HomeMy WebLinkAboutResolution 655 Maintenance of Parkings to Defray Cost -- 124 COMMISSION RESOLUTION NO. 655 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF' BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, FOR THE MAINTENANCE OF PARKINGS, TO DEFRAY THE COST OF MAINTAINING THE PARKINGS WITHIN SAID SPECIAL IMPROVEMENT DISTRICTS OF TIm CITY OF BOZEMAN FOR THE YEAR 1949. WHEREAS, the City Countil and the Commission of the City of Bozeman have heretofore duly and regularly passed Council and Commission Resolutions creating special improvement I districts within the City of Bozeman, defining the boundaries thereof and providing for the maintenance of parkings therein, and for the assessment of the cost of maintaining the parkings as set forth in Resolutions hereinafter referred to; and WHEREAS, the parkings within the boundaries of said special improvement districts have been cared for and maintained during the year 1949, as contemplated in said Resolu- tions, in accordance with terms and conditions thereof; and vTIIEREAS, said Special Improvement Districts for the maintenance of parkings and the Resolutions creating the same, the total frontage or the area of the property within said districts to be assessed, the total cost of said maintenance within said districts and the amount chargeable to the property therein, is hereinafter set forth. NOW, THEREFORE, pursuant to the provisions of Section 5242, Political Code, R.C.M. 1935, and said Council and Commission Resolutions, creating said Special Improvement Districts, and providing for the maintenance thereof; BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That for the year 1949, the City of Bozeman has defrayed the cost, I ($5257.05) of maintenance of parkings in the several Special Improvement Districts, pursuant to Resolutions creating the same, and the entire cost thereof, the total number of lineal feet, or area, of property to be assessed, and the rate per linear or square foot, is as follows, to-wit: Maintenance of Parking Distrlc,t No.6, created by Council Resolution No. 306, on South Willson Avenue from Babcock i:)treet to College Street, a total frontage of 4355.37 linear feet, at the sum of $756.94, at an approximate rate per front foot of $0.173795. Maintneance of Parking District No. 16, created by Council Resolution No. 356, Babcock Street from Black Avenue to Trace Avenue, a total area of 93773 square feet, the sum of $51.00, at an approximate rate per square foot of $0.0005439. Maintenance of Parking District No. 17, created by Council Resolution NO.355, Grand Ave. from Babcock Street to College Street, a total area of 581481 square feet, the sum of $477.46, at an approximate rate per square foot of $0.0008211. Maintenance of Parking District No. 18, created by Council Resolution No. 357, Tracy Avenue from Babcock Street to Dickerson Street, a total area of 457782.2 square feet, the sum of $265.22, at an approximate rate per square fr:>ot of $0.0005794. Maintenance of Parking District No. 31, created by Council Resolution No. 385, Black Avenue from Babcock Street to College Street, a total area of 267853.2 square feet, the sum of $516.61, at an approximate rate per square foot of $0.0019287. Maintenance of Parking District No. 45, created by Council Resolution No. 432, Eighth Avenue from Koch Street to Dickerson Street, a total area of 66000 square feet, the sum of $98.31, at an approximate rate per square foot of $0.0014895. I Maintenance of Parking District No. 48, created by Council Resolution No. 435, Eighth Avenue from Main Street to Koch Street, a total area of 116104 Square feet, tbe sum of $265.44, at an approximate rate per square foot of $0.u02286. Maintenance-of Parking District No. 50, created by Council Resolution No. 474, Third Avenue from Story Street to Cleveland Street, a total area of 378774 square feet, the sum of $310.80, at an approximate ra.te per square foot of $0.0008205. Maintenance of Parking District No. 72, created by Council Resolution No. 564, I College Street from Grand Avenue to Seventh Avenue, a total area of 515294.7 square feet, the sum of $374.11, at an approximate rate per square foot of $0.U007260. Maintenance of Parking District No. 77m created by Council Resolution No. 578, Eighth Avenue from Dickerson Street to Harrison Street, a total frontage of 1971 linear feet, the sum of $222.91, at an approximate rate per front foot of $0.1130949. Maintenance of Parking District No. 86, created by Council Resolution No.620, south side of Story Street from Sixth Avenue to Eighth Avenue, and both sides of Sixth Avenue from Story Street to College Street.. a total frontage of 2426.2 linear feet, the sum of $281.12, at an approximate rate per front foot of $0.1158634. Maintenance of Parking District No. 107.. created by Council Resolution No. 658, East Story Street, a total frontage of 70 linear feet.. the sum of $10.14, at an approxima te rate per front foot of $0.144857. Maintenance of Parking District No. 114, created by Council Resolution No. 722, west side of Grand Avenue from College Street to Arthur Street, a total frontage of 930 linear feet, the sum of $133.72, at an approximate rate per front foot of $0.143785. . Maintenance of Parking District No. 117, created by Council Resolution No. 719, Tracy Avenue from Dickerson street to College street, a total frontage of 1408.2 linear feet, the sum of $117.15.. at an approximate rate per front foot of $0.0831913. Maintenance of Parking District No. 151, created by Council Resolution No. 810, east side of Fifth Avenue from Olive Street to Koch Street, a total area of 111189.06 square feet, the sum of $64.44, at an approximate rate per square foot of $0.0005796. Maintenance of Parking District No. 189, created by Council Resolution No. 1004, east side of Grand Avenue from College Street to Arthur Street, a total frontage of 930 linear feet, the sum of $133.72, at an approximate rate per front foot of $0.14:3785. Sixth Avenue, Cleveland to Garfield street, a total frontage of 1362 linear feet, the Bum of $184.80, at an approximate ra te per front foot of $0.135683. Maintenance of Parking District No. 301, created by Commission Resolution No. 331, Sixth and Seventh Avenues between Harrison and Cleveland Streets, and on the south side of Harrison Street between Sixth and Seventh Avenues, a total frontage of 1458 linear feet, the sum of $168.73, at an approximate rate per front foot of $0.115886. That to defray the cost of Maintenance of Parkings withln said Special Improvement Districts for the year of 1949, there be and there is hereby levied and assessed a tax upon all the property in front of and bordering on ~ald Special Improvement Districts as set forth in Schedule One to Twenty-One inclusive, hereto attached and made a part hereof; that a perticular description of each lot and parcel of land with the name of the owner and the .sum assessed against him or it, is set forth in the assessment lists hereto att- ached, marked "Schedules One (1) to Twenty-one (21)" and made a part hereof; that the sev. eral sums set opposite the names of the owners and the described lots and parcels of land be.. and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of land described in the said assessment lists, Schedules One (1) to Twenty-one (21) incl- usive, as required by law; that said sums shall be paid and the collection thereof shall be I made in the manner and in accordance with the law governing the collection of Special Imp- rovement taxes; tha t failure to pay such assessments when the same shall become due and pay- able shall make such person and such lots and parcels of land liable to the penalties pro- vided by law relative to delinquent taxes. Section 3. That the regular session of the Co~~ission of the City of Bozeman to be held on the 7th day of September, 1949, at the Commission Chamber, City Hall Building, be, end the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the CommissIon. That the Clerk of the Commission be, and he is hereby, ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper, printed and published in the City of Bozeman, a notice signed by the Clerk of the Commission, and stating that a resol- ution levying a special assessment of taxes to defray the cost of maintenance of parkings in the said Special Improvement Districts for the year 1949, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said I notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for the hearing of objections, and the final adopt- ion of this Resolution. Provisionally passed and adopted by the Commission of the City of Bozeman at a regular meeting of said Commission, August 31st, 1949. NOTICE IS HEREBY GIVEN, that at a regular session of the Connnission of the City of' Bozeman held on the 31st of August, 1949, COMMISSION RESOLUTION NO. 655 was duly passed and adopted; that said Commission Resolution No. 655 levies and assesses a special assess- ment of taxes upon all the property in Special Improvement Districts of said City to de- fray the cost of Maintenance of Parkings within said Special Improvement Districts for the year 1949.
