned equipment and facilities sball be purchased by the County of Gallatin in the manner provided by law, and the City of Bozeman will reimburse the County of Gallatin in the amount of one-half (t) of the purchase price I of the said equipment and facilities. 4. That all maintenance and repair of the above-described jointly owned equipment and facilities shall be borne equally by the said City of Bozeman and the said County of Galla tin. 5. That a suitable isolated location for B'Jch receiving and transmitting station is necessary and that such location has been secured; that communication and power facilities between said station and the Bozeman Police Department and the Sheriff's office of Gallatin -.,.-.....-.--.-- . -....- .-"..------ 129 County are necessary and that service contracts for such communication and power facilities may and must be entered into with the Mountain States Telephone Company and the Montana Power Company, respectively; that the lease of said location for such station and the nec- essary service contracts for the said communication and power facilities shall be entered into jointly by both the City of Bozeman and the County of Gallatin as parties of the one I part and the owner of said location and the Mountain States Telephone Company and the Mont- ana Power Company, respectively, as parties of the other part, and such lease and service agreements shall bind both the City of Bozeman and the County of Gallatin. 6. That in addition to the above-described jointly owned equipment and facilities the City of Bozeman shall separately purchase, own, hold, maintain, and repair at its expense any additional equipment and facilities it may desire for use in connection with the said ,jointly owned equipment and facilities, including but not limited to the following: a. 1 remote control console b. 2 mobile receivers and transmitters for Police Department automobiles. c. 1 mobile receiver and transmitter for Police Department motorcycle. 7. That in addition to the above-described jointly owned equipment and facilities the Couny of Gallatin shall separately purchase, own, hold, maintain, and repair at its expense any aeditional equipment and facilities it may desire for use in connection with the Baid jointly owned equipment and facilities, including but not limited to the following; a. 1 remote control console b. 3 mobile receivers and'transmitters for Sheriff's Office automobiles. c. 1 handy-talkie receiver and transmitter for Sheriff's office. 8. That this agreement shall remain in full force and effect as to both the parties I hereto until cancelled or terminated by the mutual agreement of the City of Bozeman and the County of Gallatin. 9. That the provisions of this resolution shall be and become effective upon the adoption thereof by the City Commission of the City of Bozeman, Montana, and the Board of County Commissioners of Gallatin County, Montana. Passed and adopted by the unanimous vote of the City Comm.1ss1on of the City of Bozeman in regular session on the 7th day of September, 1949.
