Which Commission Resolutions Nos. 639 and 64.2, passed as aforesaid, are hereby referred to and made a piJrt of this resolution for further pErticulars in respect to the boundaries of said district, the character of the improvements to be constructed ther~in, the es- time ted cost of said improvements and the method of assessin€! the cost against the prop- I erty within said district; and WHEHEAS, said improvements as contemplated in said Commission Resolutions Nos. h39 and 6L+2 have been cons truc ted and completed in accordance with the terms and condi t ions of Commiss:iJm Resolutions Nos. 639 and 6Lj2, ~nd the total cost of said improve~ents so cms truc ted is the sum of Twe:1ty Thousand Seven Hundred Nineteen Dollars and Forty-seven Cents, ($20,719.47). Iv1., 1935 and amendments thereto, BE IT RESOLTED AIm 1'1' IS Hi~~EBY ORDSmm 3Y THE COhnUS::'ION OF 'I'HS CITY OF B07,"Sl'/fA::1. STATE OF MONTANA; Section 1. That to defray the cost and expense of constructing and making the im- ;Jrovements 1~ said Special Improvement District No. 353, there be, and there is hersby levied and assessed a tax amounting to the a'um of Twenty ThousHnd Seven Hundred Nineteen Dollars and 47/100, ($;20,719.47) upon all the property in said Special I:nprovellent Dis- trict No. .353, that a p~rticular description of each lot and parcel of land with the na:ne of the owner and the stun assessed agatnst him or it for such Lllprovements and the 811 ount I of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list here~o attached, merked Schedule "A", and made a Dart hereof; that the severnl 168 described in said assessment list, Schedule "A", as required by Inw; that the payment of said sums shall be m.'1de in twenty installmerrts and the payment of said installments 3l1a11 extend over 8 pertod of nineteen years; thfJt the payment of the respective annual installments shall be made o~ or before the 30th day of N.)Vember of each year until payment of all in- stallments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner &nd in accordance with the law I governing the collection of special iiprovement taxes; that fa ilure to pay s lJ.ch ass es s- ments when the same become due and payable shall make such persons and said lots and par- cels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. 'rhat the regular session of the Commission of 'rhe C1 t~T of 30 zemEn to be held in the Commission Chamber in the City Hall of seld City on the 8th day of February, 1950 , at 1:00 o'clock P.M., be, and the same is hereby designated as the tln:e and p1a ce at which objections to the final adoption of this Resolution will be heard by said CommIssion. Section 3. 'rhat the Clerk of the Commission of The City of Bozeman be, aDc he is here- by orderecl and directed to publish in. the Bozeman Daily Chr:mlcle, a daily newspaper print- ed and published in the said City of Bozeman, a notice signed by the Clerl{ of the Commis- sion and stating that a Resolution levying and assess1ng a special asseSSMent of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District N~. 353 Is on file in the office of the Clerk of the Commis- sion subject to inspection for a period of five ( 5) days; that said Notice shall state the tine and place at which objections will be heard by the Co:nmissi:Jn to the final adop- tion of this R0so1ution; that it shall be published at least five ( 5) days bef)re the day I set bv the Commission for the hearing of objections and the final adoption of th~ Reso- l1J.tj'::m. That Wednesday the 3th day of Februarv, IYSO, at 1:00 o'clock P.M., of said day at the regular session of the sald Commissi on of The City of Bozeman, at the Commission Room, in the Ci t,v Hall Building of said Ci ty, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 671, I and the Ie vying of said assessment, and that said ResolutiJn will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 639, declarinc it to be the intention of the Commission to create Special Improvement District No. 353, and Commissbn Resolutio'1.
