Whereas:
The City Commission of the City of Bozeman, Montana,
on the .1
18th day of October,
195u, passed and
adopted Commission Resoh;tion No. 696
declaring it to be the intention of slid Commission
to create Special
Improvement District No. 364 of said City for the purpose of constructing
and installing a six inch water main on Twelfth Avenue South from West Koch
Street to West Curtiss Street in
the City of Bozeman,
Montana,' which said
Resolu tion,
of record and on file in the office of the Clerk of said City
Commis s ion and open to the inspec tion of the public,
is hereby referred
to
for further particulars; and
Whereas:
Due proof has been made that service
of notice of the adoption
of said Resolution No.
696 wes duly made and given as by law provided; and
Whereas:
A~ the ti~e and place fixed in said Resolution No.696 for
the making and filing of protests against the creati~n of said proposed
Special Improve~ent District No. 364,
to wit, at the hour of 1:00 o'clock P.M.
on Wedne sda y,
the 8th day of November, A.D.
1950, being a regular meeting
time of said City Commission, at the Commission Chamber in
the City Hall
building of the Ci ty of Bozeman,
no protests were made or filed against

the creation of said Special Improvement District No. 364; NOW,
THEREFORE
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Sec tion 1
That said Special Improvement District No. 364 of The City of Bozeman,
State of Montana,
be and the same is hereby
created for the purpose of making
the improvements as
in said Resolution of Intention No. 696 and hereinafter
described;

That said special iFprovements be,
and the
same are, hereby ordered to
be made in said Special Improvement District No. 364,
as follows:
THE CONSTRUCTION OF A SIX INCH WATER MAIN ON TWELFTH AVENUE SOUTH
FROM VVEST KOCH STREET TO WEST CURTISS STREET IN SAID CITY OF BOZEMAN,
MONTANA
Section 3
That the entire cost and expense of making the special i".,provement herein
referred to in said Special Improvement District No. 364 shall be paid by
Special Improvement District Coupon Bonds,
as authorized by the laws of the

State of Montana,
which bonds sba 11 be in the denomina tion of One Hl'ndred
($100.00)
Dollars each, and fractions
thereof where necessary,
to be issued
and chargeable aga in s t a fund to be known as" Specia I ImprovelTTen t Dis tric t
No. 364 Fund",
said bonds to be redeemable at the
option of The City of
Bozeman, ~ontana, whenever funds are avaiiable for that purpose from said
Special Improvement District No. 364 Fund;
said bonds shall draw simple
interest at a rate not to exceed six (6fa)
per cent per annum, which shall be
chargeable as apart of the cost of said improvements and shall run from the

date of the registration of said bonds until said bonds are paid.
To pay
said bonds, and the interest thereon,
repressnting the cost of said improve-
men t, a special assessment shall be levied aITainst all
of the lands within
Special Improvement District No. 364
as in said Resolution of Intention
No. 696 defined,
each lot or parcel of land within said District to be
I,
assessed for the portion of the whole cost in the proportion that the area
of each said lot or parcel of land bears to the
area of the entire
District,
exclusive of streets,
a venues,
alleys or public places.
Section 4
SRid Assessment and taxes shall be payable in ten
(IU)
annual ins tall-
ments extending over a period of nine
(9) ye a r s ,
with tnterest on deferred
payments; but this provision shall not be construed to prevent full payment
a t any time.
Section 5
Tha t tlle Ci ty Engineer be,
and he is hereby, directed to prepare plans
and specifications for the doing of said work and the making of said improve-
ments.
Sec tion 6
Tha t pursuar. t to the provis ions of, and au t'lori ty conferred
by See tion
11-2232, Revised Codes of Montana,
1947,
said bonds may be sold to the high-
est and best bidder therefor for cash, and the proceeds of such sale used

in making payment to the Contractor,
or Con tra c tors, for such work,
and such
payment may be made either,
from time to time,
on estimates made by the
engineer in charge of such improvements for the
City, or upon
the entire
cOTpletion of the improvements and the acceptance thereof by the City
C0111mission.
Section 7
That the Clerk of
the City Commission of The Clty of ,Bozeman, be,
and
is hereby, direc tad to publish a no tice invi ting proposals for the furnish-
ing of material and the doing of the
work and the making of said Improvement
in said Special Improvement District No. 364, which notice shall refer to
tb,e plans and specifications on file, by publishing slJch notice in two

issues of the Bozeman Daily Chronicle, a
daily newspaper printed and pub-
lished in The City of Bozeman, not less
than ten(lU)

time such
bids will be opened, which shall be at a meeting of
the City Commission to
be held on Wednesday,
the 29th day of Noverneer,
1950, at one o'clock P.M.
of said day.
