WIillREAS, the City Commission of the City of Bozeman, did on the 1st day of September, I 1948, duly and regularly pass Commission Resolution No. 629, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT '1'0 BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVE~~NT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 349 OF rrHE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN (OIL MAT) PAVED SURFACE ON EXISTING GRA VEL BASE AND WHERE NO CURBS NOW EXIST, TO INSTALL CONCRETE CURBS ON WEST COLLEGE STREET BETvVEEN THE WEST LINE OF FOURTH A VENUE SOUTH AND TI-IE EAST LINE OF' EIGHTH A VENUE SOUTH, IN S,tI,ID CITY, and thereafter, after due and legal proceedings had, the Commission of the City of Bozeman did on the 22nd day of September, 1948, duly pass Commission Resolution No. 634, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMP- ROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 349 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN (OIL MAT) PAVED SURFACE ON EXISTING GRAVEL BASE AND WHERE NO CURBS NOW EXIST, TO INSTALL CONCRETE CURBS ON WEST COLI,EGE STREET BETWEEN THE VmST LINE OF FOURTH A VE1'1JE SOUTH At.m THE EAST LINE OF EIGHTH AVENUE SOUTH, IN SAID CITY, which Commission Resolutions Nos. 629 and 634, passed as aforesaid, are hereby referred to and made a part of this resolution for further particulars in respect to the boundar- ies of said dis trict, the charac ter of the improvemen ts to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 629 I and 634 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 629 and 634, and the total cost of said improvements so constructed is the sum of Eight Thousand Six Hundred Forty-Nine and 89/100ths Dollars ($8,649.89). NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C.M., 1935, and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. Tbat to defray the cost and expense of constructing and making the improvements in said Special Improvement District No. 349, there be, and there is hereby levied and assessed a tax amounting to the sum of Eight Thousand Six Hundred Forty-Nine and 89/100ths Dollars ($8,649.89) upon all the property in said Special Improvement District No. 349, that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and I made a part hereof; that the several sums set o"posite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against se.id described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; tha t the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "A", as required by law; tha t the pa ymen t of said sums shall be made in ten installments and the payment of said installments shall extend over a period of nine years; that the payment of the respective annual install- ----- ----...- 151 ments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the SRme become due and payable shall make such persons and said lots I and parcels of land liable to the penalties provided by law relative to delinquent taxes. Sec tion 2. That the regular, session of the Co~ission of the City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 19th day of October, 1949, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Com- mission. Section 3. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Dally Chronicle, a daily newspaper printed and published in the sRid City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 349, is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the day set by the C0mmission for the hearing of objections and the final adoption of this I Resolu tion. Provisionally passed and adopted by the Commission of the City of Bozeman at a reg- ular session thereof held on the 13th day of October, 1949. Attest: c?~ g~/ ~~~ C erk of the Commission Mayor NOTICE ------ HEARING, FINAL ADOPTION OF RESOLUTION NO. 664, LEVYING ASSESSMENT SPECIAL IMPROVE- MBNT DISTRICT NO. 349, CITY OF BOZEMAN, STREET IMPROVEMENTS ON WEST COLLEGE STREET BET'NEEN THE WEST LurE OF FOURTH A VENUE SOUTH AND THE EAST LINE OF EIGHTH A VENUE SO. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman, held on the 13th day of October, 1949, Commission Resolution No. 664 was pro- I visionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 349 in said City, to defray the- cost and expense of constructing and making the improvements within said District, to-wit: Beginning at a point on the east property line of Block 2, Capital Hill Addition, said point being 165 feet south of the N.E. corner of said Block 2; thence west on a line parallel with and 165 feet south of the north property line of Blocks 2, 3, 4, and 5, Capital Hill Addition, to the west property line of Block 5; thence north along the west line of Block 5, Capital Hill Addition and Block 49, Park Addition, to a point on the west line of said Block 49,177.75 feet north of the S,W. corner of said Block 49; thence east on a line through the center of Blocks 49, 48, 47, and 46, Park Addi tion, to a point on the east line of Block 46, said point being 175.4 Resolution No. 664 - Page 2 -... .----.-.-.---- .-...-. .-. .- 152 feet north of the S.E. corner of said Block 46; thence south alon~ the east line of said Block 46 and Block 2, Capital Hill A~dition, to point of beg nning. Tha t, said Commission Resolution No. 664 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five days by any persons inter- es ted. That Wednesday, the 19th day of October, 1949, at 1:00 o'clock P.M. of said day, at the regular session of the said Commission of the City of Bozeman, at the Commission I Room in the City Hall Building of said City, has been designated as the time and pIa ce when and where said Commission will hear and ~ss upon any and all objections that may be made to the final passage and adoption of said Resolution No. 664, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 629, declaring it to be the intention of the Commission to create Special Improvement District No. 349, and Commission Resolution No. 634, creating Special Improvement District No. 349, for constructing and making the improvements therein.
