HomeMy WebLinkAboutResolution 692 Taxes for SID 362 233 COMM"ISSION Rfi;SOLUTION NO. 692 A RESOLTTTIJN OF THE COlVfl\'ISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SOECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL HftPROVEMENT DTSTRICT NO. 362 IN THe;; CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IM- PROVE~ffiNT DISTRICT NO. 362 WHEREAS, the City Commission of The City of Bozeman, did on the 19th I day of April 1950, duly and regularly pass Commission Resolution No. 675, en ti tIed: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE TIm INTENTION OF SAID COMMISSION TO CREATE SPECIAL IMPFOVEM4~NT LIGHTING DISTRICT NO. 362 FOR THE PURPOSE OF PURCHASING A1~ MAINTAINING A LIG}~ING SYSTEM TO LIGHT MAIN STREET FORM THE VffiST LINE OF FOURTH A VENUE PROJECTED TO THE WEST LINE OF TqE INTI~RSECTION JF WEST MAIN STREET AND SOUTH EIGHTH AVENUE: DESCRIBING THE BOUNDARIES OF SAID DISTRICT: THE GENERAL CHARACTER OF THE IMPROVEMENT TO BE MADE; SETTING FORTH ESTIMATED COSTS OF PURCHASING AND COST OF MAINTAINING ST}CH LIGHTS AND sup- PLYING ELECTRICAL CURRERT THEREFOR FOR THE FIRST YEAR; AND DE'I'ER- MINING THAT ONE-HALF OF THE COST OF PURCHASING SAID LIGHTS AND ONE- HALF OF THE ANNUAL COST OF MAINTENANCE SHALL BE ASSESSED AGAINST THE PROPERTY WITHIN THE DISTRICT A}ID THAT ONE-HALF OF THE COST OF PURCH- ASING SAID LIGHTS AND ONE-HALF OF THE COST OF ANNUAL MAINTENANCE OF THE SYSTEM SHALL BE FA ID FOR OUT OF THE GENERAL FUND OF THE CI TY OF BOZEMAN, ALL UNDER THE AUTHORITY OF AND IN CONFORMITY WITP SECTIONS 11-2245 TO 11-2257 INCLUSIVE, OF THE REVISED CODES OF MONTANA 1947. and thereafter, after due and legal proceedings had, the Commission of the City of Bozeman did on the 17th day of May, 1950, duly pass Commission Resolution No. 678, entitled: A RESOLUTION OF THE CITY COMMISSION 01" THF. CITY OF BOZEMAN, MONTANA, CREA.TING A SPr.;CIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVm!fENT LIGHTING DISTRICT NO. 362 FOR T'::IE PURPOSE OF PURCHASING AND MAINTAINING A LIGHTING SYSTEM TO LIGHT MAIN I STREET FROM TEE ~~ST LINE OF FOURTH AVEIDJE PROJECTED TO THE M~ST LINE OF THE INTERSECTION OF WEST MAIN STREET AND SOUTH EIGHTH AVENUE, PUR- SUM,TT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 675 OF SAID CITY COMl'vnSSION AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 19TH DAY OF APRIL, 1950. which Commission Resolutions Nos. 675 and 578, passed as aforesaid, are hereby referred to and made a part of this resolution for further part- iculars in respect to the boundaries of said district, the character of the improvements to be constructed ther~in, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHER"RAS ,sa id improvemen ts as contempla ted in said Commiss ion Resolu tions Nos. 675 and 678 have been constructed and completed in accordance with the terms and condi tions of Commission Resolutions Nos. 6'15 and 678, and the total cost of said improvements so constructed to be assessed is the sum of Two Thousand One Hundred Fifty One Dollars and Sixty Cents ($2,151.60). NOW, THEREFORE, ~lrsuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C. M., 1935 and amendments thereto, I BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OE<' TPE CITY OF BOZ"'MAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the improvements in said Special Improvemnt District No. 362, there be, and there 1s hereby levied and assessed a tax amounting to the Sl1m of Two Thousand One Hundred Fifty One &60/l00th's Dollars ($2,151.60) upon all the property in said Special Improvement District No. 362, that a particular descriptionof each lot and parcel of land with the name of the owner and the sum assessed against him or tt for such improvements and the amount of each -.-..- 234 partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule tI A It, and made a part hereof; that the several sums set opposite the names , of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and aginst said described lots and parcels of land to defray the cost and expense of constructing and I making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "A", as required by law; that the payment of said sums shall be made in eV'rht installments and the payment of said installments shall extend over a period of seven years; that the payment of the respective annual installmetns shall be made on or before the 30th day of' November of each year until payment of all install- men ts together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accord- ance with the law governing the collection of special improvement taxes; that fa ilure to pay such assessments when the same become due and payable sha 11 make such persons and said lots and parcels of land Liable to the penalties provided by law relative to delinauent taxes. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and s ta ting tha t a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and makin~ the improvements in the said Special Improvement Dis tric t No. 362 is on file in the office of the Clerk of the Commission sub3ect to inspection for a period of five (5 ) da ys ; that said Notice shall state the time and place at which objections will be heard by the Commission to the fina 1 adoption 0 f this Resolu tion; that it shall be published at least five (5 ) days before the day set by the Commission for the hearing of ob.1ections and the final adoption of this Resolution. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman, held on the 18th day of October, 19 50 , Commission Resolu tion No. 692 wa s duly passed and adopted; that said Commission Resolution levies And assesses a special assessment of taxes upon all the property in Special Improvement Lighting District No. 362 in said City, to defray one-half the cas t and expense of cons true ting and making the improve- ments within said District, to-wit: I Beginning a t a poin t in 10 t 7 Block D. Story's Addi tion 100 fee t sou th of the south Line of West main Street and 6 feet west of the east line of said lot 7 thence west along a line lUu feet south of and parallel with the south line of West Main street to the west line of South Eighth Avenue; thence north across West Main Street to a point in Lot 11 Block 2 Springbrook Addition 100 feet north of the north line of West Main Street and 15 feet west of the east line of said Lot 11; thence east along a line lOa feet north of and parallel wi th the north line of West Main Street to a po~nt 15 feet east of the west line of Lot 8 Block D Tracy's Addition: thence south across West Main Street to the point of beginning.
