WHEREAS; 'rhere has been filed wi th theClerk of the Commission of theCi ty of Bozemm, Montana, a petition in due form of certain property owners on Main street, East and West, of Bozeman, Montana, between North Broadway Avenue and Fourth Avenue projected, a s king that a special improvement lighting district be created for the purpose of installing and maintaininc a lightinp; system to light Main Street, East and West, from North Broadway Avenue to the li~le of Fourth Avenue projected, and discontinuing Special Light- ing District No. 100 of the City of Bozeman; and W'1EREAS: At a. regular meeting of the C1 ty Commission of the City of 130 zeman held the 15th day of March, 1950, the aforesaid petition was respectively considered and granted. NOW, 'rHEPEF'ORE, BE IT RESOLVED BY 'rHE CI'rY COMMISSIOt'T OF' THE Crry OF BOZEMAN: sectio"l 1. DELCARATION OF INTENTION. That it is hereby declared to be the inten- tion of The City of Bo zeman to create a special improvement distrtct to be known and designated as Special Improvement Lighting District Number 361 of The City of Bozeman I for the purpose of installing and maintaining a lighting system to light Main Street, east and west, between North Broadway Avenue and Fourth Avenue projected in said city. Section 2. BOUNDARIES. The boundaries of said proposed Special ImC)rovement Dis- trict No. 301 are described as follows: Beginning at a point on the east line of Block C Rouse's Addition 100 feet south of the south line of East Main Street THENCE west along a line 100 feet south of a"ld parallel wi th the south 1 ine of Main Street to a point 6 feet west of the eastline of Lot 7 Block D Story's Addition; THENCE north across West Main Street to 8 point 100 feet north of the north line of West Main Street and 13 feet west of the east line of Lot 8 Block D Tracy's Addition; THENCE east along a line 100 feet north of and parallel with the north line of Main Street to the east line of Block D Rouse's Addition; rrH8~NCE south across East Main Street to the point of beginning. Section 3. CHARACTER OF IMPROVEMENTS. The character of the improve~ent to be made in said special Improvement Lighting District No. 361 1s the erection, maintenance and operation of forty-five (h5) ornamental lamp posts with electric lamps, wires, pipe cO"lduits to carry the electric current therefor, and all othS'r suitable or necessary appliances for the purpose of lighting said street. Section Lj. ESTIMATE OF COST AND MET10D OF ASSESS~ENT. The preliminary estimate of the cost of installation of the lights and other material necessary to make the said I "improvement within said Special Improvement Light:irrg Di strict No. 361 is 'rwo Hundred Seventy-five and no/lOO ($275.00) per unit, or a total of Twelve 'rhousand 'rhree Hundred Seventy-fvie and nO/lOa ($12,375.00) Dollars, of which s urn fifty (50~G) per cent is to be assessed a [:':ains t the property embraced wi thin said District on a front foot basis and fifty (50~~) percent is to be paid by the City of Boze~Dn, the estim8ted rate of assessment per front foot Bgains t the property embraced wi th'Ln the sa i d Dis tric t being $,0.91113 per front foot. 177 Section S. An esti:TIBte of the approximate cost of ma1.ntaining such lights and supplying elec- trical current therefor for the first yeEr is the sum of One 'rhousandEight Hundred 'rhirty- three and 00/100 ($:1,833.60) Dol:Brs, of which total sum fifty (SO%) Der cent is to be Assessed against the property embraced within said District on a front foot basis, and I fifty (SO/G) oar cent to be paid by the City of Boze~Dn, the estimated rate of assess- ment per year per front foot against the property embraced within said District being $0.133 per front foot. Section 6. ACTUAL FRONTAGE OF DIS'rRICrf. The total actual front8~e of the property within said proposed Special Improve::1Ont Lighting Dl;trid; Jo. )61 is 6,705.4 front feet, wrd.ch is the frontage on which all protests will be received, considered Bnd determined. The total acutal frontage of the property within said proposed Special Improvement Lighting District No. 361 is 6,78S.L front feet. pa.vment for the improvements to be made in this District is to be made in eight ( 3) ann U8 1 installments wi t.h interest on the deferred payments not to exceed six ( 6~b) per cent per annwn, payable a.nnually, but this shall not be construed to) prevent payment in full at any regular payment date by any property owner.
