I Declaration of Intention Tha tit is hereby declared to be the in ten tioD of The Ci ty of Bozeman to Create a special improvement lighting district to be known and designated as Special Improvement Lighting District ~lmber 365 of The City of Bozeman for the purpose of installing and maintaining a lighting system to light South Eighth ,- .- -- Avenue North and South, from the :::'outh Line of West Maln street to the North line of West Harrison Street in said City. Boundaries The boundaries of said proposed Special Improvement Lighting District No. 365 are described as follows: Begln~ing At a point in Block F, Story's Addition on the South line of West Ma5n Street which point is one hundred twenty five (125) feet east from the east line of South Eigh~h Avenue; TlillNCE' south along a line parallel wi th and one hundred twen br fl ve (125) fee t ea s t from the eas t line of " South Eighth Avenue to the north line of West Harrison Street; THENCE west along the north line of West Harrison Street and the North line of West Harr1,son Street projected to a point one hundred twenty five (125) feet west from the west line of South Eighth Avenue; THENCE north along a line parallel with and one hundred twenty five feet west from the west l:ine of South ~ighth Avenue to the South li~e of West Main Street; THENCE east along the south line fo West Main Street to the point of Beginning. I Section 3. Character of Improvements The Character of the improvement to be made in said Special Improvement to be made in said Special Improvement Lighting District No. 365 is the erectlnn, installation, maintenance and operation of eighteen (18) s te e 1 ornamental light posts, each to be set on an adequate concrete base and each to be equipped with tqo (2) brackets and two (2 ) luminars, with electric lamps, wires, pipe conduits to carry the electric current therefor, said . --.---..-.---- ----.- 266 wires and pipe conduits to be underground, and all other suitable or necessary applian~es for the purpose of lighting said street. Section 4. Esti mate of Cost and Method of Assessment The preliminary estimate of the cost of instellation of the lights and other material necessary to made the said improvement within said Special Improvement District No. 365 is Six Thousand F01Jr Hundred and no/lOO ($6,4UU.UO) I Dollars, of which sum seventy five (75%) per cent is to be assessed against the propertyembraced within said District on an area basis, and twenty f1 ve (25%) per eAn tis to be paid by the City of Bozeman, t"e estimated rate of assessment per square foot of property within said District being $0.0058443, with the property within twent':T five feet from South Eighth Avenue to be assessed Bt double the rate of assessment against other property within the Dis tric t. Section 5. Estimate of Cost of Maintenance and Electi.rical Current and Method of Assessment An estiFate of the approxima te cost of maintaining such lights and supplying electrical current therefor for the first year is the sum of Six Hundred Sixty and no/lOa ($66U.UO) Dollars, and the same sum for each year thereafter, of which total sum seventy five ( 75% ) per cent is to be assessed against the property embraced within said District on an area basis, and twen ty five (25%} per cent to be paid by the City of bozeman, tl e es tima ted rate of assessment per year per square foot against the property embraced I within said District being $;0.000602697, with the property within twenty five feet from South Eighth Avenue to be assessed at double the ra te of assessment against other property within the Dis tric t. Section 6. , Actual Area of District The total area of the property within said proposed Special Improvement Ligh ting Dis tric t No. 365 is 684,423 sqlJare fee t, which is the area on which all protests will be received, considered and determined. Section 7. The payment of the cost of installing and constructing said improvement shall be paid in eight (8) ennua I in s ta llmen ts . Section 8. That Wednesday, the 17th day of Jamlary, A.D. 1951, at one o'clock P.M. at the Commission Poom of the City Hall, Bozeman, Montana, is designated by said Resolution No. 7U2 as the time and place for hea:ring objections to the action proposed to be taken by said resolution, and when and where any and all persons whose property is within said proposed Special Improvement L1a:h ting Dis tric t No. 365 on SOli th Eighth Avenue, North and Sou th, from the South line of West Main Street to the North line of West Harrison Street in said City may appear and show cause,if any they have, against said proposed i4provement. Objections must be made in writing and filed with the Clerk of 'Ibe City Commission not later than fifteen (15) days after the date of the first publication of this Notice. I An approxiamte and preliminary estimate of maintaining such lights and supplying electrical current therefor for the first year is the sum of Six Hundred Sixty ($660.00) Dollars, and the same sum for each year thereafter, of which total sum seventy five (75%) per cent is to be assessed against the property embraced within said District on an area basis, and twne ty five (25%) per cent is to be paid by the City of Bozeman, the es tima ted rate of assessment per year per square foot against the property embraced within said District being $0.000602697 per square foot, with the property within twenty five feet from Wouth Eighth Avenue to be assesssed at double the rate of assessment against ot~er property within said District. The total actual area of the property within said proposed Special Improvement Lighting District No. 365 is 684,423 square feet. Payment for the improvements to be made in this District is to be made in eight ( 8) annual installments with interest on the deferred payments not to exceed six (6%) per cent per annum, payable annually, but this shall not be construed to prevent payment in full at any re/SUlar payment date by any I property owner. For a description of the Boundarles of sajd Special Improvement Light- ing District No. 365 reference is hereby made to Resol1J.tlon No. 702 of the Commisslon of The City of Bozeman declarin~ the intention to create said District, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
