There has been filed with the Clerk of the CIty Commbsion of 'rheCity of
Bozeman, ~ontana,
a petition in due form of certain property owners on North Black Avenue
between Mendenhall
Bnd Peach Streets asking that a Special Improvement District be created
for the purpose of constructing concrete curbs and storm sewers,
and bitl..unlnous paverrant
on said streets; and
WQEREAS:
That a regular meeting of the City Commission of the City of Bozeman held
on the 1st day of February, 1950,
the aforesaid petitioll was respectively considered and
granted; Now,
THEREF'ORE,

Section l.
DECLARATIOS OF INTENTION.
That it 1s hergby declared to be the intention
of The City of Bozeman to create a Speclal
Improvement District to be known and designated
as Special Imcrovement District No. 360
of The City of Bozeman for the purpose of con-
structing and installing a storm sewer, concrete
curbs and bi tuminous pHvement 0>1 NCJrth
31ack Avenue between Mendenhall and Peach Streets in said city.
Section 2.
BO UND/lRIES. 'rhe boundaries of sai

No. 360 are described as follows:

Beginning at a point on the north line of East Mendenhall Street,
150
feet west of
the west line of North Black Avenue;
THENCE north along a
line 150 feet west
of and parallel with the west line of North Slack
Avenue to the south
line of East Villa I'd street; THENCE northerly across
East Villard Street
to the intersection of the north line of East Vl1~rd
Street and the center line of the alley betwee'1 North Black Avenue and
North Tracy Avenue; THENCE north along the cneter line of said Alley to
the south line of East Peach Street;
THENCE eest along the south
line of
East Peach Street to a point 150 feet east of the east line of North
Black Avenue; THENCE south along a line 150 feet east of and parallel to
the east line of North Black Avenue to the north line of Best Mendenhall
Street; THENCE west along the north line of East Mendenhall Street to the

Section 3.
CHARAc'rER OF IMPROVEM3N'rS.
The character of the improvements to be
made within said Special Improvement District
No. 360 is:
The cJnstruction of a storm
sewer, concrete curb and pavement consisting of a h inch
gravel base, a 3 inch Road mix
Bituminous Mat and Seal with Chips, on
North Black Avenue between Mendenhall and Peach
Streets in Bo~eman, Montana.
Section I~.
ESTIMATE OF COST. The preliminary
estimate of the c6st of said improve-
ments, including storm sewer,
excavating, cur
bs, base,
pa vement, engineering and incidentals
Is Thirty Seven 'fhousand Four Hundred Nine and nO/lOO
($37,Lo9.00) Dollars.
Section 5.
ME'rfIOD OF ASSESSMENT. The preliminary
estimate of cost set forth above

is to be assessed agaInst the property within said District
on an area basis as follows:

mediately adjacent
to the proposed improvement to be assessed at double the
assessment against other property in the District.
The assessable area of
property in the District, with 25 feet next adjacent

is 533,678 square feet and the estinated rate of assessment if $0.07 per square

Section 7.
PAYMEN'rS. That payments for said improvements
shall be made in twenty
( 20)
annual installments extending over a period of nineteen (19)
years, but this shall
not be construed to prevent payment in full at any regular payment date by any property
owner who desires
to do so. It is proposed
to pay the entire cost and expense of the
construction and installation of said improvements with CBse to
be obtained from the

sale of bonds of said Special Improvement District No.
360,
as authorized by law.
Such
bonds will be in denominations of $100.00 each and fractions of $laO.OO where necessary,
to be issued and chargeable against a f1md to be known and designated as Special Im-
provement District No.
ySo Fund of 'rhe City of Bozeman.
The bonds will be redeemable
at
the option of the City, singly or in multiples,
and in the order of their regustration,
whenever funds are available for that purpose in said Special Improvement District No.
360.
Said bonds shall draw a simple interest from the
dEJte of their registration until
called for payment,
at a rate not exceeding six (6%)
per cent per annlL~, which interest
shall be chargeable as a part of the cost of the construction and installation of said
improvement.
The bonds will be issued and sold in accordance with the provisions of
Section 11-2232 and Section 11-2271, Revised Codes of Montana,
1947,
and all other appli-
cable provisions of Title 11 of the Revised Codes of Montana,
1947, relating to special
improvement districts in cities
an d towns,
and any a,nendments thereof or thereto.
Section 8.
PROTESTS AND NOTICE. That the regular
session of the City Commission
of The City of Bozeman,
to be held at the Commission Chamber,
City Hall Building, Bozeman,
Montana,
on Wednesday, the 15th day of March,
1950,
at the hour of one o'clock P.M.

upon all protests duly and regularly made and filed against the creation of said
proposed Special Improvement District No.
360,
the improvement proposed to be made
pursuant thereto and the extent and character thereof,
or either thereof;

directed to give notice in the manner and
for the tlne as by law req'.drc3d,
of the adoption of this Resolution of Intention.
Adopted by the Commission of The City of Bozeman, Montana,
at a regular and stated

An approximate and preliminary estimate of the cost of doing such work and making
such improvement within said District,
including all sotrm sewer, excavatIng,
curbs,
base, pavement,
engineering and incidentals,
