Whereas: The City
Commission of the City of Bozeman, Montana, on the 19th
de y of April, 1950, passed and adopted Commission Resolution
No. 675 declaring
it to be the intention of said Commission to create Special Improvement Lighting
District No. 362 of said City for the purpose of purchasing and maintaining
a lighting system to light Main Street from the west line of Fourth Avenue
projected to the west line of the intersection of West Main Street and South
Eighth Avenue, which said Resolution, of record and
on file in the office of
the Clerk of said Ci t~T Commission and open to the inspec:'bl:on of the public,
is hereby referred to for further particulars; and
Whereas:
Due proof hAS been made that service of notice of the adoption
of said Resoh1tion No. 675 WAS duly made and given as by law provided; and
Whereas:
At the time and place fix~d in said Resolution No. 675 for the
making and filing of protests against the creation of said propsed Special
Improvement Lighting District No. 362,
to-wit, at the hour of 1:00 o'Clock

P.M. on Wednesday, the lOth day of May, A.D. 1950,
being a regular meeting

Chamber in the C1 ty Hall
building of the City of Bozeman, no protests were
made or filed against the
creation 0f said Special Improvement Ligbting District No. 362; NOW,

BE IT RESOL\'ED BY THE COMWISSION OF THB CITY OF BOZEMAN:
Section 1
CrGs tion and Purpose
That there be, and tbere is hereby created a special improvement
district
of the City of Bozeman to be known and designated as
Special Improvement
Lighting District No. 362, for the purpose of purchasing and maintaining
a liehting system to light Main Street from the west line of Fourth Avenue
projected to the west line of the intersection of 'jVest Main Street and South
Eighth Avenue, pursuant to and in conformity with Commission Resolution No.
675 of the Commission of the Ci ty of Bozerrr.an, passed and adopted on the 19th
da y of April, 1950, which said Commission Resolution No.
675 declares it to
be the intention o.f' said City Commission to Create said Special
Improvement

Pa ymen t
Payment of fifty (50%) per cent of

all inclder;tal expenses and all interest on deferred payments,
shall be made
in eight (8 )
annual installments, and the
asse~sment thereof shall be made
against the property wi thin
said district as provided by law.
This provision
shall not, however, be construed to prevent
full payment at any ti'11e. Payment
of the remaining fifty (50%) per cent of
such cost shall be made by the City

of Bozeman, as by law provided.
Payment of fifty (50%)
per cent of the annual
cost of maintenance shall be ascertained, made
and assessed against said pro-
perty in
the same manner,
the City of Bozeman paying the remaining fifty (50%)
per cent of said cost of maintenance in the manner and as by law provided.

Payment in Bonds or Warrants
All Costs and expenses in the purchase
of the improvement in Special
LightingLighting District No. 362 hereby created,
including all expense connected
wi th end inc iden ta 1 to the forma ti on of sa id dis tric t,
the cost of printing
and advertising, and
the preparation of assessment rolls,
shall be paid for
by special improvemen district coupon bonds 0r warrants,
to be drawn against
a fund to be known as "Special ImprovemeDt Light:ing District No. 362 Fund".
Said bonds or warrants shall be jn the denomination of one hundred dollars
($100.00) or fractions or multiples
thereof, and may be issued in installments.
Such bonds or warrants shall bear interest at the rate of not to exceed six (6%)
per cent per annum from the date of thetr reg~stI'ation
until called for

redemption or paid in full 9.I'd the interest shall be payable annually on
the
first day eaob year after such registration as
expressed by the interest coupons
attached thereto. Such warrants or bonds shall
be redeemed by the Director
of Finance of the City of Bozeman when there is money in said Special Improve-
ment Ll~~ting District No,
362 Fund available for such payment.
Section 8
Sale of Bonds
That pursuant to the provisions of and authority conferred by Section
11-2232 Revised Codes of MonteI'a,
1947, said bonds may be sold
to
the highest
and best blddger therefor for cash,
for not less than
the face value of such bonds
or warran ts, and including interest thereon,
and the proceeds of such sale
used in purchasing saId lighting system.
