WHEREAS, The City Commission of the City of Bozeman, did on the

day of October 1949, duly and regularly pass Commission Resolution No. 660,

and thereafter, after due and legal proceedings had,
the Commission of The
City of Bozeman did on the 3uth day of November,
1949, duly pass Commission
Resolution No. 666, entitled:

ING ANi) INSTALLLIKG A SANITARY SEWER ON NORTH BLACK AVENUE BETWEEN
COTTONWOOD AND TAMARACK STREETS IN S I\ID CITY.
which Commission Resolutions Nos. 66U and 666, passed
as aforesaid, are
hereby referred to and Ir'ade a part of this resolution for further parti-
culars in respect to the boundaries of said district,
the charac ter of the
improvemen ts to be constructed therein,
the estimated cost of said improve-

ments and the method of assessing the cost against the propety within said
district; and
WHEREAS,
said improvements as contemplated in said Commission Resolutions
Nos. 660 and 666 have been constnlcted and oompleted in accordance with the
terms and conditions of Commission Resolutions. Nos. 660 and 666, and the
total cost of said improvements so constructed is the sum of One Thousand
Eight Hundred Eight Dollars and 'l'wel ve Cen ts.
($1,808.12)
NOW, THERFORE, pursuant to the provisions of Sections 5225 to 6277.5
and 5485, R. C. M., 1935 and amendments there to,
BE IT RESOLVED AND 1'1' IS HEREBY ORDERED BY THE COMMISSION OF TIE
CITY OF BOZ~MAN, STATE OF MONTANA:
Section 1. 'The t to defray the cos t and expense of eons truc
ting and
making the improvements in said Special Improvement District No. 359,
there
be, and t~ere is hereby levied and assessed a tax amouhting to the sum of
One Thousand Eight Ifundred Eight Dollars and Twelve Cents ($1,808.12) upon
all the propety in said Special Improvement District No. 359,
tha t a
particular description of each lot and parcel of land with the name of the

owner and the sum assessed against him or it for such improvements and the
amount of each partial payment to be made and
the day when the same shall
be delinquent is set forth in detail in the assessment
list herto attached,
ma rked Schedule "A", and made a part hereof; that
the several sums set
opposite the na~es of the owners and the described lots and parcels of land
be, and the same are hereby respectively levied and assessed upon and
against said described lot s and parcels of land to defray the cost and
expense of constMlcting and making the improvements within said District;

that the several sums so assessed be collected from the respective owners of
said lots and parcels of land described in said assessment list, Schedule
"A", as required by law; that the payment of said sums shall be made in
ten instRllments and the payment of said installments shall extend over a
period of nine years; that the payment of the respective annual install-
ments shall be made on or before the 30th day of November of each year until
payment of all installments together with the interest therAon, shall be I
made; that said sums shall be paid and the collection thereof shall be made
in the manner and in accordance with the law governing the collection of
special improvement taxes; that failure to pay such assessments when the
same become due and payable shall make such persons and said lots and parcels
of land 1 ia ble to the penR 1 ties provided by law re 1a ti ve to de 11nquetl--t
taxes.
Section 2. That the regular session of the Commission of The City
of Bozeman to be he Id in the Commiss ion Chamber in the Ci ty Ha 11 of sa id
City on the 25th day of October, 1950, at 1:00 o'Clock P.M., be, and the same
is hereby designated as the time and place at which objections to the final
adoption of this Resolu tion will be heard by said Commission.
Section 3. That the Clerk of the Commission of The City of Bozemam
be, and he is herebv ordered and directed to publish in the Bozeman Daily
Chronicle, a daily newspaper printed and published in the said City of
Bozeman, a notice signed by the Clerk of the Commission and stating that a
Resolution l.evying and assessing a special asse. ssment of taxes to defray < I
the cos t and expens e of cons truc ting and making the improvemen ts in the
said Special Improvement District No. 359 is on fil.e in the office of The
Clerk of the Commission subject to inspection for a period of five (5) days;
that said Notice shall state the time and place at which objections will
be heard by the Commission to the final adoption of this resolution; that
it shall be published at least five (5) days before the day set by the
Commission for the hearing of objections and the final adoption of this
Resoh:t tion.
Provisionally passed and adopted by the Commission of The City
of Bozeman ar a rep:ular session thereof held on the 18,t7Z 195U.

HEARING, FIT\TAL ADOPTION RESOLUTION NO. 691, LEVYING ASSESSMENT
SPECIAL
IMPROVEY~NT DISTRICT NO. 359, CITY OF BOZEMAN,
SANITARY SEWER NORTH
BLACK AVENUE COTTONWOOD TO TAM.ARACK STREETS.
NO~ICE IS HEREBY GIVEN, that at a regular
session of the Commission
of the City of Bozeman, held on
the 18th day of October,
1950, Commission
Resolution No. 691 was duly passed and adopted;
that said Commission Resolution
levies and assesses a special assessment of taxes upon all
the property in
Special Improve~ent District No. 359 in
said C1 ty, to defray the cost and
expense of constructing and making the improvements within said District,
to-wit:
Beginning at the intersection of
the center line of East Tamarack
I
Street 'and the center line of the alley between North Black Avenue
and North Tracy Avenue;
thence south along the center line of said
alley to the center lin~ of East Cottonwood Street;
thence east
along the center line of East Cottonwood Street
to the center line
of the alley between North Black Avenue and North
Bozeman Avenue;
thence north along the center line of said alley
to the center line
of East Tamarack Street; thence west along
the center line of East
Tamarack s tree t to the poin t of beginning.
Tha t, said Commission Resolution No. 691 is now on file
in the
Office of the Clerk of the Commission,
subject to inspection for a period
of five days by Bny persons in teres ted.
That Wednesday,
the 25th da y of
October, 195U, at 1:00 o'clock P.M.
of said day, at the regular session of
the said Commission of the City of Bozeman,
at the Commission Room in the
City Hall Buildin~ of said City, has been designated as
the time and pIa ce
when and where the said Gommlssion will hear and pass upon
any and all
objections that may be made
to the final passage and adoption of said
Resolution No. 691, and
the levying of said assessment,
and tha t sa id
Resolution will be finally passed and adopted at said regular session.
All persons in teres ted are referred to Commission Resolu tion No. 660
declaring it the intention of the Commission
to create Special Improvement
