WHEREAS,
the City Council of the City of Bozeman heretofore duly and
regularly passed Ordinance No. 428,

ABA TE~lENT OF CERTAIN NUISANCES",
and
WEEPEAS,
Section 5039.82 R. C. M. 1935,
provides the Ci ty' or Town
Council has power to declare and determine what vegetation within the
City or Town shall be noxious weeds, and
to provide the manner in which
they shall be exterminated, and to require the owner or owners of any pro-
perty within said City or Town, to exterminate
or remove noxious weeds from
their premises, and the one-half of any road or
street lying next to the lands
or boulevard abutting thereon, and to provide,
in
the event the owners or
owner of any of said premises neglect to exterminate or remove noxious weeds
therefrom, for levying the cost of such extermination or removal
as special
assessment against the property; and
WHEREAS,
owners of premises in said City have neglected to exterminate
and remove noxious weeds therefrom during
the year 195U and the City of
Bozeman, pursuant to '::>ection 5039,82 R.
C. M. 1935, and Ordinance ~o.

have extermina ted and removed noxious weeds from the premises of said owners
and the total cost of the extermination and removal
thereof is charg,eabJ.e
to the property as hereinafter set forth,
pursuant to provisions of said
Section 5039.82, Political Code,
R.C.M.
1935, and said Ordinance No. 428;
BE IT RESOLVED AND IT IS HEREB'
ORDERED BY THR COMMISSION
OF THE CITY OF BOZEMAN,
S TA TE OF MONTANA:
Section 1.
That during the year 1950 the City of Bozeman has exter-
minated and removed noxious weeds from properties
in the City of Bozeman
and defrayed the cost thereof as set forth in schedule hereto attached
and made a part hereof.
See tion 2.
That to defray the cost ($75.84)
of exterminating and
removing said noxious weeds from said premises as set forth in said schedule,
hereto attsched and made a part hereof, for
the year 195U, there be, and
there is hereby levied and assessed a
special tax against said property
as set forth in said schedule,
hereto attached and made a part hereof;
that
a particular description of each lot and parcel of land with the name of the

owner and the sum assessed against him or it is set forth in assessment
list hereot attached marked "Schedule One",
and made a part hereof;
tha t the

the names of the owners and
the description of
the lots and parcels of land be,
and the same are hereby levied and assessed
upon and against said J.ots and parcels of land;
that the several sums be
collected from the respective owners of said lots and parcels of land
described in said assessment list, "Schedule
One", as required by law;
that
said sums shall be paid and the collection thereof shall be made
in the

manner and in accordance with the law governing the collection of special
improvement taxes; that failure to pay such assessments when same shall
become due and payable shall make such person and such lots and parcels of
land liable to the penalties provided by law relative to delinquent taxes.
Section 3. That the regular session of the Commission of the City of
Bozeman to be held on the 1st day of Novemeber, 1950, at the Commission . I
Room, City Hall Buildinl7' be and the same is hereby designated as the time
and place at which objections to the final adoption of this Resolution will .
be heard by the Commission.
Section 4. That the Clerk of the Commission be, and he is hereby
ordered and directed to publish in the Bozeman Daily Chronlcle, a daily
newspaper printed and published in the said City of Bozeman, a notice signed
by the Clerk of The Commission, stating tha t a resolution levying a special
assessment of taxes to defray the cost of exterminating and removing noxious
weeds from certain properties in the City of Bozeman for the year 1950 is
on file in the office of the Clerk of the Commission, subject to inspection
for a period of five days; that said notice shall state the time and place
at which objections will be heara by the Commission to the final adoption of
this Resolution; that it shall be ~lblished at least five days before the
date set by the Commission for hearing of ob.iections, and the final adoption
pf tjos Resolution.
Provisionally passed by the Commission of the City of Bozeman at a
rel'ualr session thereof held on the 25th day of octOber,~. y I

NOTICE IS HEREBY GIVEN, that at e regular session
of the Commission of
the City of Bozeman held on the 25th day of October,

Resolution No. 693 was duly passed and adopted; that
said Commission
Resolution No. 693 levies and assesses a special
assessment of taxes upon
certain properties
in the City of Bozeman for the year 1950 to defray the
cost: of exterminating and removing noxious weeds for the year 195U.
Tha t , said Commission Resolution No. 693 is now on file
in the office
of the Clerk of the Commission of said City of Bozeman subject to inspection
of all persons interested for a period of
five days; the t Wednesday,
the
1st day of November, 1950,
at l:UU o'clock P.M.,
of said day at a regular
session of the Commission of the City of Bozeman,
City Hall Building, has
been designated as
the time and place when and where
said Commission will
hear and pass upon any and all objections
that may be made to the final
passage and adoption of said Commission Resolution No. 693 and the levying
of said assessment; that, Resolution will be finally
passed at said
reVI1ar session of said Commission subject to such corrections and amendments
as may be made upon objections made and filed wi thin the five days limi t as
provided by law.
