ING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DIST- RICT NO. 347 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVE... MENT DISTRICT NO. 347. WHEREAS, the City Commission of the City of Bozeman, did on the 28th day of April, I 1948, duly and regularly pass Commission Resolution No. 621, entitled: A RESOLUTION OF THE CITY COMMISSION OF ~1E CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NO. 347" FOR THE PURPOSE OF CONSTR1JCTING AND INSTALLING WATER MAINS IN N. 4TH AVENUE AND NORTH 5TH AVENUE FROM VILLARD STREET TO DURSTON ROAD, IN VILLARD STREET FROM 4TH AVENUE TO 5TH AVENUE AND IN DURSTON ROAD FROM 3RD AVENUE TO 5TH AVENUE, AND TO SPECIALLY ASSESS THE COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF SAID SPECIAL IMPROVEMENT DISTRICT SO CREATED, ON A FRONTAGE BASIS, PURSUANT TO THE STATIJTES IN SUCH CASES MADE AND PROVIDED. and thereafter, after due and legal proceedings had, the Commission of the City of Bozeman did on the 2nd day of June, 1948, duly pass Commission Resolution No. 622, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NO. 347" OF SAID CITY, PURSUANT TO COMMISSION RESOLUTION NO. 621 OF SAID CITY DECLARING THE INTENTION OF SAID COMMISSION TO CREATE SPECIAL IMPROVEMENT DISTRICT NO. 347 FOR THE USES AND PURPOSES SET FORTH AND DETAILED IN SAID COMMISSION RESOLUTION NO. 621 ON FILE IN THE OFFICE OF THE CLERK OF SAID CITY COMMISSION AND OPEN '110 PUBLIC INS... PECTION. which Commission Resolutions Nos. 621 and 622, passed as aforesaid, are hereby referred to and made a part of this Resolution for further particulars in respect to the bound... aries of said district, the character of the improvements to be made and constructed therein, the estimated cost of said improvements, and the method of assessing the cost I against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 621 and 622 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 621 and 622, and the total cost of said improvements so constructed is the sum of Nine Thousand Four Hundred Ninety Dollars and Seventy Cents ($9,490.70). NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C.M. 1935, and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the imp'" rovements in said Special Improvement District No. 347, there be, and there is hereby levied and assessed a tax amounting to the sum of None Thousand Four lliJndred Ninety Dollars and Seventy Cents ($9,490.70) upon all the property in said Special Improvement District No. 347; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each I partial payment to be made and the day when the S9me shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule itA", and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule itA", as required by law,; that the payment of said sums shall be made in ten in- stallments and the payment of said installments shall extend over a period of ten years; --- ..n_ -.-- .....-- 148 that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement ts.xes; the t fa ilure to pa y such assessments when the same shall be- I come due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. That the regular session of the Commission of the City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 19th day of Oct- ober, 1949, at 1:00 o'clock P.M. be, and the same is hereby designated as the time and place a t which objections to the final adoption of this Resolution will be heard by the said Commission. Section 3. Tha t the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 347 is on file in the office of the Clerk of the Commission subject to inspection for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the I day set by the Commission for the hearing of objections and the final adoption of this Resolution. Provisionally passed and adopted by the Commission of the City of Bozeman at a reg- ular session thereof held on the 13th day of October, 1949. TO DURSTON ROAD, VILLARD ST. Ii'ROM 4TH TO 5TH A VENUES, AND IN DURSTON ROAD FROM 3RD TO 5TH AVENUES, NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman, held on the 13th day of' October, 1949, Commission Resolution No. 663 was duly I passed and adopted; that said Commission Resolution levies and assesses a ~pecial assess- ment of taxes upon all the property in Special Improvement District No. 347 in said City, to defray the cost and expense of constructing and making the improvements within said Dls trict, to-wit: Beginning at the point of intersection of the center line of the alley between 5th Ave. and 6th Ave. and the center line of West Villard St.; thence east along the center line of W. Villard St. to the center line of N. 5th Ave.; thence south along the center line of N. 5th Ave. to the center line of the alley between W. Beall St. and W. Villard St.; thence east along the center line of said alley to the projected Resolution No. 663 - Page 2 149 east line of Block 5 of Karp's Addition; thence north along a line coinciding with the east line of Block 5, Block 4, and Block 1, Karp's Addition to a point on the south line of the S.E.t of Section 1, T. 1 South of Range 5 East, 286 feet west of the S.E. corner of said Section; thence north 166.5 ft.; thence west on a line parallel with the south line of Durston Road to the east line of 5th Ave. extended; thence south 162.5 feet to a point on the south line of the S.E.! of Section 1 T. 1 South of Range 5 East, 722.5 feet 'west of the S.E. corner of said Section 1; thence south to the northwest corner of Block 2, Karp's Addition; thence west along the I north line of said Block 2 extended and along the north line of Block 1 of the Violett Addition to the center line of the alley between 5th Ave. and 6th Ave.; thence south along the center line of sa id alley to the point of beginning on Villard Street. That, said Commission Resolution No. 663 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons in teres ted. That Wednesday, the 19th day of October, 1949, at 1:00 o'clock P.M. of said day, at the regular session of said Commission of the City of Bozeman, at the Commission Room in the City Hall Building of said City, has been designated as the time and place when and where the said Commi$sion wtll hear and pass upon any and all obJections that may be made to the final passage and adoption of said Resolution No. 663, and the levy- ing of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 621, declaring it to be the intention of the Commission to create Special Improvement District No. 347, and Commission Resolution No. 622, creating Special Improvement District No. 347, for con- structing and making the improvements therein.
