HomeMy WebLinkAboutResolution 707 Taxes for SID 363 ..--.- -.-- 278 COMMISSION RESOL~rION NO. 707 A RESOLUrION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMEN'r DISTRICT NO. 363 IN 'rHE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVE- MENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 363. WHEREAS, The City Commission of The City of Bozeman did on the 13th day of September, 1950, duly and regularly pass Commission Resolution No. 686, entitled: I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZElVIi-I.N, MON'rANA, DECLARING IT 'ro BE THE TN'rEN'rION OF SAID CDMMISSION TO CREA'rE A SPECIAL IMPROVEMENT DISTRICT OF SAID CI'rY TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NO. 363" FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SIX INCH WATER MAIN ON WEST BEALL STREET BETWEEN NORTH THIRD AVENUE AND NORTH FIF'.rH AVENUE IN THE CITY OF BOZEMAN, MONTANA, AND TO SPECIALLY ASSESS THE COST OF SUCH CONSTRUCTION AND IN- STALLATION AGAINST THE PROPERTY WITHIN 'rHE BOUNDAPIES OF SAID SPECIAL IMPROVEMEN'P DISTRICT SO CREATED ON A FRONT FOOT BASIS, PURSUANT TO THE STA'rUTES IN SUCH CASES MADE AND PROVIDED, and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 4th day of October, 1950, duly pass Commission Resolution No. 689, entitled: A RESOLUTION OF THE CITY COMMISSION OF TIm CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMEN'r DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 363 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SIX INCH WATER MAIN ON WEST BEALL STREET BETWEEN NORTH THIRD AVENUE AND NORTH FIFTH A VENUE IN 'rHE CITY OF BOZEMAN, MON'rANA, PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTI;JN NO. 686 OF SAID CITY COMMISSION AS PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 13TH DAY OF SEPTEMBER, A.D. 1950, which Commission Resolutions Nos. 686 and 689, passed as aforesaid, are hereby re- ferred to and made a part of this resolution for further particulars in respect to the boundaries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against I the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 686 and 689 hIve been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 686 and 689, and the total cost of said im- provements so constructed is the sum of Two Thousand Three Hundred Sixty-five and 99/100ths Dollars ($2,365.99). NOW, 'rHEREFORE, pursuant to the provis ions of SectLms 5225 to 5277.5 and 5485, R.C.M., 1935 and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MON'rA.NA: Section 1. That to defray the cost and expense of comtructing and making the improvements in said Specail Improvement District No. 363, there be, and there is hereby levied and assessed a tax amounting to the sum of Two Thousand Three Hundred Sixty- Five and 99/100 Dollars ($2365.99) upon all the property in said Special Improvement District No. 363, that a particular description of each lot and parcel o~ land with the name of the owner and the sum assessed against him or it for such improvements I and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of 1 d d . an escribed in said assessment list Schedule "A" , , as 279 required by law; that the payment of said sums shall be made in ten installments and thei payment of said installments shall extend over a period of nine years; that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the I manner and in accordance with the law governing the collection of special improvement taxe s ; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 2nd day of May, 1951 at 1 :00 0 I clock P .M, be and the same is hereby designated as the time and pIa ce at which objections to the final adoption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the Commission of The City of Bozeman be, andhe is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 363 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; tha t sal d Notice shall state the tine and pla.ce at 'vhich objections will be heard by the Commission to the final I adoption of this Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolution. Attest: d~~ Clerk 0 the City Commission N 0 TI C E HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION 707 LEVYING ASSESSMENT SPECIAL I IMPROVEMENT DISTRICT NO. 363, CITY OF BOZEMAN, WATER MAIN ON WEST BEALL STREEr BETWEEN NORTH THIRD AV}1, NUE AND NOR'rH FIFTH AVENUE IN SAID CITY. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bo ze~nan held on the 25th day of April, 1951, Commission Resolution No. 707 was provision- ally passed and adopted; that said Commission Resolution ~vies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 363 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit: _u 280 Beginning at a point on the west line of North Thtrd Avenue 50' north of the north line of West Beall Street; thence west along a line 50' north of and parallel with the north line of West Beall Street to the east line of North Fifth Avenue; thence south along the east line of North Fifth Avenue to a point 50' south of the south line of West Beall Street;thence east along a line SO' south of and parallel with the south l,ine of West Beall street to the west line of North Third Avenue; thence north along the west line of North Third Avenue to the point of beginning. Tha t , said Commission Resolution No. 707 is now on file in the office of the Clerk of the Commission, sliliject to inspection for a period of five (5) days by any persons I interested. 'rha t Wednesday, the 2nd day of May, 1951, at 1:00 o'clock P.M. of said day at the regular session of the said Commission of The City of Bozeman, ~ the Commission Room, in the City Hall of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adDption of said Resolution No. 707, and the 1e vying of said assessment, and thet said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 686, declaring it to be the intention of the Commission to create Special Improve:nent District No. 363, and Commission Resolution No. 689, creating Special Improvement District No. 363, for constructing and making the improvements therein..
