HomeMy WebLinkAboutResolution 688 taxes for Garbage Collection 221 COMMISSION RESOLUTION NO. 688 A RESOLUTION OF THE Cm.BHSSION Oft' THE CITY OF BOZEMAN, MONTANA, LEVYING A1TD ASSESSnW A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARGAGE WAS COLLECTED AND REMOVED DURHTG THE YEAR 195U, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN~ I WHEREAS, the C:5ty Commission of the Ci ty of Bozeman did on the 8th day of January, 1940, duly and regularly pass Ordinance No. 696, entitled: ttAN ORDINANCE DEFINING GARBAGE FOR THE FURJ:-'OSE OF THIS ORDINANCE: PROVIDING FOR THE COLLECTION AND DISPOSITION THEREOF BY AND UNDER THE SUPERVISION AND CONTROL OF THE DEPARTMENT OF PUBLIC WELFARE AND FOR DEFRAYING THE COST OF SUCH COLLECTION AND DISPOSITION BY SPECIAL ASSESSMENT AGAHiST THE PHOPERTY TO 'WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE, which Ordinance No. 696, passed as aforesaid is herebr referred to and made a part of this Resolution for further particulars in respeet to the basis and method of assessing the cost against the property herein assessed, and, WHERBAS, saidexpense incur~ed by said City in the collection and disposition of garbage in accordance with said Ordinance Is hereby estimated by the Commission of The City of Bozeman to be the sum of Twenty Two Thousand Seven Hundred Twenty Three Dollars and Twenty Four Cents ($22,723.24), for the year 195U, over and aboveall moneys collected from business and pro- fessional concerns, or combined residence and business, or residence and I professional business concerns 1naccordance with said Ordinance No. 696, and WHEREA S , in order to raise said sum to defray the said cost, it Is necessary to establish the basic unit rate as defined in said Ordinance No. 696 at Eight Dollars ($8.00). NOW, THEREFORE, pursuant to the provisions of said Ordinance No. 696, and the laws of the State of Montana, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA Section 1. That to defray the estimated cost and expense of collecting and disposing of garbage in the City of Bozeman for the year 195U, there is hereby levied and assessed against the property and the several lots, pieces and parcels of land thereof within the City of Bozeman as set forth in SChedule "A", which 1s attached hereto and made a part hereof, a tax; that ~ particular description of each lot and parcel of' land wi th the name of' the owner and/or owners and the Sl1m assessed B.1!ainst the same is set forth in the assessment list in said Schedule "A"; that the several sums set opposite the names of said owners and the described 10 ts and parcels of land, be, and I the same are hereby levied and assessed upon and against said lots and parcels of' land for said purpose; that the several sums be collected from the res- pective owners of said lots and parcels of land described in said assessment lis t and owned b~! them; that said sums shall be paid and the collection thereof be made in the manner and in accordance with Ordinance No. 696 of the City of Bozeman, Montana, and the laws of the State of Montana governing the collection of special improvement taxes; that failure to pay such ass~ss- ment when the same shall become due and payable shall make such person' and 222 such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of the City of Bozeman, Montana, to be held in the Commission Chamber in the City Hall of said C1 ty on the 4th day of October, 195u, at l:uO o'clock P.M. be, and the same is hereby designated as the time and place at which objections to the I final adoption of this Resolution will be heard by said Commission. Sedtion 3. That the Clerk of the Commission of the City of Bozeman Daily Chronicle, a daily newspaper printed and published in said City of Bozeman, a notice signed by the Clerk of the Commission, ata ting tha t a resolution levyin~ and assessing a special assessment of taxes to defray the cost and expense of the collection and disposition of garbage in the City of Bozeman for the year 1950, against the property to which such service was rendered, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said Notice shall sta te the time and place a t which objections will be heard by the Commission to the final adoption of this Resolution; and that said Notice shall be published at least five days before the day set by the Commission for hearing of objections and the final adoption of this Resobltion. Provisionally passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on the 27th 1950 . Attest. NOTICE 2ZJ HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 688, LEVYING SPECIAL ASSESSMENT TO DEFRAY THE COST OF THE COLLECTION AND DISPOSITION OF GARBAGE FOR TirE YEAR 1950, AGAINST ALL PROPERTY IN THE CITY OF BOZEMAN TO WHICH SUCH SERVICE WAS RENDERED. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of I the City of Bozeman held on the 27th day of September, 195U, Commission Resolution No. 688 was provisionally passed and adopted; that said Resolution levies and assesses a special assessment of taxes to defray the cost of colledtion and disposition of gar~age in the City of Bozeman, for the year 1950, upon all property to which such service was rendered. That said Commission Resolution No. 6ee 1s now on file in the office of the Clerk of the Commission of the City of Bozeman, subject to inspection of all persons interested, for a period of five days; tha t Wednesda y, the 4th day of October, 1950, at 1:00 o'clock P.M. of said day at a regular session of the Commies ion of the City of Bozeman, in the Commission Room, in the Ci ty Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission Resolution No. 688 and levying of said assessment; and that said Resolution will be finally passed and adopted at said regular session of said Commission, sub j ec t to such corrections and amendments that may be made upon objections made and I filed with the Clerk of the Commission within the five days limit as pro- vided by law.
