AN;) ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN
SPECIAL IMFROVY;1IrENT DISTRICT NO. 361 IN TIm CITY OF BOZEMAN,

WHEREAS, The City Commission of The City of Bozeman, did on the 19th day
of April 1950, duly and regularly pass Comm~ssion Resolution No. 674, entitled:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLAR-
ING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE SPECIAL IMPROVE-
MENT LIGHTING DISTRICT NO. 361 FOR THE PURPOSE OF INSTALLING AND MAIN-
TAINING AN LIGHTING SYSTEM TO LIGHT MAIN STREET EAST AND WEST, FROM
NORTH BROADWAY AVENUE TO THE LINE OF FOURTH AVENUE PROJECTED, THE SAME
REING THE AREA NOW INCLUDED IN SPECIAL LIGHTING DISTRICT NO. 100 OF
TEE CITY OF BOZEMAN: DESCRIBING THE BOUNDARIES OF SAID DISTR,ICT: THE
GENER.AL CHARACTER OF THE P'PPOVEMENT TO BE MADE: SETTING FORTH ESTIMATED
COSTS OF CONSTRUCTION AND COST OF MAINTAINING SUCH LIGHTS AND SUPPLYING
ELECTRICAL CURRENT THEREFOR FOR THE FIRST nAR; AND DETERMINING THAT
ONE-HALF OF THE COST OF INSTALLATION AND ONE-HALF OF THE ANNUAL COST OF
MAINTENANCE SHALL BE ASSESSED AGAINST THE PROPERTY WITHIN THE ~nSTRICT
AND THAT ONE-HALF OF THE COST OF INSTALLATION AND ONE-HALF THE COST OF
ANNUAL JlfAINTENANCE OF THE SYSTEM SHALL BE PAID FOR OUT OF THE GENERAL
FUND OF THE CITY OF BOZEMAN,
ALL UNDER THE AUTHORI'I'Y OF AND CONFORMITY
WITH SECTIONS 11-2245 TO 11-2257 INCLUSIVE, OF THE REVISETi CODES OF
MONTANA,
1947.
and thereafter, after due and legal proceedlnp;s had,
the Commission of the
City of Bozeman did on the 12th day of July, 1950, duly pass Commission
Resolution No. 677, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CI'lY OF BOZEMAN, MONTANA,
CREATING A SPECIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND
DESIGNATED AS SPECIAL IMPROVSWENT LIGHTING DISTRICT NO. 361 FOR THE
PURPOSE OF INSTALLING AND MAINTAINING A LIGHTING SYSTEM TO LIGHT MAIN
STREET EAST AND WEST, FROM NORTH BROADWAY AVENUE PROJECTED, THE SA1lli
BEING THE AREA FOW INCLUDED IN SPECIAL r,~PROVEMENT LIGHTING DISTRICT
NO. 100 OF THE CITY OF BOZEMAN AND THE MAINTENANCE OF SUCH LIGHTING

SYSTEM,
PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO.
674 OF Sll.ID CITY COMMISSION AS PASSED AND ADOPTED BY SAID CITY COMMISSION
ON Tfill 19TH DAY OF APRIL,
1950.
which Commission Resolutions Nos. 674 and 677, passed as aforesaid, are
hereby referred to and made a part of this resolution for further particulars
in respect to the boundaries of said district,
the character of the improve-
ments to be constructed therein,
the estimated cost of said improvements and
the method of assessing the cost against the property within said district;
and
WHEREAS,
said improvements as contemplated in said Commission Resolutions
Nos. 674 and 677 have been constructed and completed in accordance with the
terms and conditions of Commission Resolutions Nos. 674 and 677, and the
total cost of said improvements so constructed is the sum of Eight Thousand
Nlne Hundred One and 34!lOUths Dollars ($8,9Ul.34).
NOW,
THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5
and5485, R.C.M., 1935 and amendement! thereto,
BE IT RESOLVED Ai'TD I'J' IS HEREBY ORDERED BY TPE COM.MISSION OF' Tl-IE
CITY OF BOZEMAN, STATE OF MONTANA:
I
Section 1.
That to defray the cost and expense of constructing and
making the 1mprovements in said S~ecial Improvement District No. ~61,
there
be, and ther is hereby levied and assesspd a tax amounting to the sum of
Eight Thousand Nine Hundred One and 34!100thS Dollars ($8, 901.34) upon all
the property in said Special Improvement District No. 361,
that a particular
description of each lot and parcel of land with the name of the owner and the
sum assessed against him or it for such improvements and the amount of each
partial payment to be made and the day when the same shall be delinquent is

set forth in detail in the assessment list hereto attached, marked Schedule
"A", and made a pert hereof; that the severa! sums
set opposite
tbe names
of the owners and the described lots and parcels of land be,
and the same
are hereby respectively levied and assessed upon and against said described
lots and parcels of land to defray the cost and expense of constructing

and making the improvements within said District;
that the several sums so
assessed by collected from the respective owners
of said lots and parcels
of land described in said assessment list,
Schedule "A", as required by law;
that the payment of said sums shall be made in eight installments and the
payment of said installments shall extend over a period
of seven years; that
the payment of the respective annual installments shall be made on or before
the 30th day of November of each year until payment of all installments
together with the interest thereon, shall be made;
tha t said sums shall be
paid and the collection thereof shall be made in the nammer and in accord-
ance with the law governing the collection of special improvement taxes;
that failure to pay such assessments when the same become due and
payable
shall make such persons and said lots and parcels of land liable to the
penalties provided by law relative to delinquent taxes.
Section 2. That the regular session of the Commission of The
City of
Bozeman to be held in the Commission Chamber in the City Hall of said City
on the 1st day of November, 1950,
at 1:00 o'clock P.M., be, and the same

is hereby designated as the
time and place at which objections
to the final
adoption of
this Resolution will be heard by said Commission.
Section 3.
That the Clerk of the Commission of The City of Bozeman be,
and he is hereby ordered and directed to publish in the Bozeman Daily
Chronicle, a daily newspaper printed and published in the said City of Bozeman,
a notice signed by the Clerk of the Commission and stating that a Resolution
levying and assessing a special assessment of taxes
to defray the cost and
expense of const~]ctin? and making the improvements in the
said Special
Improvement District No. 361 is on file in the office of the Clerk of the
Commission subject to inspection for a period of five
( 5) da ya ;

MAIN STREET FROM BROADWAY I\VENUE TO FOURTH AVENUE PRO.TECTED.
NOTICE IS HEREBY GIVEN,
that at a regular session of the Commission of
the city of Bozeman, held on
the 25th day of October,
1950, Commission
Resolution No. 694 was dUlY passed and adopted;
that said Commission Resolution
levies and assesses a special assessment of taxes upon all the property in
Special Improvement Lighting District No.
361 in said City,
to defra y the
cost and expense of constructing and making the improvements within said
District to-wit:
Beginning at a point of
the eas t lir'e of Bloack CRouse's Addi tion 100
feet south of the south line of East Main Street;
thence west along a
linge lUO feet south of and parallel with the south line of
Main Street I
to a point 6 feet west of the east line of Lot 1 Block D Story's
Addition;
thence north across West Main Street to a point luO feet north
of the north line of West Main Street and 13 feet west of the
east line
of Lot 8 Block D Tracy's Addition;
thence east along a line lUO feet
north of and parallel with the north line of Main Street to
the east
line of Block D Rouse's Addition; thence south across East
Main Street
to the point of beginning.
That said Commission Resolution No.
694 is now on file in the office
of
the Clerk of the Commission, subject
to inspection for a period of five
days by any persons interested.
That Wednesday,
the 1st day of November,
1950,
at 1:00 o'clock P.M. of said day,
at the regular session of the said
Commission of the City of Bozeman, at the Commission Room in the City Hall
Building of said City, has been designated as
the time and place when and
where the said Commission will hear and pass upon any and all ob.1ections
that
ma y be made to
the final passage and adoption of said Resolution No. 694
and
the levying of said assessment, and
that said Resolution will be finally
passed and adopted at said re~}lar session.
All persons interested are referred to Commission Resolution
No. 674
declaring it
the intention of the Commission
to
Create Special Improvement
District No.
361, and Commission Resolution
No. 677, creating Special
