A RESOLUTION OF TEE COMMISSIJN OF THE CITY OF BOZEMAN
EXTENDING THE
BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TOEMBRACE
AND INCLUDE
A TRACT OF LAND CONTIGUOUS TO TFE SAID CITY OF BOZEMAN
AND HEREIN
MORE PARTICULARLY DESCRIBED WITHIN THE CORPORATE LIMITS
THEREOF, AND
DESIGNATING AND ZONTNG SAID TRACT OF LAND AS A PAR'l'
OF THE "B"
RESIDENCE DISTRICT.

WHEREAS, therehas been presented to the City Commission
of the City of Bozeman
!
a request petitioning the said City Commission
to extend the boundaries of
the City of Bozeman so as to include a certain
contiguous tract of land
within the boundaries of the City of Bozeman; and
WHEREAS, the said request also petitions the City Commission
of the City of
Bozeman to designate and zone said contiguous tract as a "B" Residence
District; and
WHEREAS, said request has been duly executed by Paul
K.Dudley and Bennett
Realty Co., a Montana Corporation, the reputed
owners of said contiguous
tract; and
WHEREAS, the proper legal description of said contiguous
tract is as follows:
Beginning at a point on the north line of said Section
18, T. 2S. R6 East,
1326 feet East gf the Northwest corner of said Section
18, T2S, R6E;
thence North 88 26' East along the Segtion Line 266.7
feet to the East
Line of Black Avenure; thence South 0 29' East along
the East line of
Black Avenue 583.5 feet; thence South 8902' West 437.6
feet to the
East line of Tracy Aveneue; thence North 0054' West
along the East
line of Tracy Avenue 180 feet; thence North 8902' East
along the
center line of Harrison Street, 167 feet; thence North
0054' West
along the West line of the alley between Tracy Avenue
and Black

Avenue, 396.2 feet to the point of beginning; and
WHEREAS,
the City Commission of the said City of Bozeman has, by its Resolution
No. 676,
regularly passed and adopted on the loth day of May, A.D. 1950,
declared it to be to the best interests of the said City of Bozeman and the
inha bi tan ts thereof and of the inhabitants of the contiguous
tract here-
inbefore described that the boundaries of the said City of Bozeman be extended
so as to include sa id. con tiguous
tract and that said contiguous tract be
designated and Zoned as a part of "B" Residence District; and
WHEREAS, the Clerk of the City Commission has, pursuant
to the provisions of
Section 11-403, Subsection 2, Revised Codes of Montana, 1947, given the
requiered notice to property owners and caused to be published the required
public notice of such proposed extension of the boundaries of the said City
of Bozeman; and
WHEREAS, twenty (20) days have expired since the date
of the first publica tion
of said notice and no expressions of disapproval of the proposed extension
of the boundaries of the said City of Bozeman have been received.

NOW,
THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF BOZEMAN:

Section 1.
That pursuant to t1~e authority vested in the City Commission
of the City of Bozeman by Section 11-403, Subsection 2, Revised Codes of
Montana, 1047,
it is hereby declared tha t the boundaries of the said Ci ty
of Bozeman shall be extended so as to embrace and include within the
boundaries and corporate limits of the said City of Bozeman tbe tract
contiguous thereto and hereinbefore described.

Sec tion 2.
That said contiguous tra c t be,
and the same is herby designated
and zoned as a part of the "B~ Residence District.
Sec tion 3.
Tha t this Pesoln tion shall be,
and the same is hereby declared
to be effective as of the date of its passage and adoption.
Passed and adopted by the Commission of the City of Bozeman at a regular
session held on the 7th day of June,
A.D. 1950.
