OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THg PROPERTY IN SPECIAL IMPROVEMEN'r DISTRICT NO. 364 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMEN'rS WI: THIN SAID SPECIAL IMPROVEMEN'r DIS'rRICT NO. 364. WHEREAS, The City Commission of The City of Bozeman, did on the 18th day of October, I 1950, duly and regularly pass Commission RAsolution No. 696, entitled: A RESOLUTION OF THE CI'rY COMMISSION OF THE CITY OF BOZEMAN, MON'rANA, DECLJ:RING IT TO BE THE INTENTION OF SAID COMMISSION 'ro CREA'rE A SPECIAL IMPROVEMENT DIS- TRICT OF SAID CITY 'ro BE KNOWN AND DESIGNATE:D AS SPECIAL IMPROVEMEN'r DISTRICT NO. 364, FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SIX INCH WATER MAIN ON TVffiLFTH AVENUE SOUTH FROM WEST KOCH S'rREET TO WEST CURTISS STREET IN 'rHE CITY OF BOZEMAN, MONTANA, AND TO SPECIALLY ASSESS THE COST OF SUCH CONSTRUC- TION AND INSTALLATION AGAINST THE PROPERTY WI'rHIN 'rHE BOUNDARIES OF SAID SPECIP,L IMPROVEMENT DISTRICT SO CREATED ON AN AREA BASIS, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 8th day of November, 1950, duly pass Commission Resolution No. 698, entitled: A RESOLU'rION OF THE CITY COMMISSION OF THE CITY OF BOZEMJI,N, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 364- FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SHe INCH WNrER MAIN ON TWELFTH AVENUE SOUTH FROM WEc;T KOCH STREET TO ~NEST CURTISS STREET IN THE CITY OF BOZEMAN, MONTANA, PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NUMBER 696 OF SAID CITY COMMISSION AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 18TH DAY OF OCTOBER, A.D. 1950. which Commission Resolutions Nos. 696 and 698, passed as aforesaid, are hereby referred to and made a part of this resolution for further particulars in respect to the boundaries of' said district, the character of the improvements to be constructed therein, the es- timated cost of said improvements and the method of assessing the cost against the prop- I arty within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 696 and 698 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 696 and 698, and the total cost of said improvements so constructed is the sum of One Thousand Three Hundred Seventy-eight and 48/100 Dollars, ($1,.37S.48). NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5h.85, R. C. M., 1935 and amendments thereto. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the im- provements in saidSpecial Improvement District No. 364, there be, and there is hereby levied and assessed a tax amounting to the sum of One Thousand Seventy Eight and 48/100 Dollars ($1,378.48) upon all the property in said Special Improvement District No. 364, that a particular description of each lot and parcel of land with the name of theowner and the sum assessed against him or it for such improvements and tre amount of each I partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the name of the owners and the described lots and par- cels of ~nd be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District: that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "A", as required by law; that the payment of said sums shall be 282 made in ten installments and the p~yment of said installments shall extend over a period of nine years; that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collec- tiO~l thereof shall be made in the manner and in accordance with the law governing the collection of sped_al improvement taxes; that failure to pay such assessments when the . same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 2nd day of May, 1951, at 1:00 o'clock P.M., be and the same is hereby designated as the tlme and place at which objections to the final adoption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the Commission of TheCity of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the impr!Jvements in the said Special Improvement Uistrict No. 364 is on file in the office of the C~rk of the Commission subject to inspection for a period of five ( 5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before I the day set by the Commission for the hearing of obejctions and the final adoption of this Resolution Provisionally passed and adopted by the Commission of The City of Bozeman at a regular session thereof held on the 25th day of April, 1951. Attest: ~p:~ "Clerk of the City ommission - NOT ICE HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION NO. 708 LEVYING ASSESSMENT SPECIAL ASSESSMENT SPECIAL IMPROVEMENT DISTRICT NO. 364, CITY OF BOZEMAN, WATER MAIN ON TWELFTH AVENUE SOUTH FRqM WEST KOCH STREET TO WEST CURTISS STREET IN SAID CITY. . NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 25th day of April, 1951, Commission Resolution No. 708 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon ell the property in Special Improvement District No. 364 in said City, to defray the cost and expense of constructing and making the improve- ments within said District, to-wit: Commission Resolution No. 708 - -" ..- --"...--... .--- 283 Beginning at a point where the west line of Twelfth Avenue South inter- sects the center line of West Koch Street;thence west along the center line of West Koch Street a distance of one hundred twenty six feet to the intersection of the center line of West Koch Street with the east line (pro j ected) of the vacated alley in Block 7, West Side Addition to the City of Bozeman; thence north along the east line of said vacated alley in said Block 7 a distance of three hundred sixty (360) feet to the center line of the vacated portion of West Curtiss Street between Block Seven (7) and Block Two ( 2) of said West Side Addition; thence east along the center line of West Curtiss Street and the vacated portion I thereof to a point one hundred twenty-six (126) feet east of the east line of Twelfth Avenue South; thence south along a line one hundred twenty six (126) feet east from and parallel to the east line of Twelfth Avenue South to the center line of West Koch Street; thence west along the center line of West Koch street to the point of beginning. Tha~ said Commission Resolution No. 708 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five ( 5) days by any persons interested. That Wednesday, the 2nd day of May, 1951, at 1:00 o'clock P.M. of said day at the regular session. of the said Commission of the City of Bozeman, at the Commission Room in the City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 708, and the 1 evying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 696 declaring it to be the intention of the Commission to create Special Improvement District No. 364 and Commission Resolution No. 698, creating Special Improvement District No. 36~., for constructing and making the improvements therein.
